Proposed Immigration Change Could Keep Families Together

WASHINGTON -- Kelly Alfaro, who lives in Washington state, almost lost her husband, Guillermo, to a bacterial infection in 2011 after he went to Juarez, Mexico, to obtain a green card to return to the United States.

An undocumented immigrant, Guillermo was one of thousands of men and women who have spouses and parents with U.S. citizenship but are forced to return to their native country before obtaining permission to get a green card based on their family member's status.

A proposed rule announced Friday by U.S. Citizenship and Immigration Services would change that, allowing those eligible to stay in the United States while they apply for a waiver to remain with their families until they get permission to obtain a green card. At that time, they would return to their native country to get their green card and then return to the United States more quickly than they can today.

For Alfaro and her husband, this could have meant saving his eye, which was removed to prevent the life-threatening infection from spreading. Guillermo lived in Juarez for eight months last year while attempting to prove his absence caused "extreme hardship" for his wife, which is the only way to get past a three- or 10-year bar on reentry placed on undocumented immigrants who leave the country.

"I was terrified for his safety because I knew how dangerous it was there and I had no idea how long he would have to stay down there," she said on a conference call Friday, adding that he could have gotten better medical treatment in the United States.

Immigrant rights advocates are applauding the proposed rule change, which, if approved, could go into effect within the year. The proposal would fix a long-standing complication with current immigration law, although it would not change the law itself.

"The goal is to substantially reduce the time that the U.S. citizen is separated from the spouse or child when that separation would yield an extreme hardship," Alejandro Mayorkas, director of Citizenship and Immigration Services, told The New York Times.

For immigration reform supporters, this would be a welcome policy change.

"This was definitely on my Christmas wish list," Douglas Stump, the vice president of American Immigration Lawyers Association First, said on a conference call.

Some Democrats in Congress praised the decision on Friday. Senate Majority Leader Harry Reid (D-Nev.), a supporter of immigration reform, tweeted that he applauds "Obama's stance for [family] unity; allowing speedy reunification of spouses/children of US citizens, adjusting #immigration status."

The proposed rule wouldn't change existing law, or even lower the requirements for being granted a green card as the spouse or child of an American citizen. Undocumented immigrants and their family members must still prove "extreme hardship" -- which does not mean just being separated -- for the American citizen based on the absence of his or her spouse or parent.

Still, there will likely be backlash from detractors of immigration reform who refer to most legalization as "amnesty." Rep. Luis Gutierrez (D-Ill.) issued a statement attempting to preempt those criticisms by pointing out that obtaining a green card based on the immigration status of a spouse or parent is a method of legal immigration, something most lawmakers against unauthorized immigration say they support.

"If Republicans are serious about supporting legal immigration and having rules families can play by without being split apart, they should thank the president and work with him to implement more common sense changes," Gutierrez said in the statement.

Obama has made a few administrative changes to immigration enforcement in the past six months, including a change in "prosecutorial discretion" that allows some undocumented immigrants to be released from deportation charges as long as they have a clean criminal record and ties to the United States.

But immigration advocates point out that just changing the rules, rather than the laws, isn't enough to help those who are not eligible for help under those policies.

For instance, immigration law does not apply to same-sex couples, meaning they are not eligible to petition for legal status even for their legal spouses. The proposed rule change, therefore, will have no impact on them, but immigration advocates are lobbying to help change it.

"This victory is also a reminder that we still have a lot of work to do," Jose Antonio Vargas, founder of Define American, said in a statement. "There are still countless of families, like my own, who do not qualify for this waiver and whose lives continue to be in limbo."

CORRECTION: 1/8 -- This article has been updated to reflect that people would still need to return to their native country, although more briefly than the current law dictates, to receive their green card.

Check into US Senator Orin Hatch and the Major Legislation that he introduced -
(several months ago) -

"The Strengthening our Commitment to Legal Immigration and America's Security Act".

It addresses legal immigration - and Obama's back-door amnesty - through Holder's DOJ and Napolitano's Homeland Security - for what Obama could not get legislatively.

To avoid this problem we should require proof of legal status in the US to obtain a marriage license for anyone with a foreign birth certificate.
If illegal aliens can't get married in the US we won't have to worry about "breaking up" families.

Roughly 30% of requests for hardship waivers are denied. Now, is Obama going to deport those whose requests for waivers are denied? Or does the illegal alien win either way? Apply for a waiver and it's accepted and you get a green card. Apply for a waiver and it's rejected and you still get to remain here illegally without facing deportation?

