Senator Mark Grisanti, Wife, Attacked And Beaten At Seneca Niagara Casino

NIAGARA FALLS, N.Y. -- A state senator and his wife said Saturday they were attacked and beaten at a Niagara Falls casino hotel after the lawmaker tried to break up an argument between two men, one of whom accused him of hating the Indian tribe that owned the resort.

Sen. Mark Grisanti said he suffered bruised ribs in the Friday night altercation. His wife, Maria, was more seriously hurt. She was diagnosed Saturday morning with a concussion and possible broken nose.

"It's just been horrible," Maria Grisanti said in a phone call from her Buffalo home after returning there from the hospital Saturday afternoon. She said that during the attack, she feared for her life.

The fight happened following a fundraising gala for the Seneca Diabetes Foundation at the Seneca Niagara Casino and Hotel Events Center. The Grisantis attended because their daughter was part of the entertainment for the night, performing with the Buffalo singing act, the Scintas. They were in a lobby area around 11:30 p.m. when they encountered two men arguing loudly.

Grisanti said he thought the men were about to come to blows, so he asked them to calm down.

"I probably just should have walked away," he said.

One of the men demanded to know his name. When he identified himself, he said the man hurled a curse word, accused him of hating the Seneca Nation and punched him in the chest. Then, Grisanti said, a woman with the man socked him in the side of the head.

As the men scuffled, Maria Grisanti said she was attacked by two women who appeared to be with the man fighting with her husband. She said she was thrown to the ground and then punched while one of the women pulled her hair out and repeatedly slammed her head on the floor.

"They were big, too. Maybe six feet tall," she said.

Niagara Falls police confirmed that there had been a melee at the casino.

In a statement read over the phone, police Superintendent John Chella said detectives were "reviewing the situation and investigating any and all facts to determine what exactly took place." He said that "once the facts are determined" the police will decide "what course of action to take, if any."

Mark Grisanti said the man who attacked him left the hotel without being detained. He said police told him security camera video of the altercation was "inconclusive." He said he believed one of the women had been charged with disorderly conduct, but for a separate fracas with security guards.

The couple didn't initially seek medical care, but Maria Grisanti went to the hospital Saturday after waking up with a headache and a bruised and swollen face.

The Seneca Nation, which controls semi-autonomous territory in western New York, has been at odds with state lawmakers over a variety of issues related to its sovereignty, including revenue from tribal casinos and its right to sell cigarettes without collecting state taxes. The tribe owns the casino where the fight took place. Grisanti's western New York district includes Niagara Falls.

Seneca Nation President Robert Odawi Porter released a statement Saturday expressing regret over the fight. He said he hoped Maria Grisanti was recovering quickly and noted that she had attended his inauguration in 2010.

"I would hope for better behavior and conduct from everyone at such an event as this, although it transpired sometime after the gala ended," he said. "Sadly, one cannot control individual behavior."

Mark Grisanti said that he didn't blame the tribe for what happened.

"We've always had a great relationship," he said.

"It was just a very strange night," the senator added.

This is absolutely "inconclusive" like the supposed video footage. I have been in many casinos, security would have been on this in a split second. Eyes in the sky are everywhere. And they waited until the next day to go to the hospital? BS, who is seeking reelection or to close the casino or whatever.

Politicians should not get involved in brawls in casino lobbies. These places have security and professional door muscle. He lacked judgment.

And if he had kept walking and someone was seriously injured or god forbid killed during the altercation, I am sure you would have congratulated the Senator for walking past and not doing anything, right? Of course if he is a republican, then I am sure you would have called him something else.

Finally, Millions of Concerned Citizens, with the help of cutting edge boat-rockers, have come to save the day. The Occupy Wall Street movement was an excellent start but now it’s time to plan seriously. The “American Spring” is the storm on the horizon for Republican/Conservatives whether they know it or not. These Republicans of 2012 are f***’n insane. They suffer from severe superiority complexes, odd paranoia, religious delusions, racist attitudes and low, LOW grade thought processes!

Why would ANY responsible journalist take anything Conservatives say seriously? Just look at how your spokespersons are representing you Mr & Mrs Republican voter. Has anyone really listened to what they’re saying? Doesn’t anyone think it matters the likes of Ann Coulter (and 100’s like her) insults a majority of the US population on a daily basis? An American majority that is already very, VERY angry at Conservatives for the Bush/Cheney catastrophe…

The casino in Niagara Falls is one of the most disgusting places I have ever experienced. The people who populate the casino floor remind me of a Mad Max movie. Seriously!
It is an example of failed political vision considering that it has become such a prominent fixture on the landscape in Niagara Falls New York.
As a Niagara Falls native who now lives in Buffalo, the contrast between what Buffalo has done with its future and that of Niagara Falls is like night & day.

I met the Seneca chairman, Robert Odawi Porter, when he started the Indian Law Department
at the University of Kansas in 2000. He's an honorable man. When all of the Haudenosaunee
Nations have dealt with the out and out thefts as they have over the years....this is what happens.
After the fraudulent Buffalo Creek Treaty of 1838, groups of Haudenosaunee people were gathered
up by the Quakers and dragged to Kansas where they were promised 1.8 million acres of land.
Only 10,000 acres of that land went into tribal hands and those people were ran off that land
by the late 1850's. The territory of Kansas illegally sold that land out from under the New York
Indians as they were called and it took from 1857 to 1901 before the New York Indians
were given any compensation for the stolen Kansas lands and stolen New York lands.
Native people have learned that a supposed Christian Nation doesn't always act very
Christian and civilized. Forty four years to be paid back for stolen lands in two states....
somebody isn't very civilized. Better yet, somebody has immunity from being sued for
lands for almost two hundred years and Republican SCOTUS appointees play dumb
and sweep their crimes under the carpet of a dumb american society that blames
the victims....only in america......

