California Cough Syrup Ban Goes Into Effect For Minors

Ca Institutes Cough Syrup Ban

In an effort to prevent kids from abusing a dangerous and trendy new drug, the state of California has banned the sale of cough syrup to minors starting at the beginning of this year.

SB 514 went into effect on January 1, prohibiting the sale of non-prescription drugs containing dextromethorphan (DXM) to persons under the age of 18.

DXM is a cough suppressant commonly found in over-the-counter cold medicines like Robitussin, NyQuil and Dimetapp. When either chugged in large quantities or processed into an extremely potent form, DMX can produce a euphoric, almost hallucinogenic, high often called "robotripping" or "dexing."

It can also lead to seizures, hallucinations, loss of motor control and enjoying listening to music that sounds like this.

"Ingesting too much cold medicine can be just as hazardous as drinking too much alcohol and it is cheap, easy and legal for children to obtain," wrote sponsor State Senator Joe Simitian in the bill's comments section. "The fact that DXM is legal and readily available over-the-counter suggests to most young people that these products are entirely safe. Indeed, that false sense of security has been identified as a contributing factor in abuse."

"It is the number one drug of choice for children under 18," Pediatrician Dr. Janesri De Silva told CBS 42, "[it's] more common than even marijuana because it is so easily accessible."

Simitian initially proposed the law in 2004 after one of his constituents pitched it as part of a "There Oughta Be A Law" contest; however, the measure never made it though the legislature. In the years since, abuse of the drug in the state has grown exponentially, which spurred lawmakers to take action.

The San Jose Mercury News reports:

The California Poison Control System reports that DXM abuse calls for children under age 17 have increased 850 percent in the past decade, making DXM abuse the most commonly reported type of abuse in this age group.

The bill was signed into law by Governor Jerry Brown last spring but only went into effect this year--making California the first state in the nation to take such a strong stance against DXM.

If a store is caught selling a product containing DXM, they'll be subject to a $250 fine.

Even so, some are questioning the law's effectiveness and are urging the state to do more. The San Francisco Chronicle reports:

[San Rafael parent Mark Dale, whose son has repeatedly overdosed on the drug] said the new law may help curb abuse but won't stop it, because teenagers often shoplift these cough medications, steal them from medicine cabinets and get them from other kids. Classifying the drug as a controlled substance, which would make it prescription-only, or requiring retailers to keep it behind the counter would be more effective.

Correction: The article originally stated that the processed form of DXM is called "sizzurp." While similar, and also prepared using cough syrup, "sizzurp" (or "purple drank") derives its high from the active ingredient promethazine and not dextromethorphan.

I completely understand why the parents of children who have dealt with this would support this law. However, the problem is not that these kids CAN buy cough syrup and get high with it, but that they do. To the people that say the kids doing this need to be parented better, you must not have kids. This is a problem that transcends race, wealth, class, religion, and every other thing you can think of, including parenting skills. It is a human problem. AOD (Alcohol and Other Drugs for those who don't speak addiction) have been around FOREVER, and so has addiction. When our culture starts to treat it more like a medical issue and less like a societal status issue or a legal issue, we might then raise a generation of children who understand WHY instead of just DON'T. Its like if a sign says "don't touch this or you will die" vs. "don't touch this or you will be fined/jailed" my bet is on the first one keeping people from touching something, and the second one encouraging people to touch something. We are human and we like to test boundaries for the most part. Like any other caged animal, we instinctively try to escape our captivity no matter how "good for us" it is. The War on Drugs is just another cage.

i'm from alabama an robotripping has been around for years. i even used it a couple times when i was younger an drinking 2 6oz. bottles is a cheap high that lasts for hours an to say you might hallucinate is a understatement. the high is sort of like lsd and as with lsd you may have a "bad trip". but on a serious note even though i tried it years ago. my wifes best freind got addicted to it an for about a year her husband had to try an keep her from getting it but she always would. she took to much one night an what the investigatment turned up is that she probaly had a seziure fell hit her head on a table an when her husband found her she was already brain dead. so as with any drug that you abuse you run the risk of something really bad happening. but used as directed it is the best over the counter cough med. so like with everything there are good an bad things about them. an just like sufifed its a great decongestment but ppl. also make meth from it. wheigh the good an the bad voice your points to your city councilmen an go by what they decide. not much esle ya can do...

