Co-Sleeping Baby Death Case: Court Upholds Charges

SALT LAKE CITY -- The Utah Court of Appeals has refused to dismiss charges against a couple accused of killing their baby in 2006 by sleeping with him – their second child to die in bed with them.

The appeals judges sided with a lower court in a pair of opinions released Friday concerning the death of 3-month-old Kayson Merrill. The infant died while in bed between his father, Trevor Merrill, and mother, Echo Nielsen, both 28, of South Jordan.

The parents, whose first child also died while sleeping with them in 2003, have been charged with child-abuse homicide and reckless endangerment. They have pleaded not guilty.

Defense attorneys argued there wasn't enough certainty to go to trial after the medical examiner also cited illness and low birth weight in his report.

But the appeals court disagreed, saying Utah judges have previously allowed experts "relying on their training and knowledge to provide opinions that do not amount to medical certainty."

Kayson Merill was put to sleep on his back, but found dead on his stomach.

He was too young to roll over on his own as a baby, evidence that "supports a reasonable inference that Trevor Merrill actually caused the infant to stop breathing by co-sleeping," according to the court's opinion.

The parents also had an infant daughter who died three years before while sleeping with them, but her death by positional asphyxia was listed as accidental.

The appeals court decided evidence of the first death could be admitted at trial, despite the objections of defense attorneys who argued it wasn't relevant and would prejudice the jury.

The judges ruled it could show Nielsen knew the risks of sleeping with her baby.

An attorney for Nielsen declined to comment, and Merrill's lawyer didn't immediately return a phone call.

Interesting.

I just read on MSNBC Internet News that in Idaho twins succumbed to the mother sleeping with them. And she was not charged.

She had TWO die on the same night. If anything sounds suspicious, that does. But again, she was not charged.

And this Utah couple is charged.

States rights, and all that jazz.

Soon we will all have to crowd in to only one state, if we want all of our liberties protected.

If you first child died from co-sleeping, why on earth would you risk it with your second child?!? Most parents wouldn't. Something doesn't add up here.

wow whats with all the people hating on letting your kids sleep in the bed with you? you cant possibly think that co sleeping is actually dangerous can you? did fox news tell you it was? i may only have one child but there is no chance in hell you could convince me that sleeping next to him is dangerous. now, at this point he sleeps in a crib because he tosses and turns so much that i dont enjoy a foot in the face at 2am, but from the day he was born until at least 6 months he slept in that bed with his parents every night. and when we decided it was time he needed his own bed was for us to decide. do you think the millenniums of mankinds survival was aided by them pushing their kids off in some corner to sleep alone? not likely. now as for these two parents, theyre obviously doing something wrong. hard to say what from such a short article. but for people to read something like this and say that all co-sleeping is dangerous is ridiculous. i hope you dont raise children, because they will be as sadly close minded as you.

In fact, this happens more often than people may think. There are dangers, especially for a newborn. And if the parent is a heavy sleeper either naturally or as a result of either legal or illegal drugs.

It is a bad idea for any child under six months.

I dont understand how parents could not be nervous about sleeping with there infent child. My daughter was 6 mo old before i even considered letting her sleep with me and that was because her daddy worked grave yard shift i made sure i kept my distance from her and woke up many times checking her making sure she was covered up and nothing was infront of her face my daughter is now two and i still wake up many times a night checking on my child am i the only mother who does that!?

It's shameful that the first "related video" on this story is a 5 minute promotion of co-sleeping where they claim to "put the controversy to bed" without even mentioning the dangers.

There is something definitely wrong in that household. Co-sleeping only kills a child if the parent purposely or accidentally suffocates the child. It appears that a pattern has taken place and someone in the home is a murderer.

I wish parants would just move the crib into there bedroom to have the baby close by for comfort
I raised three nursed cuddled and then put them in the crib next to my bed. By the time they where 6 month we moved crib in to the nursery with the door open so I coud hear them
After they where 12 month I closed the door :) ahhhhhhhhhhh
SIDS is scary but co sleeping is scary too now the parents are under suspicion for murder and we really will never know for sure what happend.... very sad

Co-sleeping is not dangerous when don't correctly. Never put the child in the middle...I raised 4 babes and slept with all 4. (Yea,yea-to all you co-sleeping nazis!) I read a recent study that said that it is better to co-sleep with your child to prevent SIDS...Actually that was the only time I could sleep to make sure they were still breathing.

I agree with the charges, the first time an accident, the second time is murder!!! Somebody in that bed is a murderer!

Yea-yea, I slept with all 4 of my babies, too...........I'm a light enough sleeper that I didn't move a muscle without knowing exactly where the baby was sleeping. I can't imagine how anyone could asphyxiate their baby let alone have it happen twice........something's a little hinky here.

Co-sleeping is dangerous. Hundreds of babies (that we know of) die every year across the United States because of unsafe sleep practices. The fact that you raised four babies and none of them died is not evidence that it isn't dangerous. You put your infants at risk when you take them to bed with you. There is always a chance that you will accidentally roll over onto them in your sleep or accidentally suffocate them. There's nothing "nazi" about trying to get parents to understand how to safely care for their children, whether it's baby bumpers, car seats, or co-sleeping. Nevertheless, a large segment of people are arrogantly wedded to the novelty of co-sleeping at the expense of their child's safety.

You read no such study saying that co-sleeping prevents SIDS. Not a legitimate one anyway. All the evidence is exactly to the contrary. Read what the AAP has to say on the matter.

I suggest you do some research on this matter as you clearly have no idea what you are talking about. Co-sleeping can be done safely and there is plenty of evidence from legitimate studies that support this. Here is a study from the Pediatric Respiratory Review to get you started:

Before you call someone a liar, i would suggest you put your google to use! People have been co-sleeping since the beginning of time...Just because contemporary opinion says that we should not co-sleep does not make it absolutely right. There are safe ways to co-sleep, never put your baby in the middle between two persons sleeping in the bed. I don't know how attach a link but I will add a paragarapg from another site...You can google the rest.

Do you co-sleep? Did you know that co-sleeping with your baby may actually help to prevent SIDS?

There is not enough information to form any opinion on this matter. Sometimes, babies die in their sleep and until recently it was the norm to put a baby to sleep tummy-down and the babies somehow survived. The first baby's death was ruled 'positional asphyxiation' but no details are given. This baby had a low birth weight and was sick. Let's not jump to conclusions.

There was a famous case in the UK a while back with exactly this scenario. Sally Clark lost her two children to SIDS. She was convicted of their deaths, but won on appeal. Very sad, she went on to die of alcohol poisoning. Apparently part of the prosecution's case was that 1 death is a terrible tragedy but 2 is murder, given the statistical probablility (which was then found to be untrue). Can apparently happen a lot in cases of twins.

I agree 100%. If you have a child that dies in your bed, you don't take the chance ever ever again with another child. Period.

This story makes me so sick!! So..... Let me test my understanding of this: You kill your first baby but you don't get charged with murder, so you try again with your second baby to make sure you get it right ??

Who said they killed any babies? SIDS happens. Both of my grandmothers lost two children each. They didn't murder anyone but sometimes babies die. It's very sad and to charge the parents is inhumane and cruel.

sids is a nice way of saying the parent were negligent. healthy babies dont just magically die from nothing. its a blanket, or a stuffed animal, or a pillow. its usually an infant that cant even roll over and there is something in their face, and since they cant roll away from it, it kills them, its not some mystery disease. its common sense.
