South Carolina Voter ID Law Defended By State In Challenge To Justice Department

The state of South Carolina yesterday filed a lawsuit challenging the Justice Department's recent blocking of the state's recent voter identification law. And it could cost taxpayers upward of $1 million or more.

In the lawsuit, Attorney General Alan Wilson asked a judge to overturn the federal government's decision, saying that enforcement of the new law "will not disenfranchise any potential South Carolina voter," according to reports. "The changes have neither the purpose nor will they have the effect of denying or abridging the right to vote on account of race, color, or membership in a language minority."

But Democrats and minority rights groups have said the laws are part of a concerted effort by Republicans to chip away at the voting rights of minorities -- who are key constituencies for the Democrats -- ahead of the 2012 presidential election.

"South Carolina's decision to fight for the right to resurrect their Jim Crow-like voter suppression tactics is deeply disturbing. Sadly, Gov. [Nikki] Haley's unwavering adherence to the myth of voter fraud is just another display of the partisan politics that move our country backward rather than forward," Ben Jealous, president of the National Association for the Advancement of Colored People, said in a statement sent to HuffPost. "Laws like these are modern-day poll tax, a stain on our democracy, and have no place in this nation."

According to one report, the lawsuit could cost South Carolina upward of $1 million to fight.

The state has hired high-powered Washington attorneys at a rate of $520-an-hour, according to a report by the Post and Courier. Other contracted associates and paralegals will earn between $180 and $200 an hour on the case, the newspaper reported.

"With states like South Carolina facing budgetary restrictions, it's interesting they can make funds available for this type of activity," J. Michael Bitzer, a professor of political science at Catawba College in Salisbury, N.C., told the newspaper. "People will question, 'Why isn't this going to education or other principle public services?' It plays well with (Haley's) base though."

Rob Godfrey, a spokesman for Gov. Nikki Haley, said in a statement, "It wouldn't cost anything if (U.S. Attorney General) Eric Holder and the Department of Justice would get out of the way and let us protect our citizens and enforce our laws."

The Justice Department in December rejected South Carolina's law under Section 5 of the 1965 Voting Rights Act, which mandates the federal government approve any changes to voting laws in a handful of states that have a history of voter suppression and racial discrimination. The last time the DOJ blocked such a law was in 1994, after Louisiana passed a law that required voters to present a photo ID at the polls.

Voting rights groups, as well as labor and minority groups including the NAACP, have called the wave of recent voter ID laws an attack on the voting rights of those least likely to have photo identification, including racial minorities, youth and the elderly. Other voting laws passed recently across the country include the elimination of some early voting and the imposition of restrictions on third-party groups that register voters.

Republicans have said the new voting laws, passed in more than a dozen states, are needed to protect against voter fraud, although little evidence of mass voter fraud exists.

"The data speaks for itself, there have been no prosecutable cases of voter fraud in South Carolina that would be prevented by this law," Jealous said in a statement. "However there is credible evidence that thousands of minority, elderly, student, and disabled voters would be disproportionately disenfranchised if South Carolina enacted this law."

About a quarter of all African Americans and 18 percent of Latinos across the country lack government-issued photo IDs as required by these new laws. Also, opponents of the laws say that many older Americans, particularly in rural or poor areas, were born to midwives or in areas that did not keep adequate records, such as birth certificates. To get a photo ID often requires documented proof of birth and/or citizenship.

Wilson, South Carolina's top prosecutor, will likely argue that the new law should stand in part because of its similarity to a voter ID law passed in Indiana that was upheld by the U.S. Supreme Court in 2008.

In a statement released shortly after the suit was filed, Wilson said, "The Department of Justice has denied citizens in South Carolina protection of a law that the U.S. Supreme Court upheld in Indiana, and the DOJ itself pre-cleared for Georgia."

Analysts and voting rights groups have said the Indiana law has served as a template for other state's voter ID laws.

"That was taken as a signal," Bob Kengle, co-director of the Lawyers' Committee For Civil Rights, told HuffPost in a recent interview. "I think that was the take-away from the Indiana decision. You had test cases Georgia and Indiana, the states where politicians were trying this to see if they could get away with it. The message they took away from the Indiana case was, 'Yes, we can.'"

