Prop 8, California's Same-Sex Marriage Ban, Declared Unconstitutional

SAN FRANCISCO — Same-sex marriage moved one step closer to the Supreme Court on Tuesday when a federal appeals court ruled California's ban unconstitutional, saying it serves no purpose other than to "lessen the status and human dignity" of gays.

A three-judge panel of the 9th U.S. Circuit Court of Appeals gave gay marriage opponents time to appeal the 2-1 decision before ordering the state to allow same-sex weddings to resume.

"I'm ecstatic. I recognize that we have a ways to go yet. We may have one or two more legal steps," said Jane Leyland, who was gathered with a small crowd outside the federal courthouse in downtown San Francisco, cheering as they learned of the ruling.

Leyland married her longtime partner, Terry Gilb, during the five-month window when same-sex marriage was legal in California.

"But when we first got together, I would have never dreamed in a million years that we would be allowed to be legally married, and here we are."

The ban known as Proposition 8 was approved by voters in 2008 with 52 percent of the vote. The court said it was unconstitutional because it singled out a minority group for disparate treatment for no compelling reason.

The justices concluded that the law had no purpose other than to deny gay couples marriage, since California already grants them all the rights and benefits of marriage if they register as domestic partners.

"Had Marilyn Monroe's film been called `How to Register a Domestic Partnership with a Millionaire,' it would not have conveyed the same meaning as did her famous movie, even though the underlying drama for same-sex couples is no different," the court said.

The lone dissenting judge insisted that the ban could help ensure that children are raised by married, opposite-sex parents.

The appeals court focused its decision exclusively on California's ban, not the bigger debate, even though the court has jurisdiction in nine Western states.

Whether same-sex couples may ever be denied the right to marry "is an important and highly controversial question," the court said. "We need not and do not answer the broader question in this case."

Six states allow gay couples to wed – Connecticut, New Hampshire, Iowa, Massachusetts, New York and Vermont – as well as the District of Columbia. California, as the nation's most populous state and home to more than 98,000 same-sex couples, would be the gay rights movement's biggest prize of them all.

The 9th Circuit concluded that a trial court judge had correctly interpreted the Constitution and Supreme Court precedents when he threw out Proposition 8.

The measure "serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples," Judge Stephen Reinhardt, one of the court's most liberal judges, wrote in the 2-1 opinion.

Opponents of gay marriage planned to ask the Supreme Court to overturn the ruling, which came more than a year after the appeals court panel heard arguments in the case.

"We are not surprised that this Hollywood-orchestrated attack on marriage – tried in San Francisco – turned out this way. But we are confident that the expressed will of the American people in favor of marriage will be upheld at the Supreme Court," said Brian Raum, senior counsel for the Alliance Defense Fund, a Christian legal aid group based in Arizona that helped defend Proposition 8.

Legal analysts questioned whether the Supreme Court would agree to take the case because of the narrow scope of the ruling. California is the only state to grant gays the right to marry and rescind it.

Douglas NeJaime, an associate professor at Loyola Law School in Los Angeles, said the California-specific scope of the 9th Circuit panel's decision means the Supreme Court can uphold it without ruling "on marriage for same-sex couples on a national scale."

"In effect, the 9th Circuit's decision allows the Supreme Court to continue the incremental, case-by-case trajectory of marriage for same-sex couples in the United States," NeJaime said in an email.

Weddings appeared unlikely to resume anytime soon. The ruling will not take effect until the deadline passes in two weeks for Proposition 8's backers to appeal to a larger panel of the 9th Circuit. Lawyers for the coalition of conservative religious groups that sponsored the measure said they have not decided if they will seek a 9th Circuit rehearing or file an appeal directly to the Supreme Court.

The panel also said there was no evidence that former Chief U.S. Judge Vaughn Walker was biased and should have disclosed that he was gay and in a long-term relationship with another man.

