GOP Seeks To Deny Child Tax Credit To Undocumented Immigrants

WASHINGTON -- Republicans are looking to deny child tax credits to undocumented immigrants--refund checks averaging $1,800--in an effort that has roused anger among Hispanics and some Democratic lawmakers.

The proposal, which would require people who claim the federal credit to have Social Security numbers to prove they're legal workers, is being offered as a way to help pay for extending the Social Security tax cut for most American wage-earners. It would trim federal spending by about $10 billion over a decade.

Senate Majority Leader Harry Reid of Nevada says the proposal unfairly goes after the children of poor Hispanic workers. Such kids often are U.S. citizens, even when their parents aren't, because they were born in this country.

Says Leticia Miranda, senior policy adviser of the National Council of La Raza: "People who are making close to the minimum wage and are raising children in this country – and we're asking them to pay for the payroll tax cut?" She says, "It's outrageous and it's crazy."

On the other side, Republicans and some Democrats say what's crazy is even having a debate over whether the government should be cutting checks to people who have sneaked into the country without documents. It's hard to imagine there isn't a healthy majority, even in the Democratic-controlled Senate, to stop the practice – if it's actually brought to a vote.

"We have rules about tax credits and benefits, and it seems to me they need to be applied fairly and across the board," said Democrat Sen. Claire McCaskill, who is facing a difficult re-election bid in Missouri. "If there are rules, they need to be enforced. I think it's just that simple. I don't think it's complicated."

Undocumented immigrants have been barred from other refundable tax credits, such as the earned income tax credit for lower-income workers. But a 1997 law enacting the child tax credit doesn't specifically exclude them from collecting that separate benefit. It was significantly expanded in 2001 and 2009 so that many more people are eligible for refundable credits, though the expanded credit is slated to expire at the end of the year along with other Bush-era tax cuts.

"Although the law prohibits aliens residing without authorization in the United States from receiving most federal public benefits, an increasing number of these individuals are filing tax returns claiming this refundable credit," Rep. Sam Johnson, R-Texas, said when the House debated the payroll tax cut measure in December. "Illegal immigrants bilked $4.2 billion from the U.S. taxpayers (in 2010). I think that it's time that we fixed it."

The situation has Democrats in a box. If they fight the GOP effort to cut back payments of the tax credit, they'll be favoring the delivery of refunds to people who not only don't owe income taxes but aren't supposed to be in the country in the first place.

What's more, closing the loophole would raise real money – an estimated $10 billion over 10 years under the approach favored by House Republicans.

The Treasury Department says that in the 2010 filing year more than $4 billion in child credit refunds went to 2.3 million people who filed tax returns but didn't have Social Security numbers proving they were citizens or legal workers. That's a four-fold increase over five years earlier.

On the other side are politically influential Hispanic groups, a key Democratic-friendly constituency. Opponents of tightening eligibility for the child tax credit point out that six of every seven affected families are Hispanic, with an average household income of about $21,000. Tax credits averaging $1,800 per family make a huge difference at such income levels.

Hispanics point out that in many instances the tax credit goes to wokers who aren't citizens but whose children are – because they've been born in the country and therefore can have Social Security numbers of their own. They say such children should reap the benefit of the tax credit just like other children in comparable economic circumstances.

"I just think the child tax credit is working just fine and there's no need to punish children," Sen. Reid said last week. "We're supposed to try to be helping them."

One option under consideration is to require tax filers to supply a Social Security number for the child when claiming the tax credit instead of requiring that at least one of the parents possess one. That would respond to criticism that the GOP proposal is unfair to the citizen children of undocumented immigrants.

"We're not in favor of fraudulent payments or payments that shouldn't be made, but we don't want to create obstacles to supporting low-income families who are trying to care for their children," said Sen. Dick Durbin, D-Ill. "Even though the parent doesn't have a Social Security number, they could still be entitled under their tax return, for a child tax credit."

