Susan Marino, Angel's Gate Animal Hospice Owner, Charged With Cruelty

DELHI, N.Y. — Susan Marino started Angel's Gate animal hospice more than a decade ago to care for animals with special needs: Dogs paralyzed after being hit by cars; cats with severe deformities; a Labrador retriever born without lower limbs, now fitted with orthotics.

A registered nurse who for more than 35 years specialized in emergency and critical care, mental health, and the care of critically and terminally ill children and their families, Marino went back to school and became a veterinary technician, got a certification in canine rehabilitation and a license to rehabilitate wildlife and had her efforts noticed by Oprah Winfrey and Rachael Ray.

Winfrey did a segment on Angel's Gate; Marino's center won $50,000 from the Food Network star. There was an appearance on Martha Stewart, an ASPCA Founders award and a Woman of Distinction honor from the state of New York.

Not all the attention was welcomed. The hospice came under fire from animal rights activists whose undercover investigation led to five cruelty charges against Marino.

Acting on a tip from a job applicant, an animal rights group sent in an undercover agent posing as a volunteer to scout the 100-acre ranch in rural upstate New York that 75 dogs, 230 cats, three horses and nine birds currently call home. People for the Ethical Treatment of Animals said the investigation found paralyzed dogs dragging themselves around until they developed bloody skin ulcers while their wheeled carts hung on a fence unused; animals kept in diapers for several days, causing urine scald; animals with open wounds and respiratory infections that weren't taken to a veterinarian.

They turned over the video to a local prosecutor who charged Marino on Dec. 30 with failing to provide sustenance to five cats, a violation of the state's agriculture and markets law. The district attorney also charged her with possession of a controlled substance. They're all misdemeanors that carry up to a year in jail and/or up to a $1,000 fine.

Marino said the PETA video is edited in some places to give a misleading impression. She disputes claims that animals were neglected, and says many of PETA's complaints amount to little more than a philosophical disagreement over whether a damaged animal should live or die.

Acting on PETA's 27-page complaint, investigators from the county district attorney's office searched Angel's Gate in May.

"They had a warrant to remove any animal they deemed not properly cared for," Marino said in a recent interview. "They never removed any animal from here."

Holly Cheever, an Albany-area veterinarian with 30 years of experience in animal cruelty investigations, assisted in the probe of Angel's Gate. She told The Associated Press that she cited about a dozen animals that should have been humanely euthanized, including cats with active cases of feline AIDS.

She called Marino an animal hoarder and Angel's Gate a death camp.

"Hospice is a temporary situation that leads to humane euthanasia when the quality of life is no longer acceptable," Cheever said. "With Marino, they're essentially trapped inside of suffering bodies without the compassion to end their suffering. That's a hallmark of the hoarder. They refuse to recognize suffering."

After charges were filed, Marino invited a reporter to make a second trip to Angel's Gate; her lawyer later instructed her to cancel the visit and decline interviews.

"I've had death threats," Marino said before her lawyer intervened. "All I've ever wanted to do was do something good for these animals."

The Oprah show featured Angel's Gate in 2008 and donations poured in. Marino said the organization received more than $400,000 and its website got millions of hits from around the globe. Marino used the money to buy a farmhouse on 100 acres in rural Delhi, moving from suburban Long Island where neighbors had complained.

In 2009, Ray's pet rescue organization chose Angel's Gate as one of 64 shelters participating in a "Mutt Madness" competition. Angel's Gate won the top prize of $50,000, which Marino used to build a food preparation building she dubbed "Rachel's Kitchen."

"There is a vetting process with any organization that gets donations," Rachael Ray spokesman Charlie Dougiello said this week. "At the time of the donation, there were no allegations against Angel's Gate."

In videos on the Angel's Gate website and Facebook page, dogs romp on spotless white tile floors and doze in peaceful piles on dog beds. At breakfast time, a worker sets out 25 bowls of meat in a room filled with dachshunds, shih-tzus, beagles and other small dogs, some of them dragging themselves to their bowls because they're missing limbs or are paralyzed. Marino hugs, kisses and cuddles with the animals.

Video shot by PETA presents a different picture.

Daphna Nachminovich, a cruelty investigator for PETA based in Northrup, Va., said the group acted on complaints including one "from a job applicant at Angel's Gate who spent several hours there and was sickened by what she saw."

"There were animals suffering horribly at death's door, without the relief of euthanasia," Nachminovich said.

PETA's video, posted on YouTube, includes a frantic scene of dogs barking and fighting in the kitchen, apparently at feeding time, with Marino yelling and trying to break up the squabble.