Proposition 8 backers had asked the 9th Circuit to set aside Walker's ruling on constitutional grounds and because of the judge's personal life. It was the first instance of an American jurist's sexual orientation being cited as grounds for overturning a court decision.

Walker publicly revealed he was gay after he retired. Supporters of the gay marriage ban argued that he had been obliged to previously reveal if he wanted to marry his partner. The 9th Circuit held a hearing on the conflict-of-interest question in December.

In its ruling Tuesday, the panel majority said it was unreasonable to presume a judge cannot apply the law impartially just because he is a member of the minority group at issue in a case.

"To hold otherwise would demonstrate a lack of respect for the integrity of our federal courts," the opinion said.

Reihardt, who was appointed to the appeals court by President Jimmy Carter, was joined in the majority opinion by Judge Michael Hawkins, an appointee of President Bill Clinton.

Judge Randy Smith, who was appointed by President George W. Bush, dissented, saying he disagreed that Proposition 8 served no purpose other than to treat gays and lesbians as second-class citizens.

Smith said Proposition 8 could serve to promote responsible child-rearing among opposite-sex couples, adding that even if those beliefs were flawed, they would be enough to make the measure constitutional.

Voters passed Proposition 8 five months after the state Supreme Court legalized same-sex marriage by striking down a pair of laws that had limited marriage to a man and a woman.

The ballot measure added the one man-one woman provision into the California Constitution, thereby overruling the court's decision. Its passage followed the most expensive campaign on a social issue in the nation's history.

An estimated 18,000 couples tied the knot during the window before Proposition 8 took effect. The California Supreme Court upheld those marriages but ruled that voters had properly enacted the law.

Gov. Jerry Brown, in his previous role as attorney general, and former Gov. Arnold Schwarzenegger refused to defend Proposition 8 in court and left it to the ballot measure's sponsors to appeal Walker's decision to the 9th Circuit.

My son is gay and I mean Really gay. Everyday I swear that kid tries to wear every color of the rainbow (face palm). He makes me laugh constantly. Some of his little antics and mannerism just crack me up. It really makes my day when I get to see him try and squeeze into those skin tight jeans.

He laughs at me when I'm flirting with the neighbor. Calls me gross when I go on a date or when I tell him I gave her a kiss good night. Last week he put glitter in my car air vents, so when I turned the heat on a billion pieces of glitter flew out at me. I have yet to get him back for that.

It's just me and him, and that may make the difference.
But we have a great time and I couldn't imagine life with out him.
Still, the reality is I won't be here forever. And I pray everyday that the good Lord takes me first.

But to know a funny, intelligent, handsome, gay kid, will live in a Country. Where he is not allowed the rights, of every other American. Though I'm not sure exactly how one comes to be homosexual, as no one truly does.
It is still a truly sad.

I am pleased with the ruling of Prop. 8 in California. I myself am straight. I don’t necessarily agree with same sex marriage but I know that it doesn’t affect the way I live my life so there is no reason for me to make a fuss. Being gay doesn’t make anyone any less of a person. In fact one of my favorite teachers from high school was a lesbian and she was a big influence on the person I am today. She never pushed her ideas upon anyone which I really respected. She also taught me that judging someone because of who they choose to be or what they choose to be is wrong. I am a better person having known her and getting the opportunity to be one of her students. I did not find Prop. 8 fair because people who are gay are still people. I feel that this is similar to the struggle we had with race only a few years ago. In time I hope to see gay marriage accepted on a more universal scale.

Everyone knows driver license, fishing license, and gun license. Where everyone's brain disconnects is the subject of marriage license. Licenses in law is permission to do that which, would otherwise be illegal. How is marriage illegal? It’s historically illegal for gays or interracial couples to be legally recognized with a right to marry. Therefore, government created remedy called marriage license to do what would otherwise be deemed illegal. Proper end all remedy for gay couples today is marriage license. Marriage is a joke. Why can someone like Kim Karsashian get married for TV ratings and a boat load of money and two people who truly love one another can't because they're of the same sex??