Congress needs to find about $160 billion between now and the end of the month to cover the costs of extending through Dec. 31 a Social Security tax cut averaging about $20 a week for 160 million workers, federal unemployment benefits for the long-term jobless and unreduced Medicare fees for doctors. All are now due to expire Feb. 29.

This tax credit was clearly meant for all low income US Citizens/their children or US born children living in a US citizens or green card holding household. If this generous credit is used by illegal’s for non existing children, then like all other tax loopholes it is the responsibility of the government to stop the abuse. This tax credit “loophole” will expire on the end of this year along with the tax cut for the rich. However we will have to tackle the abuse of “loopholes” that are meant to create prosperity and jobs, but in fact are abused by the “über” wealthy and is killing jobs and prosperity for the middle class.
If illegal aliens have the gull to extort benefits from the country that they have no legal right to be in, then they are no better then the 1% that fleeces us continuously. Until I applied for my US citizenship, I held a green card; I worked here and paid taxes. It would never occurred to me to defraud my host country.

Our political parties are to blame for this fraud being allowed to continue. They (and I mean both parties) recognize the hispanic populace as being a large block of voters to draw from if they can court their vote. The fact that they have failed to work toward enacting legislation to effectively deal with the issue until now (read election year) speaks volumes. Ilegal aliens are a massive drain on our resources all the way around, but as long as we allow the polticians to be paid to look the other way by businesses that benefit from employing this group of people you and I will continue to pay for thier food, housing, health care and education for thier children while the businesses that employ them pay next to nothing. The legal immigrants in this country who pay thier fair share should be equally if not more upset over this situation.

Ok, Im a pretty die hard Dem, but I have to say, in the name of fairness, if I have to have a SS number to file my taxes, by golly so does everyone else! Otherwise, heaven only knows who all will be filing and getting unearned returns! Thats just crazy!

I'm sure illegals pay some taxes and used pilfered SSN to draw a paycheck. it's the cash under the table and according to Judicial Watch, the $567 billion a year in state and federal services they take that bothers me. So what if they contribute a 7 - 8 billion to SSA, that still leaves a huge margin. I'm no fan of Judicial Watch but again according to JW, CA alone spends $1.25 billion in medical for illegals a year. Tax breaks for illegals is so wrong. E-Verify!!!

Illegal even use PHONY W-2’s to file using ITIN!!! That means, they ARE BEEN PAY UNDER THE TABLE, WITH MEANS NO TAXES PAID, and then he just will FORGE A W-2.

This reminds us that many do pay taxes to support the country, and now they want to simply pocket those taxes. You can't have it both ways. Either they pay taxes to the country and are able to receive benefits, or you don't collect taxes from them, like you do for a lot of legal immigrants who merely return home for an extended vacation and then are not required to pay taxes. What is the sense of that?

1-ILLEGALS DONT GET FEDERALTAX WITHOLD, and their tax liability is "$0.00", is in the TIGTA report(TREASURY INSPECTOR GENERL FOR TAX ADMINISTRATION), they simply will fill "10 dependents " in the W4, of course, they will fill also sombody else SSN.

IRS employees denounced to the TIGTA, IRS was placing levys on properties from people affected from ID fraud. When an illegal files using ITIN numbers, the computers where assigning the illegal the return (that is the child tax credit) and the incomme to the SSN real holder. Just to finish, many of the ITIN returns, claim the ACTC (aditional Child tax credit) with non born citizen children, so the tax preparer has to obtain ITIN's for them. IF those children, (whose supposedly birth certificates are not in english and are not traslated) ARE LIVING IN THE US, how come the illegals can not produce proof, like a shot record or a school records, FROM AN AMERICAN DOCTOR OR SCHOOL??

