Montana Disabled Hunter Permits: State Aims To Cut Abuse

HELENA, Mont. -- Montana wildlife regulators suspect more and more people are faking disabilities to take advantage of privileges granted to disabled hunters, so they want to remove one of those perks in hopes of curbing abuse.

Permits to hunt from a vehicle, called PTHV permits, are given to Montana hunters with certain disabilities certified by a doctor, chiropractor, nurse or physician's assistant. The permit allows a disabled person who can't get around without assistance to hunt from a self-propelled or drawn vehicle.

In some prime hunting areas, those permit holders are allowed to drive along roadways normally gated and closed to all other vehicles. They are also allowed to shoot cow elk without buying an additional antlerless elk license, even in some areas where licenses aren't available to the general public.

That kind of access has led to abuse of the permits by apparently healthy hunters, Montana Fish, Wildlife and Parks officials said.

"Most of what we see is people utilizing the permit as an opportunity or a resource to be able to take an antlerless elk," said James Kropp, the FWP's chief of law enforcement. "They're a long way from their vehicle dragging elk off the mountain unassisted, really in a situation the permit was not designed for."

As of Monday, 9,188 lifetime PTHV permits have been issued, according to FWP. The result has been a reduction in the number of cow elk in some areas, such as the Bitterroot Mountains in southwestern Montana, said FWP commission chairman Bob Ream.

"The population is being knocked back because of the substantial cow harvest in certain districts," Ream said.

But even when they encounter instances of apparent abuse, it's usually difficult for wildlife officials to penalize a person who holds a valid permit without putting them in the awkward position of deciding whether a person is disabled.

"Given the fact that these are signed off by a medical physician, it's not really our judgment to determine whether they are or they aren't," Kropp said.

Ream and his fellow commissioners gave initial approval Friday to a plan that would ban holders of the special permit from shooting shoot cow elk with just a general big-game permit.

The ban, which was originally proposed by a disabled hunter's group out called Blackfoot Access Group, aims to curb the problem by taking away one of the biggest incentives for abusing the program.

"You've got so many people who scam their way into getting a PTHV because of these incentives," said George Hirschenberger, a retired Bureau of Land Management program manager who works with the Blackfoot Access Group. "We're not asking for that privilege to go away, we're asking the commission to suspend the privilege until the PTHV is back under control."

Hirschenberger said he saw evidence of the abuse in the sheer number of people without apparent disabilities who would arrive at his BLM office and at other BLM and U.S. Forest Service offices seeking keys to open the gates of the roadways closed to all but the PTHV permit holders.

"If this guy can walk from his car to the front desk without a problem, what is the reason for him to have a PTHV?" Hirschenberger asked.

Ream said he hopes the ban will be a temporary measure that lasts just until the Legislature tightens the criteria to qualify for the permits, a cause the Blackfoot Access Group plans to lobby for during the 2013 legislative session.

The permit qualifications are set in state law. A person must be dependent on an oxygen device, wheelchair, crutch or cane, or else be an amputee above the wrist or ankle. The last qualifying clause is that a person must be unable to walk unassisted for 600 yards over rough terrain while carrying 15 pounds within an hour and be unable to handle or maneuver up to 25 pounds.

"That last clause – that's ridiculous," Ream said. "It needs to be more medically based than that. And secondly, it shouldn't be a lifetime permit."

That last category is where the biggest spike in PTHV applications comes from, and those applications have been rising since 2008, when the commission allowed permit holders to hunt cow elk without a license, FWP spokesman Ron Aasheim said.

In 2005, before the change, 564 new permits were issued to disabled hunters who cited that qualifying condition. In 2009, the year after the change, 943 new permits citing that condition were issued, Aasheim said.

The proposed ban, which is now out for public comment before a final decision will be made in February, has been endorsed by hunters' groups in Helena and Missoula.