When The Associated Press visited Angel's Gate in April, dogs were dozing on cots or playing with toys in large, bright rooms with clean tile floors. Many were disabled and some with spinal injuries dragged their hindquarters. Cats were in little cottages equipped with climbing poles, cubbyholes and scratching posts. It was apparent that remodeling had been done recently on some of the main buildings, and more construction was in progress. All of the facilities were clean and neat.

"She was very aware that the boom was about to fall" when PETA began investigating in November, Cheever said. "She put a lot of energy into cleaning up her operation. By the time I went there in May the physical plant wasn't as dirty, but was disorganized."

Rosemary Throssell, a dog breeder who provides a custom-made raw meat diet for Angel's Gate animals, said PETA's allegations are unfair.

"Those animals have a fantastic quality of life," said Throssell after she and her husband attended a brief court appearance for Marino on Wednesday.

I just watched PETA's footage and cannot believe my eyes, the images are heartbreaking. Regardless of how it started, this has become an unsafe and unhealthy environment for the animals. I think that we really need to take action and help these animals!! I can't believe all of you who are still supporting Susan Marino and don't believe that someone like her could do something like this. How would PETA be able to sensationalize their undercover footage?? Are you all just plain stupid or just wanting to wear blinders and not believe what you see?? I know they, at one time, had a horse on their website that they were continuing to collect money for. Yet, this horse had been dead for quite some time. Those of us, who were concerned, voiced our concerns/questions to Susan Marino and Angel's Gate. They, in turn, made us all out to be crazy animal activists who didn't know what in the world we were talking about. She didn't care about these animals. All she cared about was the almighty $$. Now, on the other hand, I don't understand why these animals weren't helped by PETA rather than letting them suffer and die a cruel death. If it had been me, I would have did all I could to save them. But, that's just me. Sorry to be so passionate about this, but it just gets me when evidence is shown and other people (besides PETA) get involved and it's still not good enough in the eyes of some.

The video is what is evidence. PETA cared enough to expose the video. Name calling does not change abuse or cruelty. Instead of arguing about PETA, I think being concerned about the welfare of those suffering and dying animals is what is important. Thank You Susan for seeing what is important.

Any investigation undertaken by Peta should be suspect as sensationalized. Perhaps if Susan Marino had tossed off her clothes and appeared in a Peta Porn advert they would have been more accepting of her operation.

There are no clear rules as to when a pet requires euthanized. What is clear is that Susan Marino is providing care and a continued life for pets that would otherwise have no life at all.

Camera does not lie. The pain and suffering demonstrated on video is not sensational - it is horrific and disgusting at best. Shame on You. Evil is a boomerang that returns the sender with the evil sent and the evil caused. That woman has a lot coming back...

I am a Psychic specializing in Reincarnation who lives in Upstate New York. I belong to two Circles between Albany and Oneonta, and have also been doing rescue work for 12 years. I'm going to edify all of you about who PETA really is. All of their members are Reincarnated Native Americans, you know, the primitives the Europeans killed or removed from their land and homes when they invaded. Well, now they're B--A--C--K, and on the warpath. They are going to teach all of you a lesson in Kharma. And I support their good work 200%. Holly Cheever was a Chieftess. Thank you averagezoe for your honest truthfulness. What I can tell you however is that many of the species which have disappeared are not returning for the simple reason that we've destroyed their habitat. A few specimen may survive in a zoo setting, but basically once they're extinct they're gone. They will not be part of the New World Order. And neither will all of you because this is your last lifetime on Planet Earth, for this is the Apocalypse. For those who abused or destroyed the other species, I hope your next stop is a desert-like planet.

It is hard for me to believe that a woman who went back to school for a 2nd career as a certified vet tech is intentionally cruel to animals. More likely, there are cases of neglect going on where, as she herself stated, there are differing POVs about how long you can humanely keep an animal alive before euthanasia becomes the most humane option. She may truly believe and be trying to give them the happiest life possible under the circumstances, but maybe needs to speak with some vets about when to draw the line and put the animal down.

While I understand people's desire to have a sanctuary, it is not exactly a solution to the problem of overpopulation. I have been running rescues for over 25 years and looking at the millions of perfectly viable animals being euthanized each year, not to mention the millions and millions languishing on the streets, keeping old, injured and deformed animals alive is insanity. It sounds humane and compassionate, but it really serves no purpose. Anyone who has the inclination and resources for rescue needs to concentrate on saving young, healthy pets, not prolonging lives that are already compromised. If there were no breeders and everyone had their pets spayed and neutered, it would be different, but under the present circumstances, keeping sick animals alive is completely idiotic as well as inhumane.

