Nancy Black, Marine Biologist, Indicted For Violating Marine Mammal Protection Act (Video)

SAN FRANCISCO -- A marine biologist who runs popular whale-watching tours on California's Monterey Bay has been indicted for violating federal laws that protect marine mammals, though her attorneys said her interactions with the creatures were scientific research.

Nancy Black, a marine scientist whose work has been featured on PBS, National Geographic and Animal Planet, was charged Wednesday with four violations of the Marine Mammal Protection Act.

She was accused of feeding killer whales in 2005 during a research trip, and misleading investigators by editing video footage of her encounters with other whales during a whale watching trip, and then lying about it. All of the alleged incidents occurred within the Monterey Bay National Marine Sanctuary, one of 13 ocean sanctuaries established in 1992.

Prosecutors say the charges were filed after an investigation by the National Oceanic and Atmospheric Administration and U.S. Department of Justice. Wyn Hornbuckle, a spokesman for the DOJ, declined to comment, as well as a spokesman for NOAA.

In addition to her scientific work, Black owns Monterey Bay Whale Watch and operates two commercial whale-watching vessels. Black has also worked with federal agencies on the study of whales, including the National Marine Mammal Laboratory, which is part of NOAA.

If she is found guilty of editing the video and then lying about it, Black could receive a maximum sentence of 20 years in prison and a half million dollars in fines. Each of the feeding charges carries a maximum penalty of a year in prison and a $100,000 fine. While these are the maximum sentences allowable by law, courts generally do not impose the maximum, instead relying on guidance from the U.S. Sentencing Commission.

According to the indictment, Black was asked to provide video taken from her whale-watching boat during an October 2005 trip that investigators believe included an illegal encounter with a humpback whale. Whale-watching boats are supposed to stay at least 100 yards from the animals.

Black is accused of providing an edited version of the video that took out the humpback encounter.

Lawrence Biegel, one of Black's lawyers, said the videos in question are often edited and offered to whale watching customers as keepsakes of their day. He said Black provided an edited copy to federal investigators, not knowing they wanted the original.

"She was out whale-watching with a full complement of passengers and spotted a humpback whale. It was a friendly whale, which loves to come up close to a boat and breach and frolic," he said. "There's video of this, which she turned over, of this whale doing exactly that, literally going from one side of the boat to another."

Biegel said Black never fed the creatures during her research trips.

Black was working with federal marine scientists at the time, Biegel said, to study the feeding habits of the powerful sea creatures. Orcas sometimes come to Monterey Bay to feed on gray whale calves as they migrate north along the Pacific coast, Biegel said.

Biegel said Black had collected a piece of gray whale blubber that was floating in the sea, cut a hole so a rope could be fed through, and dropped it back into the ocean. The idea was to keep the blubber close to the boat so Black could use a pole camera to film the killer whales eating underwater, he said.

"In the specific incident in question, Ms. Black used an underwater camera and filmed the eating habits of killer whales who were feeding off free floating pieces of blubber from a gray whale that had been killed by a pack of killer whales," Biegel said.

"She was never hiding what she did or how she did it. In fact, she was acting with the knowledge of other marine mammal scientists, some of whom work for agencies of the federal government," he said. Biegel said Black had a permit granted by the federal government to conduct the research.

Prosecution of MMPA violations is not uncommon. In 2010 a recreational fisherman pleaded guilty to two misdemeanor violations after his boat struck two humpbacks in the Stellwagen Bank National Marine Sanctuary off the coast of Massachusetts. In 2008, four members of the Makah Tribe were sentenced to prison and probation for illegally killing a gray whale off the northwest coast of Washington.

I have personally worked with Nancy Black and with absolute certainty can say that during my trips with her, I have never seen her break the law, harm or placed marine mammals at risk. She has been studying and admiring these fantastic animals for several decades. She's devoted and careful around them and has a wonderful understanding of their behavior. The full information of what transpired is not communicated by the media. And so please do not prosecute someone before the full truth is revealed. I request people to give her a chance and leave the rest to legal proceedings. I sincerely hope that this is not blown out of proportion and causing further angst and worry to marine mammal scientists who feel everything they do for animals will be scrutinized without justification or logic. Science will be done a great disservice and our efforts to protect these animals will be set back another 100 years. As it is there is little to no funding for marine mammal research. They may be charismatic apex predators, but they are part of the ecosystem and should be treated as such.

The part I’m not getting is the 100 yards away bit. Yea you can try to keep your boat a certain distance away but if that giant whale decides he wants a closer look at you there’s not much you’re going to be able to do about it.

Jail time for feeding a wild animal? WTF? How is this any different than feeding birds or deer in my back yard? A wild animal is a wild animal, feathers, fins or fur. This is absurd. All the mamby pamby milquetoast wacko "environmentalists" that will inevitably say whales are different are victims of their own illusions.

It's not that simple. For example, feeding deer creates a nuisance so some communities ban the practice. Here the idea is to protect juvenile whales (orca food) by not attracting orcas with a buffet. Wild animals are NOT just feathers, fins or fur. But I guess only namby-pamby environmentalists are aware that they are also have TEETH! Would you feel safe swimming at the beach if eager shark watchers were using bait to lure sharks in for a closer look?

A man plead GUILTY to 800 counts of sodomy and rape of his 9 year old step daughter, from the time she was 5 years old and he gets probation and a treatment program.... this is absurd. I agree that this women should have some kind of fine but 20 years in jail and millions in fines? The world is upside down!

No one is above the law, especially a marine biologist who is profiteering by using her sub-100 yard scientific pass to give her whale-watching clients a little extra bang for their buck. She knows the possible ramifications if she feeds whales near shore, besides disrupting their natural predatory skills, she's risking drawing the big boys (Great Whites, Tigers, Oceanic White Tips) too close to shore and in range of swimmers. a recipe for disaster. This is no "witch hunt" as has been stated, it's seeing the people with the most leeway aren't abusing the priviledge, It's like working at the US Mint and borrowing the $100 plates on your day off. If she had nothing to hide, she wouldn't have edited out the whale encounter, that would have been the highlight! Epic Fail.

Well then, take away her scientific pass for the whale watching trips and fine her. But 20 years in prison is a sad sad joke. People kill people and get less time. And all she did was feed some whales and then try to cover it up.

She doesn't have her scientific "privileges" when she's operating her tour boats already. If you have a modicum of understanding of the law, those are the maximum sentences allowable that can be imposed. She's more likely to be struck by lightning than get anything but probation and a fine. You'll get no argument from me about our unbalanced judicial system but she should be punished as she abused her position. Giving her no time or fine at all would send a costly message. If a fatal shark attack happened that day, this wouldn't seem so trivial. Further still, making whales feel comfortable around boats is killing them, they pass through shipping lanes and get run down by tankers and other large boats because their natural fears are altered by tour boat operators who break these laws and bait the water.

Again, the jail time and fines are the maximum allowable by law, she'll never see a jail cell. Has it resulted? We'll never know how many whales will be killed by getting too comfortable around her tour boats but shark attacks are approaching record highs and experts say it's likely environmental (natural prey is thinning, fisherman working too close to shore and tour boat operators chumming the waters with whale carcasses).
I'm all for confessing and moving on, but we don't know if she's accepted responsibility for her errors. I'm sure she'll get exactly what you suggest, probation and fines, sounds fair. Peace