Obviously the article isn't going to provide much insight, but perhaps you'd consider reading some of the comments below (I'd personally recommend Tuschkahouma's).

Very often, I've found, commenters provide more of the "truth" surrounding a story, than the story itself, so, when I have a question after reading the story, I often read as many of the "comments" as I can so I don't end up asking a question that someone has already provided the answer to.

But that's just me.

I'm fairly confident they likely look at us, and the way we've treated the land, air, and water, and arrive at the same conclusion.

I expect, however, they've already arrived at an answer as to "why" we do it.

The state of New York must decide whether to abide by their agreement to grant sovereign land and rights promised to the Seneca tribe or lie and cheat these indians tribes out of the last bit of land they have managed to keep hold of.

I'm trying to understand this "incident". Several people beat up a NY State Senator and his wife without any provocation and the police can only say that the "May" take action in the future? That is called assault and battery, and assault to commit grievous bodily harm, at the very least. The Senator was acting as a good samaritan and was attacked for his efforts. "Mark Grisanti said the man who attacked him left the hotel without being detained. He said police told him security camera video of the altercation was "inconclusive."" INCONCLUSIVE??? I have to guess that they were tribal members and that there will be little or no justice served there.

I live in Buffalo....I've been to this casino...and I know who John Chella is ....it's very sad to hear that comment....think he should have left off "if any" re charges...I totally agree with your comment....these women basically could have killed her and NOBODY grabbed them... and they were allowed to walk out (the one woman may or may have not been involved that they arrested) of the casino.....this smells of a coverup by the casino....and the comments in Buffalo that they have donated large amounts of $$ to the Republican Party and to Senator Grisanti personally seems to explain the comment from the one businessman while punching him "you've done nothing for the Senecas" so I guess (what a shock) that when people donate to politicians they expect special treatment.

white man did steal the land and your comment is just mean and hateful. our history books only show indians as savage. they were trying to protect their families and properties as they were being murdered and killed. Innocent women and children who were slaughtered. the europeans were victorious, and that's fine, but don't pretend we didn't have our own holocost here.

after all the murder done by our the Army in our name, we agreed to grant sovereign lands. can't we at least keep our work?

the State of New York violated the Indian Non Intercourse Act of 1790 stealing most of the
tribal lands without an act of the US Congress as prescribed in the Commerce Clause
of the US Constitution. This theft began in the 1790's and went up into the land thefts
by David Ogden and the fraudulent Buffalo Creek Treaty of 1838. All of the thirteen colonies
had immunity from land theft claims from the 1790's to the 1970's. The Oneida and Cayuga
Nations along with other members of the Haudenosaunee Confederacy all filed land claim
lawsuits in the 1970's. The anti sovereignty thieves drug their feet for a couple of decades
until the incorrect Sherill V Oneida Indian Nation ruling of a couple years ago which closed
the door on land claims and was sanctified by a number of states rights Indian hating
Republican appointees on the SCOTUS. I'll name them.....Thomas, Scalia, Roberts,
and their patron Indian hating tutor...Judge Rehnquist. Don't believe me....read Like
a Loaded Weapon by Lumbee attorney, professor, and scholar...Robert Williams Jr.
A number of people on here show the typical ignorance of Americans who know nothing
of the history of land theft that allowed their country of immigrants to be founded on stolen
lands. So yes....until the GOP shows different actions toward tribes....it appears they
hate Indians. And it's ironic because Ronald Reagan signed the Indian Casino law into
effect in 1988. Try telling a tea partier that.

Why should American Indians receive special no tax benefits? Modify the outdated treaties and make it a level playing field. Many tribes around the country have these benefits, and they are making obscene profits from their tribe owned casinos. If you think they are passing these profits along to their fellow Indians, get a clue because it isn't happening. If American Indians would assimilate into the current century perhaps their high level of proverty around the country would finally disappear. I'm not optimistic at all that that is going to happen. They are stuck in the 18th century in terms of their beliefs.

I'm no "authority" on any of these issues, but I suspect that A LOT of what you present in your statement is either probably false, or at a minimum highly debatable.

If you think they are passing these profits along to their fellow Indians, get a clue because it isn't happening." is most certainly not true of a large number of Native American Nations. I live in Arizona, and many of the Nations here are living a far better quality of life as a result of their "ownership" in Casinos and other business ventures.

I'm not sure I could support imposing changes to long standing treaties that recognized a peoples desire for "self governance" and maintained their "sovereignty" in exchange for a cessation in hostilities. WE invaded THEIR COUNTRY. They did not "surrender", they were not "conquered" and they did not give up their rights under these treaties. To suggest that they should now do so, because they have learned to profit UNDER OUR SYSTEM, seems myopic and fundamentally unfair. No one is forced to go to their casinos and spend their money there. If they are making "obscene profits", I don't see how you can cite that as "unfair", or criticize them for that.

Before we, as a Nation, begin to consider imposing our Tax System on them, or negotiating new treaties in order to "level the playing field", I would think we would have to put our own house in order, beginning with the "unfair advantages" being provided to large corporations that have long held preferred status in their industries. Native Americans have long histories of seeing American "fairness" in action, I can't really fault them with being skeptical of being treated "fairly" in any discussion of renegotiating their legal standing.