When you request a waiver that means you've already completed the first two steps in obtaining residency. When a waiver is submitted you're prensence is requested at the consulate in your homeland. Hence this is what this article is about, the longevitiy of your stay while awaiting judgement/pardon. You're not deported after the waiver, you're already in your natural birth place before a decision is made on your waiver.

The Great President Ronald Reagan facing a massive National Deficit in 1986 did a few things, he lowered taxes, he cut Defense Spending, however most importatnly he granted Amnesty to about three million good, hard working Immigrants.

Over the nest twenty-two year period approx: twelve million more good, hard working Immigrants came to the Greatest Country on Earth the only way poor Immigrants can, un-documented.

This twenty-two year period was the "Most Prosperous time in total U.S. History.

Until we began the January 2008 I.C.E. Deportation Program.

Reagan himself later recognized that granting amnesty was the biggest mistake of his Presidency. I have to agree with him. He should have known that attempts to control the border and remove job opportunities would be met with opposition by the illegal aliens and their enablers.

The Secure Communities Act will become mandatory next year. This is something that BO and Napolitiano were trying to keep a secret but the info was leaked. Cities had been told they could opt out and not participate but now apparently they cannot. So, BO continues his efforts to grab the Mexican vote in November by pandering to illegals and their supporters. We need to get rid of him and Napolitano. They are destroying this country by handing it over to the Mexicans.

They don't seem to care that US citizens are losing their jobs and homes nor do they care that they are starving in the streets while they panders to illegals, their anchors and their supporters. While they let that idiot president of mexico come here and criticize us while his country does much worse and the democrats gave him a standing ovation for it. That tape should be played every 5 minutes till the elections are over along with the tape of OB's apology tour.

BO, Napolitian­o, illegals, their anchors and their supporters are trying to bring us down to third world status by handing it over to those who are more than willing to destroy us and will not be happy till US citizens and legal residents are homeless and starving in the streets while illegals are running the show.

Ossit, the people who are here illegally are criminals who have wrongfully stayed in the US. Because they chose to do this, the responsibility for bad decision making falls on them, regardless of reason. There's nothing wrong with legal immigration, but there are plenty of foreigners that come here without making the effort to get legal, the consequence of doing this is what we are seeing today. The use of our leadership is available to all the chose to write, I also advocate this sort of speech. Those legally born in the US that knew they were harboring illegals should be held culpable for their actions as well. I do not believe the Guillermo's race is criminal, but the act of being in this country is a criminal act that needs fixing. Please don't put words in my mouth. I do not believe amnesty is the best way.

I cannot believe the number of race intolerant trolls that occupy the Latino Voices' section of the Huffington Puffinton Post. The ideas in their threads certainly do not reflect the sentiments of the country as a whole. Are the views of pro-immigrant posters being squelched or is it that all the Latinos out there are too busy working to post any replies? I guess I'll know if this gets posted.

The you're-a-racist canard is all the pro-illegal crowd *has* in their arsenal. They know they *must* keep throwing out that accusation, because it's so hard to defend against. If they weren't working so diligently to cloud the real issues, someone might notice that the people they champion may not be good for this country. When someone's first act that impacts the US is to enter it illegally, that person might not be the best choice for a new neighbor. When we're told that all these people want is a path to citizenship, but they show a total disregard for our laws, someone might not see them as an exemplary potential citizen. When illegals jump the line, putting themselves and their own interests ahead of this nation and all the folks trying to immigrate legally, they're saying that their own considerations are more important than *everyone else's*, leaving the impression that they may not be the best addition to our society. These are people trying to defend the indefensible -- what else *can* they use if not the race card?

Someone please let our president know that supporting (or worse yet, creating) ANY insane policy leading to the amnesty of INNUMERABLE (millions and millions) of illegal aliens AND THEIR families WILL cost him re-election.

I voted for him (was there any other choice really?) and most people I know also voted for him and overwhelming few will vote for him again ON THIS ISSUE alone.

The way these quickly waning and soon to be former Obama supporters see it, the long-term social and cultural future of this country is FAR more important than any grand, feel-good, social-engineering notions Obama thinks he will obtain while he vacations at 1600 Pennsylvania Avenue.

If he bites into this hand-grenade, the next big move he'll make will be a bowel movement.
