Joe Arpaio Asks For Facts To Back Up Civil Rights Case

Joe Arpaio

By JACQUES BILLEAUD   01/ 4/12 06:55 PM ET   AP

PHOENIX -- An Arizona sheriff whose office has been accused of a wide range of civil rights violations conditionally agreed Wednesday to take part in discussions with federal officials about ways to correct the alleged violations.

Maricopa County Sheriff Joe Arpaio said that his office first needs the U.S. Justice Department to provide facts to back up its allegations that his office racially profiles Latinos, bases immigration enforcement on racially charged citizen complaints and punishes Hispanic jail inmates for speaking Spanish.

"I have a suspicion that politics might be involved in this, but we want to resolve (the case)," Arpaio said.

Joseph Popolizio, one of the lawyers representing the sheriff's office, said in a letter to Justice officials that Arpaio was ready to go to court if federal authorities refuse to provide the information to back up their claims.

The self-proclaimed toughest sheriff in America has been a national political fixture who has built his reputation on jailing inmates in tents and dressing them in pink underwear, selling himself to voters as unceasingly tough on crime and pushing the bounds of how far local police can go to confront illegal immigration.

The sheriff's office said it doesn't discriminate against Latinos and that Justice Department didn't provide facts to support its allegation that Arpaio's office has a culture of disregard for basic constitutional rights.

Popolizio said in his letter that constructive talks between Washington and the sheriff's office could occur only if the Justice Department backs up its allegations.

"We are merely requesting the opportunity to conduct our own weighing of the reliability of the evidence in your possession," Popolizio said.

The changes in the sheriff's office that Justice officials were seeking include training in constitutional policing and dealing with jail inmates with limited English skills, collecting data on traffic stops and immigration enforcement, and establishing a comprehensive disciplinary system that permits the public to make complaints against officers without fear of retaliation.

Arpaio's lawyers set a Jan. 18 date for the Justice Department to say whether they would provide the information and believe federal officials could provide that information by March 19.

The civil rights allegations have led some Arpaio critics to call for the sheriff's resignation. Arpaio has said he won't resign and intends to seek a sixth term this year.

Separate from the civil rights probe, a federal grand jury has been investigating Arpaio's office on criminal abuse-of-power allegations since at least December 2009. That grand jury is examining the investigative work of the sheriff's anti-public corruption squad.

Why would I search for a cat when the report clearly says it was a dog who bit the old woman? I know... it's called profiling and if I only question dogs then I may be guilty of intimidation and profiling of dogs. So to be fair I must detain and question at least 9 innocient cats for every 10 dogs. Give me a friggin break! You can't fight crime if you aren't allowed to profile the physical characteristics of the reported criminal! Go Joe!!!!!!!

You wash dishes for 12 hrs a day, be a day laborer, or even watch your taxes go to deporting hard working people for doing the jobs that you're too lazy to do yourself. Christ, go Joe? I hope every single person he deports comes right back. Si Se Peude!

It is too bad the Justice Dept did not document its findings. It is like going to trial, and simply having the prosecutor read the charges, and thinking that was enough to convict. While that is true in many parts of Texas and the south, a decent respect for following the law would mandate some FACTS to back up charges. That the Sheriff has to threaten to go to court to get such FACTS says a lot about the flimsy nature of such charges.

They would have done better to concentrate on where the grand jury is looking at the obvious abuse of power against his poitical opponents.

Support states rights! To be more autonomous, states must keep more of the taxes paid by their own residents, accept more responsibility, and depend less upon the federal government. Each state should be an experiment in policy-making to serve as an example for other states. If Arizona wants to harass and deport all their Mexicans then let them. Texas and California will gladly accept them. Let Arizona find other workers for agriculture, construction, and all the labor-intensive jobs that fat, lazy Americans like Arpaio will not do. Let the xenophobes of Arizona reap the harvest of their ignorance.

I see that YOU are a racist by calling Americans fat and lazy, and I most certainly hope that you include yourself in that group since you are not out there doing that work obviously. It is even more disturbing that such virulent racism is allowed by the moderators. Of course, one has to wonder how Americans ever built anything or fed ourselves before the massive influx of illegals. I guess we just conjured up those things without breaking a sweat? Or I guess that you have never heard or read John Steinbeck about the AMERICANS who did all that work before Mexicans came.

This racist wants to play the martyr while he continues his witch hunt on people of a certain color of skin. He has already displayed himself as such and has to stop crying wolf. He started this mess by getting on a soapbox proclaiming his obvious racism.

Joe Arpaio will go down in history along with some other "heroes": Bull Connors and George Wallace. Within a generation his fans will be deceased and his name will be mud.
12:27 PM on 01/09/2012
True. Within a generation, the people he so detests will be very much part of this country and Joe will be just a bad memory.

I'm only sorry he gives Italian-Americans a bad name.

"Sheriff Joe raids another business, illegal aliens found hiding in dumpsters."

2 Dec 1012

"On Friday, Maricopa County Sheriff’s deputies raided both Parks and Sons Inc. locations in El Mirage, and Youngstown, AZ. The raids came after a six month-long investigation tracked illegal alien identity thieves to the trash collection business.
Seven suspects were arrested. One had an outstanding warrant, two were targets of the investigation, and four more were discovered and turned over to Immigration and Customs Enforcement. All are in the country illegally.
Apparently, just before deputies arrived, a cell phone call tipped off the illegal aliens to the raid, as some hid in dumpsters, and others had to be pulled from the barbed wire fence surrounding the properties."

There are no "facts" in the case, Joe, beyond the fact that Obama and the Just-us Department loathe Americans and love invaders.

Joe is being set up by the Feds who are in collusion with LaRaza and the ACLU. I hope the facts do come out about this and I predict the Fed's charges will be found to be fallacious and will be eventually be withdrawn.

Great Sheriff? Now I'm sure You don't live in Mesa, where the people see Arpaio deputies like a represive force instead of a protection force.
10:53 PM on 01/07/2012
that's because most of them are here illegally. Mesa has turned into little MEXICO. give me a break.
06:41 AM on 01/08/2012
The people who are here legally have nothing to fear. Just like me, when I am pulled over I MUST present ID, insurance, registration. Don't have it with you....WHY? Oh you don't speak english yet you're 30 years old....
I live in Mesa....I love Joe.....as do 60% of those of us who are legal.

How do you feel about the molestation victims that Joe was too busy to investigate? I guess he had more important stuff to do (like investigate the President's birth certificate).

The federal case rest mostly on statistics that show the Maricopa County Sheriff Office stops and arrests Latinos at higher rates than non-hispanic whites. However, this is true in law enforcement agencies across the country. The Maricopa County Sheriff Office has won similar lawsuits by presenting data that shows Latinos are stopped and arrested at higher rates because the office focuses on high-crime areas.

He has gotten use to bullying local officials, minorities, and prisoners. He is going to be finding out that he can not bully the Feds.
10:43 AM on 01/06/2012
He is going to find out that every latino that has had a run-in with the sheriff's office is a witness, and can testify against him. That is proof enough!

Right, because the will of the electorate is not important. The claims of a politically-favored group are more important than the choice of the voters or the rule of law.
