Arizona Supreme Court Upholds Ruling Against San Luis City Council Candidate Alejandrina Cabrera

PHOENIX — The Arizona Supreme Court on Tuesday affirmed a ruling that barred a woman from running for a city council seat because she doesn't speak English proficiently.

The state's highest court ruled that Alejandrina Cabrera's name shouldn't appear on the March 13 election ballot in San Luis but didn't list a reason for the decision. A full written ruling is expected at a later date, according to an Arizona Supreme Court spokeswoman.

The case brought widespread attention to the southern Arizona border city after Mayor Juan Carlos Escamilla filed a court action asking for a determination of whether Cabrera has the English skills necessary to serve a four-year term.

State law requires elected officials to know English, but Cabrera's attorneys claimed the law doesn't define proficiency in the language.

John Minore, an attorney for Cabrera, said his office is looking at ways to appeal the case to the U.S. Supreme Court.

Cabrera's lawyers previously said the action against their client was politically motivated because of her efforts to recall Escamilla. Cabrera began circulating petitions to recall the mayor in April after the council hiked utility rates and approved the layoffs of 12 city employees as part of spending cuts.

Cabrera previously told the Yuma Sun that she needs to improve her command of English but insisted her language skills are adequate for serving the border city where Spanish is used as often as English. She also said she will keep campaigning.

Yuma County Superior Court Judge John Nelson ruled on Jan. 27 to strike Cabrera's name from the ballot. Her attorneys appealed to the Arizona Supreme Court three days later and asked for an expedited ruing because of a deadline for printing the election ballots.

Cabrera, who last year launched two unsuccessful attempts to recall Escamilla as mayor, was one of 10 candidates who filed petitions to run for the council.

Nelson's ruling was based on tests administered by a sociolinguistics expert, as well as Cabrera's inability to respond to questions posed to her in English at a hearing.

The action against Cabrera also stemmed from a Dec. 14 complaint made by former mayor Guillermina Fuentes that Cabrera isn't fluent in English, according to The Sun.

Fuentes claimed she has acted as an interpreter for Cabrera.

Sociolinguistics expert William Eggington presented the court with results of three different tests he administered to Cabrera, who graduated from Kofa High School in Yuma. One measured her English-speaking skill, another was to determine if she reads the language, and the third was to assess her level of English comprehension.

Eggington's report said Cabrera's English skills did not meet the level of language proficiency needed to serve on the council.

Wow she doesn't get it; I'm not surprised. If she was too dumb to learn English than its safe to say her educational credential is only limited to a GED. Rather wasting peoples time she should go back to school, learn English and maybe lose 50lbs. She has been in the country for decades.
Graduated from a U.S. high school.

Yet can't speak English above a very base level?

Sounds like a self-inflicted wound on her part.

The AZ Supreme Court simply sided with a law that has been on the books for years and has already been proven Constitutional.

If she doesn't like it, she can always return to Mexico.
At least she can speak their language....

This is the typical behavior of all illegals. They cross a little border to work in jobs any idiot can do, than they expect the world revolve around their need and than their surprised when laws like SB1070 are passed.

Rather than refusing to learn the language and complain- they should put down the tequila bottle, learn English, go to college and learn a skill that is in demand. Because their is nothing special about cleaning toilets or picking fruit.

I know a number of English speaking people whose knowledge of English is pathetic. It is like they cannot use verbs correctly and seem to lack the desire to learn how to properly use a language they can barely speak.

I wonder if she were such a hick if the courts would have ruled the same way.

Even if you are in a town where Spanish is the predominant language, a council member may have to communicate serious issues with officials from other towns or with federal, state, or county officials. English proficiency is a legitimate requirement for serving citizens well.

If she along with most of San Luis are too suborn or dumb to learn English then they should move back to Mexico, only thing will change is we will not have to pay for their food stamps.

When will there be an inquiry into GOP Politicians who may not even be mentally proficient.

BTW, judging from news clips and interviews, many conservative voters may be able to read and speak English, but they begin to loose points on Comprehension,Language, Math, Science,Spelling,Social Studies, History,Abstract Reasoning Skills,and Word Recognition-Definition

Conservatism on steroids should not be an option,...it's a detrimental threat.

It isn't a "Conservatism" issue, although Libs have to restort to that accusation.

It is a functionality issue. After living in this country for decades, and graduating from a U.S. high school, this woman can't even speak English at a level that would allow her to function in the position she is seeking.

Most of Washington are speaking Un-American language and has been for 4 years ... What we hear is Socialism / Communism / Marxist ,etc .. This lady wanting to be in office would probably fit right in ....lol

It is ridiculous for this woman to want to insist on being part of American government when she doesn't speak the language of the country fluently.
Regardless of whether English is the "Official Language" it is still the accepted language in the United States. Other nations speak other languages. It just so happens that English has been the common tongue here. Refusal to accept and speak it in the name of "preserving heritage and culture" is self defeating hubris at it's worst.
It would be just as foolish to go to any other nation and expect to be able to function as a government representative with only a passing knowledge of the country's language.
Once the border is crossed, Spanish is no longer the accepted main language of business and government. If people find this hard to accept, their national language of choice is right across the border.

The law was passed decades ago and already verified as Constitutional

If this woman spent almost her whole life in the U.S. and hasn't learned to speak English beyond a very, very base level, then her situation is a self-inflicted wound and nothing more.

"She spent her childhood in Mexico" and that is why she can't speak English? WRONG answer. I have been to San Luis, AZ (I like going to minor league baseball games in SLRC, Sonora.) English IS spoken. Anyone who lives in San Luis and has not learned English is both lazy and too STUPID to spend at least a little time outside of their linguistic ghetto.
