More Than 1,600 Deportation Cases Set To Be Closed In Denver And Baltimore

WASHINGTON -- The Obama administration has recommended canceling deportation proceedings for more than 1,600 undocumented immigrants in Denver and Baltimore not considered a national security or public threat, a DHS official said Thursday.

The recommendations come after a review of 11,682 pending cases involving undocumented immigrants not jailed by federal authorities as part of an Obama administration pledge to focus deportation efforts on criminal undocumented immigrants and those who pose a national security or public safety threat.

According to preliminary figures shared with The Associated Press, 7,923 cases were reviewed in Denver and officials recommended closing 1,301. In Baltimore, 366 of the 3,759 cases reviewed were recommended for closure.

The official, who spoke on the condition of anonymity because the preliminary data has not been released publicly, said the recommendation to cancel the deportation case hinges on the immigrants being cleared by a final and extensive background check that will include the use of biometric data such as fingerprints.

"We wanted to triple check" everyone's background before halting a deportation case, the official said.

Starting in early December, the immigration court dockets in Denver and Baltimore were suspended while officials did a "deep dive" of the entire backlog of pending deportations. Meanwhile, cases in other jurisdictions were also reviewed, though data on those reviews has not been released.

The Obama administration announced in August that roughly 300,000 pending deportation cases would be reviewed and non-criminals and those undocumented immigrants who don't pose a public safety or national security threat were likely to have their cases put on hold indefinitely. In June, Immigration and Customs Enforcement Director John Morton issued a memo outlining when authorities could use discretion in deciding which undocumented immigrants to arrest and put into deportation proceedings.

Critics of the review and the discretion policy have said President Barack Obama is circumventing Congress to change immigration policies.

In a statement Thursday, House Judiciary Committee Chairman Lamar Smith again called the policies "backdoor amnesty."

"The results from the pilot programs show that President Obama's backdoor amnesty only works for undocumented immigrants, not Americans," Smith said. "Nearly 2,000 illegal and criminal immigrants in Denver and Baltimore have been granted backdoor amnesty that allows them to remain in the U.S. and apply for work authorization. And this administration routinely grants work authorization to 90 percent of undocumented immigrants when their cases have been administratively closed."

The DHS official said that only undocumented immigrants who would have been eligible to apply for a work permit before their deportation case was suspended will now be eligible. The official did not say how many people may be eligible.

"If you can apply for a work permit under existing law, you can apply now," the official said, adding that closure of the deportation case will not automatically qualify someone for a work permit.

Immigrants whose cases are closed won't gain legal status and could once again face deportation if they commit a crime or become a security threat, the official said.

The nationwide review is expected to be completed by the end of the summer. The official said the number of cases recommended for closure is likely to vary by court jurisdiction.

Let's keep families together and let hard working, non-criminal people continue to live peacefully with their loved ones and continue contributing to our country and our economy. Let's face it, America would totally shut down without their labor so we all need to be thankful for their hard work. My heart goes out to them that so many people take them for granted and want to make their lives harder.

86% of the test case of 11,682 illegal deportation cases have been found "criminal" threat to public safety & will continue the deportation process

Meaning the 300,000 deportation cases under review by the BHO Adm for possible "stay of deportation" ~ 258,000 of the 300,000 cases reviewed will lead to continued criminal illegal deportations

The balance of 42,000 of illegals given a temporary reprieve? Not worth the expense & manpower to be given special treatment to

Just get it over with & deport each & every illegal detected & detained ~ They're ALL illegal, unauthorized to be in the USA

The article states, "Immigrants whose cases are closed won't gain legal status and could once again face deportation if they commit a crime.' So according to that, they should all be deported the very next day. Residing in the U.S. unlawfully is a federal crime and in some progressive states like AL, AZ, GA, SC. it is also a felony. Seeing as how that have all this good information on these individuals now, ICE has no excuse not to be picking them up for immediate deportation.

Let us pretend those 1400 are american citizens who have written a few bad checks, robbed only one bank, accidentially maimed another driver with the American's drunken driving. No more O, stop closing deportations for illegals. The two states they started with don't say where the immigrants are from, just that they passed background checks, and had never been arrested.
They broke our rules when they came illegally. It has got to stop, Why doesn't O just drop the whole illegal business and let everyone in the world come here and give us more problems. O egghead has to go.

13.7% of test cases were closed ~ Is that low percentage of illegals, not of criminal threat to the U.S. Public, worth the time & expense?

Illegal immigration in this country is a business and people are very naive to think the government wants to actually get rid of the "problem". Lets face it people its CHEAP LABOR why on earth would a company want to hire a person with a legal status when they can just hire a person with no status and save thousands? Once again the problem of illegal aliens living in this country is ignored by Washington DC. Neither party wants to address the problem or let alone solve it.

Both parties are to blame. The democrats are itching to gain millions of new voters and the republicans love the cheap labor.

If you want to end illegal immigration you go after the employers of illegal aliens. You fine them 100,000 per violation and the problem of illegal immigration will vanish overnight.

Oh you can bet that if re-elected BO is going to sneak in another amnesty.....for sure. So, it's no longer a crime to enter America illegally? Wow. It's obviously going to be up to the states in the coming years and decades to do something about illegals as the Feds are trying everything they can to circumvent or to just totally ignore immigration laws.

Things are not always what they seem, especially in politics. The Arizona statute coming before SCOTUS soon is a very bad set of facts for illegal immigrants. The AG's office asked SCOTUS to not decide the Arizona case. (This request was unlikely to be successful.) On the Arizona facts, the AG is expecting to lose. I know this sounds strange, but the AG does not get a case he expects to lose to SCOTUS by accident.

It is crucial to get a case with the right set of facts to SCOTUS, if you are hoping for a specific result. (Recall the partial birth abortion case, the odd decision, and the gruesome facts. Also many pro-life organizations objecting to "personhood" laws, because they don't want that statute decided by SCOTUS.) Case selection, with an ultimate destination of SCOTUS, is a huge decision for Activists. Many cases are not filed, not appealed, or dropped, to prevent a case with unfavorable facts being decided.

In the Arizona case, SCOTUS is likely to issue a sweeping opinion supporting State's rights against illegal immigrants. They already supported State's rights on E-verify. Public opinion is strongly opposed to illegal immigration. BO has Hispanic voters to pacify, while at the same time he can't anger the majority of voters opposed. An adverse SCOTUS decision is in BO's interest. The majority of voters are pleased, and he can tell Hispanics his hands are tied.

im an illegal immigrant who lived in this country my entire life since when i was a child its sad that when immigration is such complex an issue people only seem to be paying attention to what the media feeds them

i live under the shadow, when my friends ask me why i dont have my drivers id i dont have an answer although my parents still pay taxes i cant get any financial aids

whats even more ironic is theremare people who birthed their children here just to make them a citizen and have gone back to their country to live there and when he came back hes actually elligible for financial aid an everything else even tho he didnt even live here

he dosnt speak a lick of english and hes a citizen

people need to look at this in a larger picture immigration is a hot button issue in politic but people in america is in serious need for realisitic orkable solution not pandering and lies

The blame lies with your parents, not the US taxpayer. Go be mad at them for not caring that they were putting you in this situation and still don't. You are just a meal ticket to them and/or something to trot out in front of the cameras to cry about not splitting up your family if they are ever in danger of being deported. You will see they don't care about splitting up the family when they leave you here without a second thought if they get deported.

I hope the whole lot of you gets found out and deported. It's the only thing you and your parents deserve.
