Jesus Navarro, An Undocumented Immigrant, Denied Kidney Transplant Despite Willing Donor And Insurance Coverage

Jesus Navarro had everything he needed to get a kidney transplant in the United States--private insurance and a willing donor, his wife, with a compatible blood type.

The one thing he didn't have was a green card.

It was the Oakland resident's undocumented status that caused officials at UCSF Medical Center to refuse to perform the necessary medical procedure needed to save Navarro's life from the kidney failure he began experiencing nearly a decade ago.

"UCSF's policy for financial clearance requires candidates to present evidence of adequate and stable insurance coverage or other financial sources necessary to sustain follow-up care long after transplant surgery," Recce Fawley, UCSF's executive director of transplantation, told the Contra Costa Times in a statement. "Immigration status is among many factors taken into consideration."

Even though Navarro was in the country illegally, he had private insurance from the 14 years he worked at the Pacific Steel foundry in Berkeley. He lost his job earlier this month as a result of an internal immigration sweep by the company; however, his insurance carrier is still covering him.

If he loses this insurance and ends up on the rolls of California's Medi-Cal program, which the Contra Costa Times said was likely, it would pay for his dialysis but--because he is in the country illegally--not the transplant itself or the drugs that would be necessary after surgery to prevent his body from rejecting the kidney. UCSF's lack of confidence in Navarro's ability to afford the drugs was at the crux of the hospital's decision to deny the procedure.

In the years since the Connie Frank Transplant Center was established in 1964, UCSF has performed more kidney transplants than any other hospital in the world.

Health care for undocumented immigrants has long been a contentious issues both in California and nationwide. In 1994, California voters passed Proposition 187, which would have prevented all illegal immigrants from using any publicly funded health care services had it not been subsequently deemed unconstitutional by a federal judge.

Republicans in the Arizona legislature last year considered a bill that would have required all hospitals in the state check a patient's immigration status before administering care.

According to a study by the United Network for Organ Sharing, undocumented immigrants in the United States donate significantly more organs than they receive. Transplant Week reports:

Immigrants who are in the U.S. without proper papers account for about 2 percent of all cadaver organs donated in the United States and receive just over one percent of all U.S. organ transplants, according to UNOS.

Last year, a similar case to Narvarro's made the news in New York City, an undocumented waiter was unable to get funding for a $100,000 kidney transplant from his brother, even though his government insurance was willing to pay for his dialysis to the tune of $75,000 annually.

The New York Times reports:

"As a physician, it puts you in a real ethical dilemma," said Dr. Eric Manheimer, Bellevue's medical director, noting that a transplant would sharply reduce Angel's risk of death from complications. "The ultimate irony is it's cheaper to put in a transplant than to dialyze someone for the rest of their life." ... "Here's the paradox: he could donate, but he can't receive," Dr. Manheimer said.

Correction: In the original article, it wasn't made explicit that the reason Medi-Cal wouldn't pay for Navarro's anti-rejection drugs was because he is an undocumented immigrant. For legal U.S. citizens, Medi-Cal covers the cost of the drugs for two years after the operation.

I dont know where I stand on this to be perfectly honest. MY husband immigrated here LEGALLY 3 years ago and we paid dearly for each petition to be able to move one step closer to U.S. Citizenship. If you take the risk to be here illegally then the cards have to fall where they will in the "risk" category. Sounds like he was here for years...so why didnt he get his affairs in order before this tragedy struck?
On the flip side we all make mistakes, is this one worth taking his life over? I do believe that he should be deported back to his country to have the surgery there. I am sure the same outcome can be achieved. Sounds like another media hype~!

The scarce resources of this country, in this case organs, should be allocated to people who are in the US legally. If he needs help from the government he should get it from his government, the one which he is a citizen of and not expect to take from those who have a right to the resources of this country.

That's not the problem. He is not asking for help from our goverment. He has the money to pay! Let him have his wife's kidney then give him a green card, we need more people willing to work and pay taxes to fed all those Occupy people.