I know a kid who drank cough syrup (a lot of it) he is now a certified psycho. He thinks he is God. He was a fairly normal and quite intelligent teenager. Sad, I liked him.

Good call Ca. a actual law that makes since....I mean how many minors need to have to go to the store to buy cough syrup...That's their parents job...Of course there are going to be people complaining about the law...Kids are to lazy to look in the fridge for food if it's not right in front of them. So the only ones that are going to put the effort into buying the cough syrup are the ones that want to get high...

#1??? I seriously doubt it. I know it is not more popular than marijuana. In fact, it probably is not in the top 5.

You know this how?
07:17 PM on 01/04/2012
Didn't say I know, I said, "I...doubt." From statistics I have read, marijuana is the most popular drug second only to alcohol, it even beats out cigarettes. I do not know this to be fact but unless you are a hermit, it should be obvious.
12:48 PM on 01/24/2012
I agree that it probably is not more popular than marijuana. I think that calling it the number one is probably because it causes kids to need medical attention for seizures, overdosing, etc. so it seems more prevalent. Marijuana only causes kids to seek medical attention when they freak out because they can hear their heart beating...which doesn't happen too often. lol.

Why are ANY medications allowed to be sold to minors? Even over-the-counter. legal medicines have 'use only as directed' warning on them. Most Children can't understand dosage instructions. Some adults cant.

No one is being "punished". They are only restricting sales to minors. If you're over 18 you have nothing to worry about. If you're under 18 your parents should be buying your medicine when you're sick. I'd rather they restrict sales if it means preventing a few deaths. Why is this such a problem for you? Or are you under 18, live in Cali and it just got harder for you to get high?

I'm 56 and live in NH
. I grew up in the land of the free and home of the brave. Not the land that restricts everything. One can justify anything if one wants to. Like the government telling us we have to wear seat belts. While seat belts are a great idea the government has no busuness telling us we have to wear them or else. They have no right to tell me i have to wear a helmey when I ride my bike thats up to me and no one else. If a kid wants to get high they are going to. Drugs are illegal and you can get them anywhere that law really helps........NOT!!!!

They can even get high with the acetone remover....
When there is a will, there is a way....

Exactly. And that goes for everyone, not just kids. Probably kids shouldn't be buying medication that you CAN overdose on, but if they think that this will stop anyone getting high they are sorely mistaken.

Somebody is going to make money selling it to California on line ..! You can't deny everyone a remedy, because of a few abusers. They call that poor Governance

Did you read the article, or just the headline? No one is being "denied a remedy". They are only restricting sales to minors under 18. Adults will still be able to buy it is they need it. Learn how to read. They call that poor education.

Sixteen and seventeen year olds, get sick too they'll just obtain it on line. Attacking me personally, is usually a sign, of some sort of personal issues, and is unbecoming of anyone of any age....!

I don't really have a problem with this law. You can't buy alcohol if you are under 21 and I know that cough syrup can mess you up depending on how much you use. Why would a child buy the stuff on their own if they were going to use it as directed? It's not like they said "OK, now cough syrup is illegal across the board for everybody". I would think that a store that sold the stuff would be liable if the customer hurt themselves or someone else under the influence of it just as a bartender can get a charge for over-serving. For once a law that makes a bit of sense.

and from the state that gave us LSD in the 60's; cocaine in the 70's, and medical marijuana now . . . just don't make sense. Or perhaps that's my cough syrup talking . . .

No one ever died from taking medical marijuana. And if you think the state of California is responsible for LSD and Cocaine, you have bigger issues than your cough medicine.