Haley is a sellout to the dominant group in this country... Most white women don't want this legislation any more than any other minority group, and on top of that, most white voters agree with minority group voters... We all would rather see the money in education and other community development activities... If Gov. Haley had bothered to ask. We as voters are not worried about voter fraud, because it isn't a problem, so there must be another motivation for our legislators... Let everybody vote and stop being afraid of the outcome.

The so-called "free" ID is only free if you have alot of supporting documents at the ready or transportation, time, money and health to obtain them. Birth certificate, marriage certificate, social security card, etc....all from different agencies, all at a price. Free means no monetary cost in my book. Don't fall for Gov. Tricky Nikki and her crew!

Gov. Haley is too young to understand what happened with respect to voting rights in the south, before her birth (1972). She was raised on Reagan/Bush (80-92). Thus the myoptic view of voting rights. As in "Those things happened before my birth. Black people do everything now...".
Example: Reagan attempted to void the Voting Right Act by letting the bill's expiration date pass.
Plus Gov. Haley wants to be seen as a "team player". Thus fighting to install methods to deminish minority voting.

This is not disenfranchisement. It is utterly insane to compare this to previous instances of voter blocking.

1950s-1960s: You can vote when you guess how many marbles are in this jar.
2012: You can vote when you obtain your (free) photo identification card.

When I see that people insist that these two things belong in the same category it makes it difficult to keep my keyboard free of vomit.

People like me? Listen, the bottom line is that this is an effort to suppress minority votes. And, as we know, states like South Carolina have an extensive history of such tactics. There is NO evidence of voter fraud, yet, Nikki Haley (backed by her Tea-Party Conservative base) are proceeding in this costly litigation. This, along with the suspicious timing (after the election of the first African-American president & before his re-election bid) makes it obvious that this is a ploy to disenfranchise potential minority voters.
I'm sure YOU think that "literacy tests" might have been good. It's the same kind of strategy as the "ID cards." Knowing full well that many blacks were denied equal educational advantages as whites, "literacy tests" were used to keep minorities from voting. By the way, illiterate whites weren't given literacy tests.
Everyone can see through these new tactics!! I guess desperate times call for desperate measures!

I don't understand this victim stuff, just get the paper, people.
We saw that the Government pay a $49.00 subsidy for TV Converter Box's because the poor can't afford these new fangel, wave systems to keep up with the world. Can we afford $49.00 to pay for a few poor citizens ID's one time around, after that they're on their own to keep it valid.
You are thinking like a racist White when you think that the African American living there in South Carolina cannot tell each other from a foreigner. Look, like they say, because of certain locations and conditions of some African Americans in the South they do not have an ID. Therefore shouldn't it be easy to pick one out judging by their, looks, age, area they were born in. Seems to me several friends and family members as witnesses, and a, Note-Republic Stamp, should be enough to get you a birth certificate. But then it is the South.

After 911 was the time for everyone to get the new type of passport, or passport license combination. In many places you can be issued a none drivers license ID, which is just as valid. We are African American, we fought for our rights, we fought for this country, we are not the enemy of this country, we were never spies, we're no frauds, and we are not illegal. So don't let the Devil surround us, and our concerns with such demeaning words.

Since whites make up more than 66% of South Carolina's population­, this means more white than non-whites lack photo IDs. So, we are not talking about very many people. A drive to encourage voters to get one of the state-issued photo IDs would probably increase the number of voters of all races. However, many of the registered voters who lack photo IDs are probably dead or have moved out of state. At any rate, the photo voters IDs are nice to have since they can be used for other purposes than voting.

If the majority of the people effected by this new law are African American and other minorities, why aren't the Republicans who are pushing for this law do something to rectify the situation like addressing the disenfranchisment of these groups instead of denying that there is disenfranchisment. The state could provide for free government IDs to all of it citizens. That would solve the problem. Unless the real purpose for the law is to suppress the Democrat vote.