If you want the best for your children, you position yourself to obtain it and you don't take shortcuts like putting citizenship in your host country on the backburner. Simply showing the initiative to cross the border illegally and get pregnant is NOT a responsible, honest approach and is NOT thr American way. La Raza want us to beleive "they will pay more taxes". ILLEGALS PAY $0.0 READ THE REPORTS. The current rules set by the IRS allow them basically to TAILOR their return to pay 0.0 and to forge "birth certificates" to collect the max ammount of ACTC (aditional child tax credit). Even more, thge TREASURY INSPECTOR found 75% of the sample investigated, to be FRAUDULENT, involving filing several times under different ITIN numbers.
Illegals were using PHONY BIRTH CERTIFICATES. According to IRS rules, ITIN filers could file with:
W2 with somebody else SSN, IRS WILL NOT CONTACT SSA.
FOREIGN BIRTH CERTIFICATES IN ANY LANGUAGE., no translation needed, the tax preparer waas given the burden of "certified authenticity". Mexican nationals (legal residents) can claim dependents (children and other close relatives) living in Mexico. This rule was also extended for mexicans no authorized to work (illegals). .
THE TRUTH IS THAH ALMOST ALL THE CHILDREN CLAIMED AS DEPENDENTS ARE NOT LIVING IN THE US.
The TREASURY INSPECTOR GENERAL FOR TAX ADMINISTRATION REPORTS from 2009 and 2010 indicate they found individual filing more than once amid the forgery in the birth certificates.

I am a Democrat and consider myself to be a Liberal. I have worked in human services for over 25 years. I had NO IDEA that if you were undocumented and did not have a Social Security card and could not prove you were even legally working here that you could get the Child Tax Credit! When I file my taxes and claim my child I have to prove that we have Social Security numbers. I have to agree that this is a bit much. If it will save $10 Billion in a decade.....? I also have limited my children to ONE child because one is all I can afford to raise on my own after my husband died. I have worked two jobs in the past in order to provide for her. I really do not think it is fair for families whose parents are undocumented and usually have many more than one child, to be able to
get the Child Tax Credit. I hate to admit that I am feeling this way, but I do.

I also am a lifelong blue collar liberal Democrat who felt compelled to vote Republican in the congressional midterm because of Democratic support for illegal immigration. Unfortunately, more and more often it seems as if the Democratic Party is opposed to the best interests of American workers.

In 2009 illegals pocketed$ 2.4 BILION, in 2010 $4.2, do the math, it doubles so we face IRS handing illegala $8 BILLION this tax year. WHY? The TREASURY INSPECTOR GENERAL FOR TAX ADMINISTRATION (TIGTA), found widespread FRAUD in the tax return filed with ITIN numbers:
-Same illegal claiming taxes using diferent ITIN's
-Phony "Birth Certificates", most certain those "poor children" doesn't exist.
-Claiming "back years returns", that is potentially 4 times the return dollars.
- The "$1,800" average??? in the TIGTA report there were $10,000 returns.
The current IRS rules to file using ITIN,- you can review them at the IRS web page- relay heavily in the ILLEGAL to tell the truth, as there is no verification at all of the authenticity of ANY document presented to a tax preparer:
w-2 with somebody else SSN ? OK, the IRS wont notify ANYBODY, nor the SSA, nor ICE and more important , the victim of ID fraud.
BIRTH CERTIFICATES IN ANY LANGUAGE, no translation and no certifications of any kind.
The result?, illegals tailoring the return for max Aditional Child Tax Credit,.
ILLEGALS PAYING TAXES?/?? thats a good one, almost certain the will claim 10 dependents in their w4 so no incomme tax is witheld.

Illegal = no benefits, state or federal, one way ticket to the border, they are not citizens because they are born here . That amendment was intended for slaves, are they slaves, or are we slaves for supporting them. I live in an area of high illegal immigration, not a one speaks English, unless they are applying for welfare. It's time to send them home, perhap DHS could give them a one way bus trip to the border, instead of their monthly benefits, we would save trillions,