This is in response to a prior comment of yours to me. I can't find the place to click "reply!"

Zoe -- I, too, have been a fan of yours, a devoted one, I might add. I like and respect the things you say to others. You always, in my mind, make sense.

Yes, the world is heavily overpopulated with unwanted pets. I also totally agree about docking and cropping, etc. -- that it is not necessary and I said that in my previous comment.

When my previous Dobe died, I knew I wanted another one. My vet advised not to adopt one, mainly because of some of the breed's traits, and because you never know why a dog is turned in. Just as a point of reference, my vet is not an advocate of cropping, docking, removing dew claws, etc. and is very much pro-adoption. My husband and I also wanted a puppy. I did my research seeking a breeder. I was VERY picky in finding one that met what I consider high standards.

I will go on to say that I believe responsible breeders do have a place in our society. However, you have already seen where I said that I do not believe in docking and cropping and hope that one day people adopt the British tradition of not doing that.

I hope you can find some redeeming quality in me knowing that our other two dogs and 2 cats are all adopted/rescued.

I've also agreed with every comment you've posted, but I do beg to differ when it comes to buying a pet. From my perspective as a rescuer, there is absolutely no excuse to allow any dog or cat to reproduce - I would like to see all breeding banned or at the very least a moratorium on all breeding until the overpopulation problem is under control. I also disagree with your assessment of a dog's traits. I'm sure you've heard certain attributes ascribed to certain breeds, but in reality, each dog is different and those breed standards are a fallacy. There are many breed specific rescues and I'm sure you could have found a Dobie puppy had you searched the internet and I am equally sure that some were euthanized by animal control in several states while you were looking. The sad reality is that breeders perpetuate the misconception that bloodlines are of utmost importance which is a blatant lie - all they want to do is line their pockets. Some of them even proclaim to breed for the "love of the breed," which is the most nauseating of statements. I see so much horror and pain every day that I feel sick whenever I hear of someone buying a dog - you could say that each time money changes hands, another dog dies. Quit apologizing for knowing which breed of dog you wanted and going and getting one. if you were truly sorry, you would have gotten a lab/chow/pit mix of questionable parentage/ancestry/health/background at the local rescue.

YEEEPP !!!!!.....

All you have to do is "google"...."Peta kills dogs/animals".....and you will find
an abundance of articles on this....as well AS.....STATISTICS with the
numbers of dogs/cats that Peta euthanizes VS the Norfolk SPCA......
I was flabbergasted.

AND....a couple of their workers were indicted and convicted of dumping
dead dogs in a dumpster.......THAT can also be found thru a "google"
search......

My 2 girlie dogs need spaying. In my area it is $230 EACH to get them
spayed........ However.... PETA is located only 50 miles from me and
tho we have NO "spay clinic" here.....PETA sends a "snipmobile" down
across the state line to our county to do low-cost spaying/neutering....

I wouldn't give PETA a damn DIME for ANYthing.......even spaying my
girlies..... I will JUST have to wait until I get moved......

AND.....NOTE to AUTHOR of this article:

PETA is NOT located in Northrup, Va......they are located in
NORFOLK, Virginia...... Downtown on the waterfront in a HUGE
highrise building with a humongous PETA sign on it......

This sound like two snakes in the same pit where sooner or later one will get bitten. The Hospice operator sounds as if she has slipped over to the too frequent status of well meaning care givers of being a Hoarder. For some reason nurses are especially prone to animal hording with good intentions but never realizing when their care converts to organized neglect. The other snake in the pit is PETA which is a bit rabid in its efforts and investigations at time. Perhaps these two warring parties could best serve animals by seeking some middle ground and assisting each other in their eventual goals, the comfort and care for animals.

Get an unbiased investigator. Anything involving PETA is automatically suspect to a lot of people - including me. And exactly WHO is this job applicant? Was she turned down for a job? A PETA plant? If this woman is guilty - then have the courts appoint an advocate and tear the whole thing apart. When the truth is exposed by an unbiased and credible investigation, then the guilty parties can face the consequences.

They didn't remove any of the CRUEL treated animals. So, I can't see the problem, unless she was tipped off by someone who knew of the up comming search and she put them some where else. Hard to believe that is the case but I think her intention were good when she started but I believe she has became a animal hoarder. That will come to light in other investigation, if there are any. We have always had animals growing up, birds, cats and dogs and I can relate to the letting go part. We had to put down more animals then I can count but you got to draw the line for them .
