Greg Kelly Rape Case: No Charges Will Be Filed Against New York Police Commissioner's Son

NEW YORK -- Prosecutors say the New York Police Department commissioner's son won't face charges in connection to a rape accusation.

Authorities had been investigating a woman's claim television anchor Greg Kelly raped her. Kelly is the son of NYPD Commissioner Raymond Kelly. He denies any wrongdoing.

The chief of the Manhattan district attorney's office sex crimes unit says in a letter sent Tuesday to Kelly's attorney Andrew Lankler an investigation determined "no criminal charges are appropriate."

The woman told police last month she met Kelly for drinks in October and he assaulted her.

The prosecutor's letter says Kelly and the woman were interviewed as part of the investigation.

Read the facts of the case, and you'd be right, it WAS no surprise. The girls story was REALLY flimsy, and completely unsupportable. Witnesses at the office don't support her claims, she was flirting with him via text AFTER the rape supposedly occurred. The only reason anyone believes it might have happened, is BECAUSE he's someone powerful's son, and THAT is bias.

Other news outlets are reporting that the woman claims she was 'unable to give consent', became pregnant and had an abortion. She was compelled to come forward and make the complaint after her boyfriend found out about them.

If both parties are equally drunk, would it be considered mutual rape? What if HE were more drunk, then was it she who took advantage? I have huge issues with the whole "unable to give consent" thing, it's too easily perverted from it's intended use.

This is a perfect example.

They had consentual sex, as a couple does. There was some drama and she cried rape. There was no rape however.

Now...what if she was pregnant and wanted to abort based off the fact she was "raped"

False rape is a statistically insignificant occurrence that is dealt with when it is proven the claim was false. For Ron Paul to even bring light to such a non-issue, which belittles the problem that is rape in this country and thus real instances of rape, is thoroughly disingenuous. He truly is a conservative though.

He was speaking of abortion and how it relates to that. This could be a prime example.

If this women had gotten pregnant, while they were having consensual sex, and then she cried rape and wanted to abort.... see where I am going.

She was not raped, so this is false rape and had she gotten pregnant she should not be allowed to abort under flase pretenses.

That is what Paul was talking about.

I know it is difficult for people to remove their emotions when discussing these issues and make comments through their own biased filter but do we have to lose our common sense too?

The very idea that people are so willing to believe the worst of this woman when there is absolutely no proof of anything (that is why he wasnt charged!) is extremely depressing. People are VERY quick to believe the worst about women and that is a shame.

I think it is hilarious how many people believe everything they read. In another unrelated matter when there was a video of Marines pissing on what looked like dead bodies there was an absurd number of people on here claiming we should wait until its authenticated as though it looked fake in any way (no it didnt).

Now we have an alleged rape reported with no real facts, and now it is reported charges will not be filed and people are falling all out of the woodwork claiming the following (none of which has proven to be true):

1- She lied- There is no proof she lied about anything. There is also no evidence to say the guy assaulted her. THAT is why charges are not being filed.
2-She only reported it because boyfriend found out - Again, no proof why she reported it late, however why would this surprise anyone? Most rapes do not get reported and police and society do not make it easy for women to come forward. It is perfectly reasonable to argue that she finally came forward because of the encouragement and support of her boyfriend. It is not reasonable to assume she went through all the trouble of making a false police report. She is a paralegal for godsakes and probably has some understanding of ethics and reasonableness.
3-Texts-All the reports I have read merely say a source claims these texts occurred. So, again, no proof.

Wrong on counts 2 and 3. As to 1, one can only guess as to whether she lied or not though 2 and 3 would indicate that maybe she did.

2. She didn't report it until after her boyfriend found out is a fact. As to her understanding of ethics and reasonableness... she may understand but she certainly did not utilize same.

3. There were, indeed texts, as noted by the District Attorney's office. And telephone calls.

2- So?!?! Just because she reported it after her boyfriend found out doesnt automatically mean she was falsely reported a rape. Sorry, but there is no logic in that position. It is perfectly reasonable to think she may have reported it at that time because her b/f encouraged and supported her in coming forward. We'll never know the truth and that is the bitter pill that all the people on here need to swallow.

3. Uhh no. The mention of the texts in the DA's letter proves nothing. The texts couldve all been from when they were planning to meet. The letter proves nothing about the texts other than they texted each other at some point in time.

Again, there is nothing to even reason she must have lied other than people's own biases about issues like that. It is very clear from most of the comments on this thread that people are VERY biased about this issue and can only comment through their biased filter.

If she is not able to have charges on him, then they should release her name, what are they hiding?

The NY Post outed her today...

Wow.... I just went to the NY Post page to get the link for you and the article won't load. I'm wondering if it's been pulled because it not only named her, it posted a picture of her and her boyfriend.

Maybe they are just overwhelmed with traffic right now but take a look at the front page. They have a pic of her over a pic of Kelly.

It should be pulled. The New York Post is a tabloid anyway. It is not the practice of the media to identify alleged victims of sexual assault.

Also shocked too see her name &photo, but they are not bound to keep it secret, since she is not a victim. Kelly needs a bodyguard now. The humiliated boyfriend is going to try and hurt him somehow

Basically, there are no formal negative consequences for a person who files a false report of rape. Although there are grounds for bringing legal action against the accuser, it is almost never done. Even should a charge be filed, in most jurisdictions filing a false report is only a misdemeanor.

This is the most frustrating part of it...there are no real criminal options for justice for the victim (the man falsely accused). Fortunately, civil action is always possible if you're rich enough eh?

LOL...Maybe, but sex offenses are the only crimes that do not require corroborating evidence for conviction. Because there are often no witnesses and no physical evidence (especially if the victim delays in filing a report), the case may come down to the credibility of the accused versus the credibility of the accuser.

But there is no proof she lied. False rape claims, which are not in any way common, are proven when the alleged victim admits they lied. There really is no other way to determine they are lying.
