Cal-Cruz Hatcheries Abused, Tossed, Drowned Chickens, Says Lawsuit (VIDEO)

A California chicken hatchery has been sued for alleged animal abuse after gruesome undercover video footage revealed hatchlings with ripped skin and exposed organs being thrown into bins, trapped under machinery and drowned.

Compassion Over Killing, a Washington, D.C.-based animal protection group, on Wednesday filed a complaint asking Santa Cruz Superior Court to end the alleged abuse at Cal-Cruz Hatcheries Inc. in Santa Cruz. The hatchery didn't return messages seeking comment.

The group turned over undercover video shot by its investigator, a factual statement and a legal memo to the Santa Cruz County Animal Services Authority and the local district attorney in February 2009, the lawsuit says. The animal services authority confirmed the abuse and seized 88 hatchlings, Compassion Over Killing said in a statement. Farm Sanctuary, an animal protection organization, reported many of the birds were so sick they required euthanization. The rescue group took 38 survivors.

Cheryl Leahy, Compassion Over Killing's general counsel, said in an email that the DA's office "informed us that they would not be filing charges (for reasons that are still unclear to us)" a year after the group approached investigators. In a statement, Compassion Over Killing accused the hatchery of felony animal abuse. The prosecutor who supervised the investigation didn't immediately return a call.

A copy of the lawsuit, emailed to The Huffington Post, states:

The investigation revealed that Cal-Cruz, through its employees, operates heavy machinery in a manner that regularly mutilates hatchlings, neglects dying birds trapped in machinery or on the concrete floor, drowns baby birds in buckets of waste, throws hatchlings several feet into trash bins where they remain for several hours, abuses hatchlings with excessive force by washing them down a disposal chute with a high-powered hose, jams birds down the chute with a pole, and cruelly kills hatchlings in a crowded disposal chute in a manner that does not guarantee a humane death.

"The systematic torture and reckless neglect of baby birds at Cal-Cruz is not only shocking -- it is also illegal under the California Business and Professions Code," said Carter Dillard, litigation director for Animal Legal Defense Fund, which filed the lawsuit.

Cal-Cruz hatches and ships millions of chicks each year to growers who raise the birds until they are slaughtered, the lawsuit says. A Cal-Cruz representative told the group many of these chicks are sent to Bauer Family Farms and Carlson Family Farms and are ultimately destined for meat counters at Northern California grocery stores, according to Compassion Over Killing's statement.

Representatives of Bauer Family Farms and Carlson Family Farms could not be reached for comment.

"There is a hard reality when it comes to factory farming," Dillard said. "If you look at the video, you see the numbers of animals involved -- businesses have to maximize numbers so they try to minimize labor costs. The problem with factory farms is you cannot have those numbers of animals being cared for by so few people without a significant number of the animals literally falling through the cracks."

KGO-TV reported in 2010 that Cal-Cruz Hatchery president Brian Collins had viewed the video and confirmed it was taken in his facility. He told the San Francisco TV station, "I think the employees get desensitized to the actual handling of the bird, and for them, it's a job." He said he may make one change: "Right now, the guideline is every 30 minutes you empty those boxes, I might make it 15 and be more diligent about it."

Leahy said the group has "no reason to think the hatchery has made any significant changes."

Cal-Cruz has 30 days to admit or deny the lawsuit's allegations.

I use to joke about vegans and their preaching but I became a vegan eight years ago after watching a video similar to this. The impact of this action has been amazing. My bad cholesterol levels have dropped, I have more energy, and look much better than I did when I was a meat eater. Everything else in my life has been better, too.

This is awful. It reminds me of my cat and her "kill corner": the corner in the closet where she takes her trophies to extract the maximum amount of entertainment from them before she kills them. Why is cruelty the uncomfortable truth of the food chain? I "save" spiders by placing them outside, yet there is chicken in my fridge. If I raised my own chickens I could never have them slaughtered, but seeing this turns my stomach. I voted for the law that is supposed to prevent cruelty to poultry, but alas, it is not working. The fantasy that animals have enjoyed a decent life before slaughter is just that: fantasy. The scale of the mechanized cruelty is just so huge, it is unbearable. How is it that life is so cheap?

Good question. Great question actually. Because we let it. Humans have no problem shrugging off animal cruelty every time they buy, eat, wear or use an animal product. Look at the average person walking down the street, they may be wearing several different dead bodies all at once while dining on another and often may even eat pig, cow, sheep, fish, all in one meal. We compliment the chefs, the clothing designers, the consumer for their choices and no one thought or thank you goes to the animals who did the real work. They suffer in silence. A vegan will not take part in any of this if they can help it. An animal rights person will perhaps take the animal and give it a loving safe home it deserves. These are the people I want to surround myself with. Times are changing, animal abuse is the old way of doing things.