"This proposal will return respect for the disabled hunters program," said Rod Bullis of Helena Hunters and Anglers.

i have Cerebral Palsy, Spina Bifida Occulta, Spinal Stenosis, Scoliosis, and Epilepsy. even though i have all of this; i have never applied for a DHP !!!!!!...i've even had to PROVE to the SSA that i was disabled before i received disability. the woman at the local SSA office,.that i had to speak with, told me that i wasn't disabled !!!!!!...then she said, my "husband's in a wheelchair, he's disabled !!!!!"

i cannot walk as well as you folks do, and my right hand doesn't work as it should...i used to hunt small game and deer, however, i can't hunt now. my hunting is limited to target practice because the isn't any area situated for the disabled to hunt from....i've NEVER asked for ANYTHING because i've pushed myself to be self-seficient. i was told by my dr that i must use a wheelchair now, because walking is very hard for me now, and i'm not looking foward to it.

as a side-note...someone here mentioned wolves decimating the elk and deer population...wolves take those who are elderly or infirm only !!!!!!

What is the correlation between people claiming a disability for a hunting permit and a parking permit? I am sure it is a very positive relationship.

Another good intentioned idea gone crazy.I can remember when being handicapped meant your were getting around in a wheelchair because you could NOT walk.
Now,it seems to mean you are over 50 and got your Dr.to sign that you need a Handicap Placard.
It is sickening to watch overweight people who NEED to do a little walking, unload their Hoveround (that didn't cost them a dime!! but cost taxpayers) to go shopping.
If you can manage unloading one of those,you dont need one.
As far as hunting from ATVs etc...I say that it is not safe for several reasons.When people lose their sight,we dont allow them to continue to drive.Same thing here.Not everybody should be allowed to hunt.

My point exactly.If you are chaired because you have a spinal injury etc...thats one thing.
But the majority of people using these motor chairs are NOT in that group.
People start gaining weight and then begin to have ailments if they dont LOSE weight.It is that simple.
My MIL recently changed heart doctors after years of walkers,hoverounds handicap parking stickers etc.
She had grown heavy,immobile,unhappy and to be honest,an unnecessary burden on others.
To make a long story short,one of the first things that happened was he told her to stop using her ailments as an excuse to not get exercise.
He told her to get rid of the walker as all it was doing was greasing the tracks to being bedridden for no good reason.Heart,weight problems are not spinal problems.
She was sent to a rehab hospital for a week to get some muscles working.
Since then,she has gotten her life back (and we have too).No more handicap placard,no more walkers etc.
So when they let you have these things...just remember,they are not going to force you to exercise or lose weight.They get paid no matter what.
The day will come when people will realize many of the ailments American suffer from are self induced.
Our government would be doing LOTS of people a favor by going back to WHEELCHAIR people being the only ones that get the handicap placard...Get some exercise.You will live a longer ,happier life.

Relax a law to help someone with disabilities "compete" - and you always have those who feel the laws are not for them and they can take advantage and do as they please- . I have very tiny speck of respect for bloodsport hunters in the first place--and absolutely zero for those who take advantage of disabled people in any way, muchless impersonating them.

If they don't have a blue handicapped plate or sign, they shouldn't get a handicapped permit.

And lifetime? Nope. It should be issued one year at a time, like all other licenses.

And they should still have to buy a tag for every kill. No cows.

The bean counter can't understand why the number of disabled hunters has increased in recent years, one thought for him: IRAQ, Afganistan. And while this disabled Vet could walk from the parking lot to his desk, 600 yds ain't gonna happen anymore.

Hunting in Montana is a given. We have a huge disabled Veteran population and I think this bill was meant to make hunting more accessible to them. Getting your meat in the wilderness is much more difficult then in the grocery store.

You seem to know little about hunting. The shooting part is the easiest part of it all. It's the butchering, cleaning, and moving a 600lb+ carcass that's lots of work. Hunting is actually very easy until you kill something, then it's nothing but hard work.

A nurse, chiropractor or assistant shouldn't have the authority to designate someone handicapped for the purposes of the DMV or hunting. That should be a doctor's only designation.

They also shouldn't be lifetime permits but issued yearly.

Agree with the doctor but some one who is in a wheelchair for life should not have to go through the process of proving they are disabled every year in order to be able to hunt. For someone with a temporary disability that would make more sense.
