IONIA, Mich. -- A Detroit hit man in prison for eight murders said he's willing to publicly take responsibility for four more to help clear a young man who claims he's innocent of the slayings and confessed at age 14 only to satisfy police.

Vincent Smothers' testimony would be the most crucial evidence yet to try to persuade a judge to throw out Davontae Sanford's guilty plea and free him from a nearly 40-year prison sentence. In an interview with The Associated Press, Smothers declared: "He's not guilty. He didn't do it."

Smothers said he never used a 14-year-old accomplice – blind in one eye and learning disabled – to carry out his paid hits, mostly victims tied to Detroit's drug trade. Ironically, there's no dispute that Smothers confessed to the so-called Runyon Street slayings when he was captured in 2008, but prosecutors have never charged him and never explained why.

"I understand what prison life is like; it's miserable. To be here and be innocent – I don't know what it's like," Smothers said of Sanford, who is now 19. "He's a kid, and I hate for him to do the kind of time they're giving him."

Told about the AP interview, Sanford's attorney said she soon would ask a judge to bring Smothers to court.

"If we can get Mr. Smothers up on the stand, it would be awesome for Davontae," Kim McGinnis said Monday.

Smothers, 30, spoke over a phone Saturday at the Michigan Reformatory with a glass window separating him from an AP reporter. He's 130 miles west of Detroit where he unflinchingly killed people on streets, inside homes and even while he talked on a cell phone. He finally was arrested in an alley in 2008 while holding his daughter.

Smothers quickly confessed to a series of murders, including the execution-style shooting of a Detroit officer's estranged wife for $50. He says he was paid $60,000 over a two-year period. He eventually pleaded guilty to eight slayings and was sentenced to at least 52 years in prison.

Sanford, meanwhile, has been fighting to get out of prison. A Wayne County judge soon is expected to decide whether to throw out his guilty plea to four killings on Runyon Street in 2007. McGinnis has worked to discredit the police investigation. She discovered major holes, including Smothers' confession and the fact that a gun used in the murders was found at the home of an accomplice who, like Smothers, hasn't been charged.

Prosecutors, however, have refused to back away from Sanford's guilty plea. At times, they have acknowledged that Smothers may have been involved but they won't rule out a role for the younger man.

"There is no link between me and him," Smothers told the AP. "I never knew him."

McGinnis has been desperate to get Smothers on the witness stand. He invoked his right against self-incrimination last year but was willing to allow his attorney, Gabi Silver, to testify about what he told her about Runyon Street. The prosecutor, however, objected and courts said no.

"I'll testify if possible and answer all questions truthfully. Anything I will say will be the truth," Smothers told the AP. "I don't lie."

The prosecutor's office had no comment Monday about Smothers' willingness to testify. Silver said Smothers has "always wanted to right this wrong."

"It's too bad that a kid who didn't have anything to do with this crime is sitting in prison. That to me is a tragedy," Silver said.

With short hair, clear face and a thin build, Smothers looks much younger than his 30 years. He smiled often during the interview and expressed dry humor, especially when he described odd jobs – drywall, plumbing, roofing – while a student at Detroit's Kettering High School and later a factory job in Warren.

"You sound surprised," Smothers said of his resume.

He declined to talk about why he became a hit man but said, "I understand people think I'm a monster."

"Over the course of my young adulthood, I developed a hard heart where people didn't matter ... When you grow up in the city there's just certain facts of life," Smothers said.

The self appointed BLACK leadership is no different than the self appointed neighbor hood watch captain George Zimmerman. Spike Lee, Jesse Jackson, Al Sharpton, and Russell Simmons should be charged right along beside him considering their total exploitation of their own people in the worst of ways.

Donald Goines couldn't write a better script. Even those who are the most evil among us have bouts of redemption. I hope Davontae Sanford gets a second chance at justice. As for Vincent Smothers, well, maybe the temperature will be a few degrees cooler once he reaches where he could be headed..

Not uncommon for police to coerce teenagers in drug infested communities into false confessions for stats at all. More common than most think. Happens all the time becaus cops are kept from actually doing real police work to keep up with the stats game for the suits up above on high.