It is finally time that gay marriage is legalized and recognized as a real ideal. All people should be allowed to be married to the person most important to them in their lives. What people do in the privacy of their own homes should be of no interest to other people. If you are against gay marriage my advice to you is to continue on as you do now and you don't have to take part in their marriage. This is the age of progressive thinking and this is exactly what this kind of decision is. At this point all people have are two choices. Follow us into the future, or be left behind in the ideals of the past.

Time to wake up and smell reality.

America was not founded on Christiani­ty. We, as a country, do not have any sort of "approved"­, "acknowled­ged" National Religion. Christiani­ty has as much "right" to legislate other people's lives, or dictate policy to the government­­­­­­­, as Islam, Wicca, Mormonism or Judaism. Namely, ZERO.

Stop trying to use your religion as a basis for discrimina­ting & judging. Your holy book and your religion do not confer any special rights on you. It doesn't set you above anyone else & it doesn't make you special. And it certainly doesn't make you any more qualified to deny rights to a group of people because of what you think it says in your holy book.

And, since we are in no way a theocracy, the simple fact of the matter is that religion has absolutely no bearing on the issue of whether homosexual­s deserve the same rights as everyone else. What people think their religion says about homosexual­ity carries zero LEGAL WEIGHT in this discussion­.

I am a Christian. I am a Republican. I am hated, by more than half of the political world.
Yet none of you know me.
I am seen through the eyes of many as "whats wrong with this country". But I'm a working class hero just like the rest of you.
I have two doctoral degrees and I use all my energy to give the leaders of tomorrow a head start. Am I not entitled to an opinion?
But I am denounced and my education is questioned. For a society who speaks of freedom and equal rights for all. I have certainly not been extended the same.
Many of you speak to me as if I have been the single reason of your oppression.

The original meaning of "marriage" is man and women. Yet, in that same definition it clearly states "no divorce". You are also not to be married for "greed, lust or money".But many as Christians due this anyway, thus, not following the meaning of "marriage". And true enough, the same people argue that gay marriage, is a sin. Very hypocritical indeed.

I personally feel marriage is between Man and Women.
But under no circumstances, am I to hold others accountable, to a rule that is commonly broken, by those who claim to hold it dear.

All I ask is to be given the chance to hold my own opinion. If you don't like it or don't agree. Talk to me, don't judge me.

I see that you've just recently joined HP. So, as someone who is not a Republican and not a Christian, let me just say - very well stated and Welcome.

If you stick around for a while, and I hope you do, you'll notice that there are both good & bad elements on both sides of the political aisle. And, since HP is an open public forum, the types & content of the responses you receive to comments can vary greatly. Unfortunately that means that a certain percentage of the responses are nothing more than ignorant comments laced with hate & vitriol that are just emotional, knee-jerk reactions & have nothing to do with the actual article being discussed.

I'd like to think that the majority of people on here value intelligence, honesty & cognitive function. You'll find that there are some really good people on here who respond to your comments based on how you present yourself and your argument & how you treat others, as opposed to whether they agree with you & what you're saying.

So, in closing, let me just say that YES, you are absolutely entitled to an opinion. And if you keep posting comments such as this one, that inform & make people think & are based on rational, logical, well-reasoned thought, I think you might be pleasantly surprised at some of the replies you receive & you may make some friends along the way.

Yes, I just recently joined. I had originally joined to correct a few statements about historical inaccuracies. Which then started a conversation and so I decided stay. Unfortunately, since then I haven't really had any good conversations.

Still, Thank You for the warm welcome. Its too bad I haven't come across more people such as yourself. I see absolutely no reason why two people with differing opinions can't talk things out. No one has to change their views, or be changed as a person. It's just a conversation.

None the less, Thank You for the well thought out reply. It certainly puts a better spin on things knowing there's still hope, for a decent conversation.