The state does provide the photo IDs free of charge. They are actually much easier to obtain than other types of IDs. For example, you don't have to pay a fee and pass a test as you do to obtain a driver's license, which is what most people use for identification.

Since the greater majority of African Americans and Latinos tend to vote Democratic aren't you really only concerned about disenfranchising Dem voters? Tell the truth now; would you be equally upset, equally vocal if the majority of the disenfranchised might be Repubs? Just my guess but I think your outrage would be significantly less. But I admit it is just a guess.

If an adult does not have a valid picture ID, how easy or how difficult is it to obtain one? What are the barriers to the procurement of an ID? This is something to work on prior to the election.

The state issues free voter photo IDs to people who don't have photo IDs. You can get them at the same offices that issue driver's licenses, but they are easier to get than driver's licenses because you don't have to pay a fee, pass an eye exam, or take a driver's tests. The photo IDs also come in handy because they can be used for other purposes, such as check cashing.

It is a shame that you have to show and picture ID to cash a check, buy an airline ticket and make transactions at a bank but according to Liberal Democrats you shouldnot have to show an ID to help secure our constitutional right for a fair and honest vote. Everyone now knows that Liberal Democrats prefer that voting not require picture identification because it paves the way for cheating and the padding of ballot boxes that insures them the political victories to spread their anti-American Liberalism. Democrats have learned well from their past terrorist group the KKK that stealing elections, intimidation and mis-information is the key to keeping them in power. It is now time to throw all Democrats out of office. Congrats to the Governor Haley!!!

There is some incidence of Democratic voter fraud in 90% of all election taking place in Chicago. You are not a Republican so you really don't know if the current elections are supporting the constitution the way Americans are suppose to.

Get an ID or do not be heard, period. I bet you would get one to cash your check!!!

For those that claim there is little or no voter fraud I ask a realistic question. How much would be too much for you? Is 1% acceptable but 5% isn't? Is 5% acceptable but 10% isn't. Sometimes fraud is like proving a negative. Unless you are checking for fraud you don’t know how much is happening. That is the same “proving a negative” that Obama wants us to believe. You know the “it would have been worse if I hadn’t passed all of thse stimulus spending bills”. And as for the claim that they stay in the shadows, they seem to come out for food stamps, tax credits, shopping, or any other State or govt program that they can "qualify" for. No shadow life when it comes to getting a driver's license from those silly states that are willing to give one to illegal immigrants. No hiding in the shadows when it comes to reaping benefits from Fed tax payers. Sure looks like folks can find an ID to qualify for assistance programs but just can't find one to vote. Nothing suspicious here.

You don't need an I.D. to pay taxes-- sales, income, state, federal whatever. If you pay taxes in a state-- you should have the right to vote in that state no matter what. You should be able to bring your W2 or sales reciepts to the polling place and say " I paid taxes in this state, now I get to vote on who I want to represent me in government, money is speech"...

The state issued voter photo IDs are free and easier to obtain than a W2 form or sales receipt. You have to have a job to get a W2, and you have to go shopping and purchase something to get a sales reciept.

According to the reporting I've read the photo ID's are not free and you have to get them from places like the DMV. There was an elderly woman denied one because she did not have the documents they were asking for- though she had government and notarized documents. And my point is, if you are taxed, that money goes to the government (state and or federal), you should have the right to vote for the officials of that government no matter what-- you are paying money to operate that government.

Since whites make up a much larger percentage of the population, more whites than non-whites lack photo IDs. So, the claim that South Carolina's goal is to suppress African American and Latino votes isn't valid, since more whites would be "disenfranchised." Of ocurse, most people who want to vote will get one of the free state-issued photo IDs. You can get the photo ID when you register to vote.

Really... interesting.

But genrally doen't work due to the demographics of where one lives. Lets say for example I live in a district where there is a 50/50 split AA to white. Because 25% of my base is gone from the begging and tend to vote with in the same bloc that candidate/party suffers. Correct? Your looking at national averages not the states, or district...and what do they say about politics...it's all about grass root.
