IRS's Corporate Auditors Find $9,354 Of Additional Taxes Owed Per Hour

Jan 17 (Reuters) - Congress will spend a trillion dollars more than it levies this year, so how do Washington's politicians respond to the 11th consecutive year of federal budgets in red ink? They plan to shrink the IRS.

Go figure. Cutting the IRS budget by more than 5 percent in real terms makes as much sense as a hospital firing surgeons or a car dealer laying off salespeople when customers fill the showroom.

Shrinking the IRS makes sense if you believe government is too big and that cutting everywhere is the best way to shrink government. But this is the staff that generates revenue, and there is easy money to be made.

Congress should listen to the national taxpayer advocate, a position it created to make sure taxpayers had a voice in how the IRS operates. In her annual report, released last week, advocate Nina Olson said Congress needed to "ensure that the IRS continues to be effective, either by reducing the IRS' workload or by providing adequate funding to enable it to accomplish its assigned mission."

Instead of cutting, we should be expanding the revenue-generating staff because there is plenty of tax money to be had, even in this awful economy.

IRS data show that auditors assigned to the 14,000 or so largest corporations found $9,354 of additional tax owed for every hour spent testing tax returns in the 2009 fiscal year. The highest-paid IRS auditors make $71 an hour. Based on a 2,080-hour work year, that works out to around $19 million of lost revenue annually for every senior corporate auditor position cut from the payroll.

WHY CUT?

It makes no economic sense to trim the ranks of auditors who generate more than a hundred times their annual salaries. Run a business that way and you go broke.

So why would President Barack Obama and Congress cut the IRS budget? Their actions illuminate the rise of corporate power and values, and the diminishing voice of Joe Sixpack, thanks partly to how we finance election campaigns. Then there is the growing army of corporate lobbyists and the Supreme Court's decision in Citizens United, which allows corporations (and unions) to spend all they can afford on influencing elections.

Keep in mind the IRS costs just a half penny for each dollar of tax collected. Its proposed $11.8 billion budget would be less than the Agriculture Department spends each month.

If the IRS budget is cut, the losers will be workers and ordinary investors, who will find it harder to get their questions answered and their problems resolved by the agency. On the whole, these people do not cheat on their taxes because their incomes are easily checked - through reports by employers, mortgage banks and others. Under a law taking effect in stages between last year and next, brokerages must report the cost basis of securities. This change will reduce capital gains cheating.

TAX CHEATS

The winners will be tax cheats among sole proprietors and other business owners, who are subject to less verification. The latest IRS tax gap report, issued Jan. 6, estimates that just one percent of wages escapes tax, while 56 percent of "amounts subject to little or no" verification do so. http://link.reuters.com/daw95s

America's biggest corporations, those with more than $250 million in assets, also may escape some tax if the IRS budget is cut. These nearly 14,000 companies pay about 86 percent of corporate income taxes.

Audits of these big firms were down even without a budget cut. And audits have become far more complicated, partly because Congress changed the tax code more than once a day on average from 2001 through 2010, Olson reported.

Two decades ago, when the economy was a third smaller, the IRS staff numbered about 118,000. Now it numbers 95,000 and is on the way to about 90,000. The likelihood of a big company being audited has plummeted 50 percentage points from 72 percent in 1990 to 22 percent in 2010.

Big company audits are now limited to specific issues known to the companies in advance, not unlike when cops tip off owners of favored gambling dens before a raid. Each audit also begins with an "estimated time to completion." Working auditors tell me this is really a hard deadline that allows companies to run out the clock with delays in producing documents.

Some IRS tax detectives privately ridicule this system, calling it "audit lite."

Whether you like the corporate income tax or think it is an abomination, failing to enforce it with the same rigor as taxes on wage earners and most investors is indefensible on economic, budget deficit and moral grounds.

IRS budget cuts worsen budget deficits and send a corrosive signal that only chumps file honest tax returns. So you have a choice. Do nothing and suffer the consequences or call your congressman, senators and the White House - today - and then vote in politicians who support, rather than undermine, tax law enforcement. Yep. Congress wants to make sure that they and their corporate owners won't be bothered with bothersome audits.

They will probably make sure that they keep just enough IRS employees to focus on, and audit only the 'unwashed masses'.

There are just so many loop holes to take advantage of. I started asking companies that I consult for to raise my per diem rates to that of the President. They now account for 1st class tickets at peak times, limo expenses, presidential suites at a five star, and meal rate of the president. That money covers expenses and is non-taxable. I then fly business class at off times, get a rental car, get an upgraded room, and eat well but not lavish.

Another thing buried in the numbers of the same report: The increase in automated, enforced collections.

IRS Levies (bank account seizures, wage garnishments, or receivable seizures) are up 556%.

IRS Asset Seizures are up 332%

IRS Tax Lien Filings have gone up by 245%.

This is largely due to the automation of enforced collection.

When the IRS stops sending demand letters for amounts over $20k to middle class filers who have never owed over $5K and never failed to file on time perhaps we can start believing their numbers. Until then not so much.

My husband received such a demand letter stating that he had not filed a return for a very much prior year. We had always filed jointly, and did so in that year so I took a copy of our return--and the refund check--to the local IRS. They told me my husband was deceased, and to clear the demand his estate had to file a final return.