Point being, this video is horrible...a response is necessary and it is pretty common knowledge that factory farming is atrocious but please avoid the self-righteous Vegan diatribe! If you use a computer, drive a car, eat food, or use water...you know what, IT IS SIMPLE FACT that almost EVERYTHING we humans do in this modern world is at a detriment to our planet, its ecosystems and biodiversity, and ultimately ourselves. I'm not throwing my hands up in the air and giving up but I am calling bluff on those individuals trying to exploit this situation to further their own personal causes and/or lifestyles. I make a genuine attempt to arm myself with knowledge so that I may make more responsible choices but you Vegans and your "holier than thou" attitude are just hypocrites, who need to stop this nonsense. Do you really believe your convictions and amateurish web page links are enough to completely change a person's mind and life with a one paragraph explanation on a discussion thread!?! Seriously, you just end up offending people with your censoriousness and driving them away from Veganism; which most people dismiss the minute you start pulling the whole, "it's-all-or-nothing" polarized position.

My only advice: Whether it be plant or animal, please stop feeding the ego.

Come children and look at all the vegan hypocrites! These are the type of people sharing link upon link to their favorite end-all argument websites, which spend a great deal of time debating the semantics of the word "humane" and "free." (Question: Do you believe you are "free" and allowed to live a "humane" life?) Meanwhile, all the energy they just used to explain themselves/justify their position, from the comfort of their "first-world" homes, just led to an increased output of CO2, the exploitation of several oil-producing nations and their peoples, the profit growth of several industry giants, the burgeoning of a few monstrous corporations, the spreading of a divisive nature on the American social front, an increase in world negativity, and the destruction of several ecosystems required for the precious natural resources necessary to facilitate use of the internet and their own computer.

I really hate factory farming but ill eat meat.
The key is source, local small farms.
I dont care if the animal is killed if its feed a healthy meal and treat it well before you kill it humanly then i am happy

I'm curious where people think the 'chicken' in their pet food comes from?

That's why I don't eat chicken, I'd kill way more sentient creatures doing that per year, than by eating 1 steer a year, or four lamb/goat a year. And my dog gets all it's butcher trimmings & soup bones.

Sorry small scale family farm egg producers, you're sh%t out of luck, because with groups like this, their real intention is to leave you without a supplier.

To watch this - And not be moved or shamed, is telling of our culture. If nothing else, we should reject such vile practices because they suppress our evolution. They keep us uncivilized and pragmatically barbaric.

Because we are the thinking beings - we have a responsibility of living up to the "gifts" we are given. Our capacity to reason carries the "burden" to reason well. There is no just reason in defiling life in such a way... Only excuses - Mainly built around profit, greed and gluttony. They stain and make our ethical code a hypocrisy.

Mankind will not suffer if it chooses to be kind. Indeed it is our only way to a more just and less violent world. I'm all for the survival of my species - But if such practices are part of the bargain - You'll find thoughtful folks like I, will have no part in it. To kill with such deliberate malice is simply unacceptable. There are alternatives.

The facts are absolutely clear: Eating meat is bad for human health, catastrophic for the environment, and a living nightmare for animals. There's never been more compelling reasons or a better time to opt for a plant based diet.

Your statement is emotionally driven, biased, interesting and faulty.

Majority of readers would concur to your perspective of the unneccesary abuse of the chicks or any animal for that matter.

To ingratiate yourself by claiming to be a vegan disarms your argument. Most chicks raised are for egg bearing. Vegans do not eat eggs in the natural form. Society utilizes eggs in a myraid of produce. Vegans eat the produce, there by are as culpritable as the carnivours.

Advocating eating meat is harmful to human health is plainly false. From the cave man to modern times, meat has been in societies through out the world. If it was so harmful, how has mankind mulitplied through out the ages?

Hmmm, seems I recently heard of a few outbreaks of lettuce and other veggies being recalled for some kind of contamination or another. Loaded up with fertilizers and pesticides and the likes; how safe are they for a daily consumption?

All disiplines of eating from paleo to resticive caloric intake have pros and cons.

The most detrimental is a high carb diet.

have you been hiding under a rock? there is plenty of support to the premise that meat is harmful to human health. the consumption of meat has been part of our society for some time. im not denying that fact. but if you would look at the impacts to our health and enviornment, not to mention the cruelty to animals, im sure you would understand my position. and to say that from cave man to modern times we have consumed meat does not necessarily make it right or healthy for us or the planet. the world needs to evolve. some societies still practice cannibalism, does that make it right? people used to own slaves, women were treated as property, the mentally ill were treated horribly. as our civilization evolves, we should reevaluate our attitudes towards carnism, not only for the animals, the enviornment, but also for our health.

OK so I am shocked - this place is about a mile from my home. I'll be on the DA for not filing charges and am compelled to make life difficult for this place until they change. I cannot look away while people are doing this right down the road. There is no excuse for doing nothing.

I eat chicken and beef and fish...But this is nauseating! How can this barbaric treatment of animals be allowed this day in age? So upsetting...Thankfully, we have a farm nearby where I buy all our eggs. If I can't get them there, I buy cage free. Bell and Evans chicken is raised humanely.

Actually, more human qualities can be seen in animals than what is seen in human beings these days...most animals take extreme measures to care for their children...whereas, we continue to hear about these parents who abuse and kill their own children (rip, Casey).