UCSF does not have to conduct business by mob rule. There are Catholic medical centers in the US that would most likely perform the transplant. Americans go to Mexico all the time for medical and dental work. He can do the same. He has family support, and financial support. UCSF is one of the most prestigious medical institutions in the world, and does not lack compassion. Again, this is mob rule using an emotional story to dictate policy.

UCSF's stated concern for patient ability to “sustain follow-up care long after transplant surgery,” is thinly disguised racism. Especially since Mr. Navarro, through no fault of his own, was illegally laid off from his employment at Pacific Steel Casting which was the source of his employer based health care. This decision harks back to the Kidney Dialysis rationing of pre 1972 Medicare coverage; a patient’s economic status and gender determined his or her ability to get dialysis.

Why must he die. He can always go back to his own country and have the transplant since he already has a donor. I am sure there are many of his supporters who would be happy to donate money to make this happen.

I am shopping for my own health insurance, since I am a full time paid 1099 contractor and therefore do not quality for insurance from my employer, and insurance company (oh the irony...)

I find it funny that the tea partiers made a huge brouhaha over death panels and long hospital waits under "Obamacare." All of the dental plans that I have been researching for private insurance have 6 - 12 month waits for procedures such as orthodontics and fillings.

We are already living under a system of rationed health care and it is being provided by for profit corporations. The ability for Americans to be fooled time and time again is agonizing to thoughtful citizens such as myself.

The decision to perform the transplant to save this man's life should not reflect any opinion of disrespect or weakness..it is an act of just plain medical ethics or humanity. To let a man die because of a piece of paper is ridiculous. Perform the surgery and deport him if you must, but perform the transplant and save his life because it's the humane and right thing to do!

Compassion is not weakness, and concern for those in unfortunate situations is not socialism. It is discouraging to read some of the comments here, but sadly not surprising these days. It is my hope that Jesus Navarro is able to have his surgery.

I have been on both sides of the immigration process.My husband who now had his green card was illegal. Prior to marrying him, i would have been sympathetic. After learing about illegal immigration up close, I no longer am.

There is a genuine disrespect for the US by people who enter this country illegally.

There are also thousands who are waiting to immigrate legally and play by the rules. No one feels sorry for them.

No one feel sorry for the people born in this country. Medicare to seniors who have spent their lives contributing to the US is on the cutting board. Medical care for US citizens is called 'entitlement'.

Yet people want to allocate already scarce dollars to somone who made the decision to break the law by entering this country. Someone who took a job that might have went to a US resident. Someone who taught his little daughter sitting on his lap that it is ok to lie and cheat if it conveniences you.

I'm sorry he is ill. However, he is not a citizen. His country of origin should be responsible for his health care.

It was his decision to break the law. I don't want my tax dollars spent for someone like this.

funny how everyone is talking like the doctors and hospitals want this guy dead b/c hes illegal.. first off .. just as long as hes been here in america hes had kidney failure.... Ins has been paying for his dialysis.. he knew this time would come that he may have to have a kidney transplant but yet did nothing about his status... blaming doctors and hospitals to operate on someone who has no insurance and take a chance that 1- they wont get paid and 2 they are liable for things that go wrong b/c of lack of insurance why would they want to take that chance?

BTW there are other countries where doctors/hospitals do not charge a person who needs care until they are better.... just a thought to ponder over on that one

Now that means his insurance probably most likely will not cover after the procedure b/c hes not working his job and even though they are paying now his insurance wont cover after the fact.....

Has it occurred to you that Mr. JESUS Navarro simply can't afford to apply for legal status/citizenship? Thief Bush and cronies have singlehandedly raised the application fee for citizenship to almost $1k per adult. Do you honestly think the poor man has $2k or is even healthy enough to work, travel, anything? Do you understand what kidney failure is? It doesn't sound like you do.
There IS NO amnesty law in this country to give illegals a chance to apply for legal status. Finally, please people, please stop blaming these poor folks from other countries for trying to make a better living for their family. Your folks came here on the same premise after we stole the land from the Natives..