I believe that if they admit to being wrong, there may very well be more cases where they were wrong which would lead to them losing their credibility and even worse their jobs. Better to lose the job than having to live with the ugly burden of knowing you were responsible for putting away an innocent man.....or kid just to protect your mistakes. I have no doubt many of these scenarios have gone unsolved and the secrets gone to a grave.

i believe you are correct. in my small experience at a law firm, i did see a officer's entire history of cases questioned because he was found lying in a case. i imagine the same would very much be true for a DA or judge, etc

All cops are corrupt. ALL of them, including the females. Well, maybe not all..maybe there are like 3 cops that aren't corrupt. I'm assuming, because I have not met one yet. But as far as this case is concerned- how tragic, and also very common.

Vincent Smothers should definitely be executed not spend the rest of his life in jail. He is a murderer with no remorse whatsoever so why should he be housed and fed by the taxpayers for the restof his life AND the young man who was imprisoned if found innocent should be released immediately .He was 14 mentally challenged and may have been tortured into confessing to a crime he didn't commit. There should be another investigation by honest responsible investigators and if indeed the boy was railroaded into confessing , he should be freed and paid for the injustice he suffered.

He won't spend the rest of his life in jail. He got 50 years; which means he will be out the revolving door in five to make room for a new batch of "city" folk.

The other extreme is to have criminals running the streets despite evidence of their guilt. It's not a perfect system by any means, but there has to be a system.

Your comment is equally frightening. Unfortunately, there are too many guilty prisoners who are released due to over-crowding when they are guilty of very serious crimes and released to terrorize citizens again. Why they sentence the least serious crimes with the longer sentences is beyond me. And why is it that those prisoners are not allowed to be released before any of the hardened prisoners just makes me shake my head and wonder who is in charge and is there anyone challenging these ridiculous decisions.

I believe as soon as there is enough evidence to re-open a case and investigate new information that would reveal a prisoner is more than likely innocent, all effort should be made to prioritize the case. There is nothing more grievous and unethical than keeping an innocent man in prison when there is enough information to prove his innocence.

who knows...Could be guilty or not... Vincent just seems to want to get credit for killing no matter what makes me wonder if the other guy is innocent .... they sure leave out a lot of info in this article as always...If the kid was 14..where were his parents while he was confessing to the crimes...Or his lawyer...And if there was no evidence to show he did it..Then why would a jury find him guilty.. Seems a little hinky here..

Well on the matter of parents and lawyer, even thought the law states that a minor can not be questioned without a guardian present it is done all the time. They do it because they know the "child" will talk if pressed hard enough. Might even confess to have the pressing stopped. For as the jury, well some just want to go home, some just don't care and others well it's just another punk minority off the streets that would eventually get picked up for some other crime.

It is so sad and frightening that out justice system is so out of whack. I agree with your comments. It seems like we have a bunch of tired and disinterested people on the board that are supposedly examining these cases. It strikes me as being very similar to the old saying about not wanting to see how they make sausages. I fear if we know what really is going on in these prisons, we'd be really disgusted.

A good percentage of convictions are form inadequate representation, forced confessions, and incompetence on the police's investigations. Illinois had at one time 11 INNOCENT men on death row! Very flawed system.

It makes me sick to think how blacks are considered to be more than likely guilty without a whole lot of evidence. It's an imbalance that causes even more anger for which I can sympathize. Our country is in need of strong leaders who are focused on examining our systems and making the course corrections necessary. Hopefully, with our military troops returning home, there will be more focus on the issues that require many top to bottom changes to improve our country,

I understand both sides here - the overzealous cop theory and the lying thug theory. It just seems like people are always quicker to condemn the cops than the perpetrators/alleged perpetrators. I wouldn't want to be a cop for anything. Every day they leave their house for work, they know there's a chance they may not return. Yes, that could be said for any of us, but the nature of what they do increases the likelihood. No one commenting here knows all the facts involved, and to make such strong statements (about either side, really) is jumping the gun (no pun intended). Without law enforcement as a firewall against true evil and brutality, the streets would be much more dangerous yet.

I absolutely agree. There are many streets that are more similar to war zones, and cops are putting their lives on the line in a similar way as our troops. I would be terrified to be married to a cop not knowing on any given day whether or not he is going to make it back home.

It is another case where over zealous police officers want a conviction and bully a young person into confessing. I hear a lot of similarities to the West Memphis Three case. Teenagers seem to be easy targets for the police who are trying to get a conviction to make quota. I think policemen should truthfully stop bullying and start listening. You are an officer of the law not above it!