Since I appear to be under the mistaken belief my husband either has a pulse or is the liveliest un-dead entity since Twilight, I simply laughed. Evidently, the IRS believes the deceased can get a W2 for each year after they died.

Do you have any idea how difficult it is to prove someone isn't dead to the IRS? It required my husband showing up in person with someone other than myself who would affidavit his existence-preferably a parent or sibling who could prove the relationship by providing a birth certificate--and providing a copy of his own birth certificate and most recent pay stub. Fortunately my husband and his brother share a remarkable resemblance.

We have never received a resolution letter or, heaven forfend an apology, but when I called the IRS they stated the dispute had been resolved.

How did Obama get into this article? Where exactly is the fact the proves that Obama is trying to cut workers at the IRS, rather than Republik Congress putting their hatchet on the IRS, after all, they have the most to lose. Considering Cheney/Bush had already slashed jobs there when they were in office, what is left to slash?

So, the chances of being audited are down... but that guy selling medical marijuana out in California is audited, and has tax code used against his business in order to put him out of business, while Wells Fargo announces profits in the billions, stole homes, and took taxpayer rebates checks (for taxes never paid) and doesn't pay a penny in income tax for the last three years despite, uh, posting a profit (after expenses)?

Under Bush we cut 419 IRS offices. They're working harder than ever for at a job that makes them hated. Let's change that.

It used to be patriotic to pay taxes. Now we match the rest of the undeveloped world in complaining about it.

If you don't like taxes, don't drive your fifteen thousand trucks on my highways every year and complain about it while your family remains one of the richest on the planet.

I'm proud to pay, it's my country, my nation, my people, I don't even care about your trucks, it's just the way it is.

If a few coast through, it's not my problem, I simply do not mind, nor care.

The many will do the right thing.

It's why God still rules our lives.

So if you're worried about somebody getting what they don't deserve, ask God if he minds you filling in for him.

Lighten up Francis, we got this.

It takes taxes to make our lives a little bit better than it is in Iran.

We're awesome, so let's start acting like it.

That means humility in knowing it, and helping those that can't, can.

Give us your tired, your poor, your huddled masses...

And we'll do what we always do.

Make the best, from the worst. Solve problems, fix things, and be more productive than anyone on the planet. Why? Because we afford everyone the opportunity to excel. That's our trump card, and current attitudes aside, it will be again.

Here's a truly RADICAL idea: CUT taxes for everyone (well, those of us who actually PAY them, I'm sure we can bring the other HALF of the country into the fold to adhere to their 'fair share' of responsibilities!), tax income, capital gains, and death (inheritances) at the same rate, then introduce a 1% VAT while simultaneously LOWERING those income and CG taxes even more! A 15% flat tax rate on all income generating sources is the smart and FAIR thing to do for starters. Every 2 years, increase the VAT by 1% (excluding investments, medicines, medical equipment, and foods) on all sales while lowering the other taxes mentioned, until VAT and the other taxes are all at 5%, OR, let the VAT increase to 7% and eliminate ALL of the other taxes altogether. THAT would ensure that the IRS (and no one should have animus towards the personnel of the IRS, they are doing what the CONGRESS mandates) could shrink proportionately, while acknowledging that there will always be a need for such a govt agency. Corporate and FICA are not part of this discussion, though corporate taxes ought to be reduced to the same 15% level (or lower), so businesses will look at setting up shop here from abroad. Simplifying to a flat tax will eliminate the need for many if not most 'auditors' and the hours they put in, not to mention what businesses and citizens will save when it comes to tax prep!

Don't forget a VAT on food. Then the entire country would be like Idaho, which imposes a 6% sales tax on food. This tax deliberately targets the most vulnerable members of society: poor children. But preying on the helpless is what you're all about, Gomez.

this is just to avoid a little tax, can you imagine what they do to make the money? And we should allow greed driven capitalist to police themselves? What we need are more stricter regulations and a military style enforcement group that has the man/woman power to do monthly checks on banks, wall street and corporations. and at least bi annual checks on all other businesses. When money is involved, even people with the appearance of being the most honest, will fudge things legally or Illegally to make that extra nickle.

I am one of the FEW. Im a 5%er. I worked hard at my business. I have 20 locations now. i worked my tail off to get here. no pay for years. long hours for years. Sacrificed, risked everything. YOU DONT get to tell me what I earned and what I didnt. I make 6 figures because I EARNED it. Get off you lazy butt and do it. i came from a poor family. We were dirt poor. I dont have a college degree and didnt get my money illegally. I worked 3 jobs and risked ! Time to get off you lazy back end and try it yourself !

The problem in this country has NOTHING to do with who is wealthy, and by how much. It has to do with the insatiable appetite for spending the govt has. Period. This country is going broke thanks to the truly bi-partisan efforts of the Congress and WH since the Great Depression! No amount of taxation will put a dent in what we owe now! The ONLY thing that can stave off disaster is massive budget cuts, across the board, and including the entitlement programs. But seeing how our Congress and its members (of both parties) and our Presidents (of both parties) will never have to live under the mandates they force on the rest of us, don't dismiss the very real possibility of bankruptcy being an option they are looking at. All that will happen on their part is to blame the other side for that (they will still be able to 'live large'). Our spending is so out-of-control that 'destroying the village in order to save it' might very well become policy! Stay tuned..
