AUGUSTA, Maine — Gay rights activists in Maine, the only New England state that doesn't allow gay marriage or civil unions, moved Thursday toward forcing a second statewide vote on the marriage question, and their opponents say they'll be ready for a fight.

EqualityMaine, the American Civil Liberties Union, the Maine Women's Lobby and their supporters said Mainers have had a change of heart since the last vote in 2009. They turned over dozens of cartons of petitions signed by 105,000 voters, far more than the 57,277 needed to force a referendum in November. The petitions must be certified by election officials.

After the Legislature approved gay marriage three years ago, opponents forced the question before voters, who overturned the law 53 percent to 47 percent. If Mainers approve gay marriage this time around, the state would be the first to do so by a popular vote.

Advocates said Thursday that their polling and observations convince them voters are ready to do just that in a campaign that could cost $4 million to $5 million.

"Many people have changed their minds," Betsy Smith, executive director of EqualityMaine, said at a news conference at the State House.

Smith cited the results of a poll in December by Goodwin Simon Strategic research that showed 54 percent of 800 likely voters favored allowing same-sex couples to marry in Maine.

"The number of signatures we gathered and the thoughtful conversations we've been having with voters tell us that Mainers are eager to speak on this question again," she said.

One of those eager to vote again is the Rev. Michael Gray, a Methodist pastor in Old Orchard Beach.

Gray said he was a longtime conservative who changed his mind "after study, prayer and patience."

After an effort to reach out and meet personally with voters, gay rights advocates kicked off a new petition drive in August. By November, they had collected more than 100,000 signatures, but supporters wanted to wait to make sure the timing was right before deciding whether to deliver those petitions to the secretary of state.

Opponents said they will be ready for the renewed referendum fight with bolstered forces.

"I expect it will be the same coalition except only broader than it was before," said the Rev. Bob Emrich, a Baptist pastor in Plymouth who helped lead the last campaign to defeat gay marriage and plans to be active this time, too.

The addition of the Family Policy Council, a nonprofit also known as the Christian Civic League of Maine, "will be a huge difference," he said.

"I don't think the people in Maine want to do it again," Emrich said. "But here it is, and we'll do what we've got to do."

The Roman Catholic Diocese of Portland, which opposes gay marriage, expressed disappointment that gay marriage supporters chose to seek another vote so soon after the 2009 referendum.

"After the bitterly divisive campaign of 2009, in which Maine people clearly and decisively voted against changing the meaning of marriage, we're dismayed that they would bring this issue back for yet another vote," Brian Souchet, a spokesman for the diocese, said in a statement.

To get gay marriage on the 2012 ballot, organizers needed to collect signatures by Jan. 30. If those are certified, the proposal first goes to the Republican-controlled Legislature for an up-or-down vote. If the Legislature approves the proposal and the governor signs it, then gay marriage will be legalized. If the Legislature doesn't approve it or the governor doesn't sign a bill, as expected, the question goes to voters.

In New England, gay marriage is recognized in Massachusetts, New Hampshire, Connecticut and Vermont, and civil unions for same-sex couples are allowed in Rhode Island. Other states that allow gay marriage are New York and Iowa, along with Washington, D.C.

In the six states where gay-marriage is allowed, the laws all came through either through court orders or legislative votes, not through a statewide popular vote.

Elsewhere, bills to legalize same-sex marriage have good chances of passage this year in legislatures in Maryland, New Jersey and Washington. Proposed amendments for constitutional bans on gay marriage will be on the ballots in North Carolina on May 8 and in Minnesota on Nov. 6.

In Maine, the state ACLU leader said same-sex marriage is a constitutional right, guaranteed by the religious-freedom and equal-protection amendments, said the group's executive director, Shenna Bellows.

Although I find the notion of putting a groups civil rights up for popular vote to be repugnant, it will be interesting to see how this plays out. There's a lot at stake here in a sense and not just for supporters of marriage equality. If this vote goes before the people of Maine and fails, it won't really affect the fight for marriage equality other than to act as a temporary setback. However, if it succeeds, the message that will go out is that the American people by a majority DO approve of same sex marriage and that attitudes are shifting. This would be a BIG blow to opponents of same sex marriage and I think would be the opening of the flood gates that could very well turn the tide for us.