I have given 30 years of service to the youth of this nation, been honored for my years of volunteer work and hold multiple post graduate degrees. The fact that those you support deem me unworthy of the rights of American citizen is offensive, degrading and outrageous. Even more outrageous is the fact that some of them feel it appropriate that an 18 year old, an illiterate, a bigot, etc. should have the right to vote on whether or not I should have those rights. You are asking to be given respect for your opinion when those you support deny me respect as a person. They deprive the LGBT community of dignity, deliberately, publically and from a pedestal of superiority. By supporting them, YOU judge ME and contribute to their cause. As educated individuals exchanging reasonable comments, I fail to see how you can justify their actions and your support of it. You've gotten respect in my reply. When will you extend your respect for my rights?

You do not know me. You do not know who I support. If I say I'm a Republican, it does not imply that I am in favor of all their doings. Because I'm not.

Is it "reasonable" for me to assume you dress up and dance in the street, and love to throw glitter, just because of homosexuality? No it is not. Because I don't know you. So is it "reasonable" for you to tell me that "By supporting them, YOU judge ME and contribute to their cause", just because I am Christian? No its not.

You claim that it is unfair for an 18 year old to vote, yet again "assuming" he is illiterate. But that's not fair either. Is it "reasonable" for me to call you illiterate? I have a doctoral degree in Theoretical Physics and Quantum Mechanics and yet another in Philosophy. But its not right for me to assume you are not capable of obtaining these degrees.

Do you understand what I mean? It's not right for you to judge me, when I have done nothing to you.

I do not know why God is making these changes regarding Gay marriages, he did not tell me. But he did tell me that he was sick and tired of the people of this world ignoring his directives and was going to make the greatest ever changes. He also said "Many people will be pleased and many will not be so." And this is one of the many prophesies begining to bear ripe fruit.

It is so very sad that religions pit parents against their children. Devout followers of a faith who don't recognize the subjectivity in the interpretation of Biblical phrases, are placed in conflict between their love of their child and the beliefs of their faith. Many parents have been raised within a religious persuasion whose stand in regard to gay rights was not spoken of until recent years For them to try to wade their way through the waters of salvation is difficult. Their child has been created in the image and likeness of God, Then that loving God deems that child as sinful and inferior? It tears at the core of their belief system. They don't have the tools to debate the issue in terms of accuracyand stand up to the churches. Thus, are left defenseless against a "doctrine" that has been developed carefully, albeit inacurately. Particularly, elderly parents are prone to this conflict. It is unconscienable. "Family values"? Churches have hijacked that phrase.
While I'm not defending parents being unsupportive of their children in any way, I am trying to see the roadblocks that have been created and the dysfunction they cause in families.
I just wish God would come knocking on the doors of churches and say, "Hey, what are you talking about? You've got wrong." For anyone looking for the "tools" to stand up to them with, see www.Hoperemains.com

Well times are changing and people have to lift up their hearts to those who are not as they, Like what God said to me move with the times, he also said "I will take those who are gay to the place I want them to be just as I will take those who are not gay to the place I want them to be.

Gay marriages will most certainly increase as time goes by. You're absolutely correct about that.

In fact, where once there were none, there are now some 150,000 married gay couples in this country. There will be thousands more shortly as Washington state comes on-line with gay marriages on Monday, February 13, 2012 -- just in time for Valentine's day.

That will make 7 states with legal gay marriage, plus DC.

And on May 17, we'll mark the 8th anniversary of gay marriage in Massachusetts, the first state to legalize gay marriage.

There is no turning back this clock.

This has been a phenomenal exercise in re-educating the uninformed masses about civil rights, and why they are not subject to a vote. Sometimes, you need to remind people about things they already should know. In this country, you have to do that a whole heaping lot.

You asked me several times to prove to you that God exists. Challenging me in every comment but yet there was no reply option each time for me to respond.
Since you don't want to answer if you don't believe in God because you choose not to or because he has not revealed himself to you, then i don't see the point of me answering your request. And the questions does have revelance to my answer. If you choose not to believe then what is the point of proving it to you if you will still turn the blind eye?
