Botched Child Porn Case Spurs Outside Review At University Of Michigan; Charges Filed Against Physician

ANN ARBOR, Mich. -- University of Michigan officials said Friday they have ordered an outside review of campus security in the wake of a botched response to child pornography found on a medical resident's computer flash drive.

An internal investigation determined a hospital attorney aware of the discovery decided after a month there wasn't enough evidence to tell police and closed the matter in June.

But the case was reopened after doctors expressed concern in the wake of the Penn State University scandal, in which former assistant football coach Jerry Sandusky awaits trial on child sex-abuse charges and other leaders including late football coach Joe Paterno were pushed out.

Charges were filed in December against a resident physician. The flash drive containing child porn was found in a staff lounge.

The six-month delay was a "serious failure on the part of our institution – there is simply no other way to describe it," U-M President Mary Sue Coleman said in a statement accompanying the audit.

"A university attorney must not assume the lead role in investigating a potential crime of this nature," Coleman said. "This is solely the responsibility of the police."

The attorney, whose name was not released, left the university in June for reasons unrelated to the case, the school said.

Coleman said in the statement that it wasn't solely the actions of that attorney, but a "significant breakdown" among numerous individuals and departments as well as "poor judgment on the part of several employees who could have done more." She commended a medical resident for twice reporting what she saw and apologized to that person for not properly investigating in May.

"It took an act of courage to come forward again, and it is because of her that the case is now moving forward in the legal system," Coleman said in the statement.

Recommendations made by the internal review panel include developing an extensive set of common guidelines for reporting security incidents, raising awareness of patient, employee and student privacy rules, and boosting understanding of the duty to report suspected criminal activity.

The university audit said outside experts will be hired by April 1 to "assess our safety and security culture and help us achieve needed change." An improvement plan will be developed within the following 60 days.

This sounds like a risk management problem to me. If somone reported this to hospital security, surely risk management was informed and it would appear that rather than take care of the problem (the ped resident) they went on risking the possibility that he could harm pediatric patients. I don't understand why they will go to just about any length to keep from admitting their mistakes. I was a victim of a medical situation there and found it very discouraging to discover that they will not do anything unless someone sues them in court or they get put in the news or "caught," so to speak. My doctor received a promotion!

This appears to be the status quo for these institutions which are more concerned about the reputation and welfare of the establishment than that of the victim! There must be consequences so that this doesn't happen anymore!

It was the status quo for all institutions to protect the institution. Up until recently you were required to report potential crimes to internal security instead of the police. Part of it was to keep the name of the institution out of the news as being linked to crime. Due to the way evidence was obtained, or handled, most could not be used in a court of law, so they would just fire the person to get them out of the institution.

The outside review is only to advise the university on how to improve their procedures for reporting crimes to police (how about simple policies like, if you see a crime report it to the police). The UM is trying to make this complicated by citing health privacy and student privacy laws but none of this applies in this case. The outside review will have no mandate to investigate how this happened or who was responsible. The internal review refused to name names or say who knew that the case was dropped. Did President Coleman know?

The UM Regents need to do their jobs and take control of this great university. The Coleman administration is responsible for covering up many cases that they find embarrassing, like the football player arrested for raping a girl and his fellow football player who threatened to rape her again if she pressed charges.

The outside review is only to advise the UM on how to improve procedures. They will have no mandate to investigate what happened or who knew. The UM report on the incident refuses to name names or say how high in the chain of command knew the case was dropped in May. Did President Coleman know? The internal investigation is totally inadequate and the Board of Regents should demand an independent investigation. My geuss would be that President Coleman was not informed. I would hope not because if even she wouldn't do anything then they really have a problem. The Board of Regents is made up of many attorneys and I have a hard time believing that all would dismiss a potential sexual predator on campus. I would hope not. I think it is the CEO and risk management who makes final decisions on issues like this and other medical legal problems. If risk management didn't do their job, they should be disciplined also. I had a very serious medical case and they wanted to blame the students and the only thing they promised to do is hold classes for students on how to treat patients. It wasn't the students that harmed me. They refused to do anything to the doctor and also refused to conpensate me for my injuries.

This is a huge problem where Universities and Colleges do not keep law enforcement in the loop pertaining to on campus crimes, this is especially true in on campus rape cases. A special board, and peer group review the accusation of rape on campus and often intimidate the victim from going to the police, there is some mickey mouse suspension and no police agency is alerted, none of the usual procedures are followed to collect evidence. They do this to keep the perception of the College clean and safe in the public eye, when in fact there have been serial rapists allowed out, committing crimes over and over again. The colleges don't want to lose alumni donations and hide scandals, there needs to be type of amendment to laws forcing them to call in law enforcement for any type of sexual crimes or face some severe consequences. Terrible things happen on campuses all over the country now and much of the crime is never punished. This is one guy who should never be given a license to practice medicine, please don't tell me his specialty was going to be pediatrics. Who knows how many people this man alone could damage before he was caught.

You're right, especially about rapes, which is why women who are sexually assaulted should go STRAIGHT TO THE POLICE IMMEDIATELY. Go to campus officials second, not first!

My school's campus police were deputised and had to show records to the city and county. It helps reduce these issues as ther are forced to be police officers rather then security guards.