THE RIGHT WING GUIDE TO OPPOSING GAY RIGHTS:

1) Pretend you had a gay relative die of AIDS to make it look like you know what you're talking about when you perpetuate every gay stereotype there is.

2) Pretend someone at your church went through "ex-gay" therapy and came out straight so that totally proves that it works, you guyzzzz!

3) Find the one example in the news of the one gay person that meets your stereotype and prop them up as a representative of all gays. (see Cynthia Nixon)

4) Call liberals "intolerant" when they try and stop you from trying to outlaw everything your religion doesn't like. Because we all know there is no difference between disagreeing with something and trying to take it away from everyone else.

5) Spout false history about how every civilization in history collapsed because of homosexuality.

6) If all else fails, just use the reproduction excuse. Gays can't reproduce therefore they shouldn't be granted the same benefits and rights straight couples have. (fair warning, this requires you to ignore all medical advances of the last 50 years)

Let them put this on the ballot. It would be different if they already had gay marriage and they were trying to vote to take it away. I get the principle of the thing, that this should have been done already through the precedent of equal protection, but at this point, if this is the most expedient way, let them try. It's not legal yet, so there's nothing to lose.

Rights should never be put on the ballot. We are seeing many victories in the past few years, DADT was repealed and marriage equality was legalized in NY but we need to continue the fight for equality and make this truly the land of the free. Bans on Gay Marriage needs to be overturned in several states and DOMA needs to be thrown into the garbage

Gee, that would be half true if were guy, but I've been married to same woman for 24 years, which is more than I can say for Newt, or Rush. As for Jesus, yes he did hang around with 12 men, their English there names were Simon Peter, James the elder, John, Andrew, Philip, Thomas, Bartholomew, Matthew, James the younger, Simon Zelotes, Jude and Judas Iscariot. Your the one who implies Jesus was gay.

Even though passing gay marriage would still be a step forward, it still doesn't mean much. Gay marriages and civil unions in this country will still equal sitting on the back of the bus until DOMA is repealed and we have every single same right and protection as the heterosexuals, all across the board, in each of the states.

Agreed, Mindy. DOMA is the last block (IMO) to full marriage equality. I would actually like to see it overturned as the unconstitutional piece of bigotry that it is, though I would also settle for Congress voting to repeal it (not too likely until we regain a Democratic majority in the House and retain it in the Senate.

I'm confused Republicans like throwing around the term "mob rule" as a synonym for majority rule, which is the very reason they use the term republic to describe our political system. Republicans believe that republicanism protects the rights of a minority, except for gays, women, children, latinos and blacks.

Marriage is what defines a family in the eyes of the law. The status of "family" provides a set of rights and advantages and protections that we, as a society, have decided families and family members should have.

If conservatives wanted to "protect the sanctity of (their form of) marriage", they should have fought like hell to pass laws giving gay families the same legal rights and protections of heterosexual families. After all, granting equal rights is the right and good and fair thing to do. But, they didn't, and so they lose the entire debate.

That they fight for gay "rights" is also an indication that their "sanctity of marriage" argument is bunk. Their objection to gay marriage is born of a desire to marginalize gay people. You marginalize gay people primarily by denying equal legal rights, and secondarily by denying equal social status. That conservatives are more interested in denying equal rights tells me all I need to know about their motives...and it should tell them all they need to know about the eventual outcome.

I have a question for Carol Martin, who thinks gay marriage is a lustful joke, what do think of Newt's marriage history and did he take his his marraige vows seriously. How about Rush, better yet how Ronald Reagan, he left his 1st wife Jane Wyman of 9 years because she lost a little girl Christine Reagan (born prematurely on June 26, 1947 and died the next day). Ronnie couldn't deal with it, so he started up with Nancy. Jane Wyman filed for divorce in 1949, she said the marriage broke up because she didn't share his politics, my mother didn't buy that for a NY minute. After Reagan died Jane Wyman admitted that she was a Republican, but didn't care much about politics, so I guess that wasn't it. Wyman went on to say, "America has lost a great president and a great, kind, and gentle man". She had more class than her husband, she was a better actress to.
