MONTGOMERY, Ala. -- Two longtime Alabama school board leaders are defending the panel's decision in 1993 to reinstate an elementary school teacher who was accused of molesting a student, even though the teacher is now charged with more abuse.

School board President Lee Doebler and Vice President Steve Martin said students, parents and community leaders encouraged the Shelby County Board of Education to return 4th grade teacher Danny Acker to his Alabaster classroom, and the board agreed 5-0. Doebler and Martin are the only board members who remain from those days, and both said they did the best they could with the information they had.

"Looking back, given the evidence we had I would have made the same vote," Doebler said. "I wish we had some evidence, but unfortunately, we didn't."

Acker, 49, is now in the county jail on four counts of first-degree sexual abuse involving two female students under 12. Police said the former teacher admitted to molesting 21 girls throughout his career when he was arrested on Wednesday. The arrest shocked residents of the well-to-do Birmingham suburb, where Acker taught for 25 years and was a familiar figure in his green VW convertible.

Doebler, chairman of the department of counseling and instructional leadership at the University of Montevallo, said he was as surprised as anyone because two of his children had Acker as a teacher. "They always liked him and never indicated any problem," he said.

Shelby County's superintendent placed Acker on leaver in October 1992 when a student accused him of touching her improperly at her home. A county grand jury reviewed the case and did not return an indictment.

Martin said the superintendent recommended Acker's dismissal. The school board held a hearing in February 1993 that lasted more than eight hours and then voted unanimously to keep him.

Martin said there were no witnesses and no physical evidence. He said the abuse was alleged to have occurred during babysitting rather than at the school.

Doebler, who was also the board president in 1993, said many present and former students and their parents turned out as character witnesses to support Acker, and the board was heavily influenced by the grand jury's decision to take no action.

"There was no evidence presented to us to indicate the grand jury was incorrect," he said.

Martin said Acker's father, longtime County Commissioner Dan Acker, made no effort to influence the decision. "The dad did not call anyone or discuss it with anyone," he said.

The charges against Danny Acker involve allegations of abuse before and after the 1992 case. One says she was abused in 1990-1991 and other in 2009. Court documents say both were younger than 12 at the time.

Acker's arrest has caused Shelby County residents to question the decision by the school board in 1993.

Both board members said there were no more complaints against the popular teacher between 1993 and his retirement in 2009.

While board members say Acker's father was not a factor in their decision, he has been a factor in Shelby County District Attorney Robby Owens asking to step aside from the case.

Owens, who was not working in the district attorney's office in 1993, said he asked the state attorney general to appoint a new prosecutor because he knows the commissioner and the County Commission helps determine the funding for the district attorney's office. Owens said he wants to avoid any appearance of impropriety.

A spokeswoman for Attorney General Luther Strange said Monday he is working on finding a new prosecutor.

It is all to common for schools to believe teachers over students who claim they have been either sexukally harassed or sexually abused. Because of that even MORE students get harassed or abused. Schools need to take every one of those claims seriously until it is proven that the student wasn't telling the truth. Our children are MUCH too important to make ANY mistakes.

1 in 4 girls is sexually abused before the age of 14. 1 in 6 boys is sexually abused before the age of 16. More than 90% of all sexual abuse victims know their perpetrator. Almost 50% of the offenders are household members and 38% are already acquaintances of the victims. The average serial child molester has between 360-380 victims in his lifetime. Only 12% of all cases of child abuse are reported how much investigated, unclear.... The most common ages of children when sexual abuse occurs are between 8 and 12..... Over the past 10 years, more than 20,000 American children are believed to have been killed in their own homes by family members. Whether he gets a lot of jail time or not, he can be a listed sex offender easily which means he'll have eyes on him all the time and if he does try again *BAM* he's down and doing the time for sure

Sounds like students kept quiet until the teacher retired. This is what happens when the victims dont come forward. Had they done so years ago, he would have been stopped. The Board needed them to come forward otherwise they their hands are tied. Sad.

I am saying that for a school District to remove a teacher they need proof, evidence. That requires people to step forward who have been abused. If no one comes forward what can an employer do. In this case there was some event outside of school. There are too many he said, she said attacks, what are you to believe. You cant fire people based on here-say. A teacher can harrass so can a student. Its a difficult situation for an employer who can face lawsuites for firing someone without proper cause.

The superintendent recommended (at the time) for Acker to be removed, but it was the school board that voted against his recommendation. MESSED UP!!!!!

Think of all the children he molested because school chief did nothing all those years ago! With all the news of late, it is my hope that this is a HUGE wake up call for adults to NOT bury their heads in the sand or look the other way - Children right now are suffering and need our help! I understand the board's decision at the time was based on limited evidence, and I was in agreement with their defense of their past decision....until I got to this statement:

"He said the abuse was alleged to have occurred during babysitting rather than at the school."

What difference would the location of sexual abuse make to keeping a teacher who worked with young children?

As unfortunate as this is, I'm inclined to agree with the school board. I don't think anyone should be fired from their job because of an accusation. If they put him on suspension while the matter was being investigated and the results of the investigation came back that there was no evidence, then they made the correct decision with the evidence that they had available to reinstate him.

Completely misleading headline, Huffpost. The board members are not defending this teacher at all. they are defending a decision they made in 1993. No one in this article has anything to say in defense of Mr. Acker.
