Personhood Bill Resembling Failed Mississippi Measure Advances In Virginia House

The GOP-controlled Virginia House of Delegates Monday advanced a "fetal personhood" bill that would give legal rights to a human fertilized egg and a measure that would require women seeking abortions to first undergo trans-vaginal ultrasound tests. Delegates rejected an amendment that would have ensured contraception remains legal once the personhood bill goes into effect.

The personhood bill, sponsored by Del. Bob Marshall (R-Prince William), defines the word "personhood" in the Code of Virginia as beginning at the moment of fertilization. Voters in Mississippi, one of the most socially conservative states in the nation, rejected a similar measure in October because it complicated the legality of stem cell research, in vitro fertilization, abortion in cases of rape, incest or life endangerment, and certain kinds of birth control.

Marshall said he's been working on passing a bill like this in Virginia for the past 20 years and insisted that the bill would not "directly" affect contraception or abortion -- it just provides a legal framework for mothers to sue if anything happens to her unborn baby.

“The legal effect here is [if] a pregnant woman is driving in an intersection and someone runs into her, she can sue for loss of a child,” he said. “Under the current code, a mother cannot do that. [The bill] has no direct legal effect on abortion or birth control.”

But House Democrats, in a press release on Monday, expressed concerns that the bill could have farther-reaching consequences than Marshall acknowledges. House Minority Leader David Toscano (D-Charlottesville) called it "another example of misplaced priorities."

“Yet another extreme bill on a social issue emerges, and House Republicans saved the most controversial one for last,” he said. “House Democrats are focused on education, economic opportunity, and transportation while the GOP continues to push a narrow, divisive agenda.”

To mitigate Democrats' concerns, Del. Vivian Watts (D-Fairfax) tried to attach an amendment to the bill that would declare that nothing in it could be construed to outlaw any form of legal contraception, since some kinds of birth control have the potential to prevent a fertilized egg from implanting in the uterus. The House voted 64 to 34 against considering the amendment.

The bill to require ultrasound passed the House 63 to 36, with one lawmaker, Del. C. Todd Gilbert (R-Woodstock), describing abortion as a "lifestyle convenience" during the floor debate. An external ultrasound test is unable to generate a fetus image during early pregnancy, but a trans-vaginal ultrasound can.

Personhood bills, far more restrictive than any other anti-abortion provision on the books, could directly challenge Roe v. Wade. Similar legislation is being considered in at least 12 other states, either as a ballot measure for voters or as a bill to be decided by the state legislature.

In response to the measure, Virginia senate candidate Tim Kaine (D) took the opportunity to distinguish his views on reproductive rights from those of his Republican opponent, George Allen, ahead of what is expected to be a close and important Senate race between two former governors. While Allen hasn't officially endorsed Marshall's bill, he notes on his website that he "believe[s] life begins at conception and support[s] legislation declaring the personhood of every individual life."

Allen's campaign did not respond to requests for comment for this article.

Kaine sharply criticized the personhood bill in a statement on Monday, assuring voters that as senator he would "fight for affordable and accessible contraception."

"I strongly disagree with the House of Delegates' vote to enact personhood legislation," he said in a statement. "This reckless proposal, supported by my opponents, including Bob Marshall and George Allen, could threaten access to some forms of birth control for women across Virginia. Even when given the opportunity to reaffirm their support for contraception, Marshall and Virginia House Republicans rejected a measure to create a safe harbor protecting women's access to birth control."

Taken literally -- and how else does one take such a law -- means that every pregnancy that ends in a miscarriage or stillbirth must be investigated as a murder. More twins are conceived than born, so every time that happens that surviving child must be held responsible for the one lost. And what about molar pregnancies that are 97% fatal to the mother? Nature is a bitch and god does not do a thing about it.

My first thought about this bill... is how would it affect the rights of a birthing mother? Could a hospital/doctor/government entity somehow get custody of a fetus/unborn child and treat it for medical conditions against the mother's consent? Could the same force a mother to undergo a c-section or other medical procedure without the mother's consent if they felt it was in the best interest of the fetus/baby? Could they force a mother with a wanted pregnancy to undergo ultrasound or genetic testing for the "good" of the fetus/baby? Scary...

Notice that the Virginia bill contains a large hypocritical exemption for "assisted conception."
What it says is that the eggs fertilized in a fertility lab are not considered persons but all other embryos are.
Why are they creating a second class of citizens?

Because there is a rational medical, legal, ethical, reason for doing so. During in vitro they implant multiple embryos into the woman and if all of them take hold, the woman's life may be in danger necessitating a medical procedure commonly referred to as an abortion to remove the 'toxic' embryos.

A minority of religious people are opposed to all this but the vast majority of people have no problem saving a life using this process and no problem with woman being able to have children using this procedure. And since there is no way to know which procedure is going to threaten which woman's life, they did what liberals do not understand, i.e. they used common sense and made a exception in the law. It's not exactly analagous to, but is close enough to the centuries old right to defend one's own's life, whether threatened by a man holding a gun or a implanted embryos. Hopefully as medical science progresses they will solve the problem of having to plant multiple embryos and eliminate the 'abortions' necessary to remove them.

You seem by your rude "thanks for playing" comment to indicate you think this is a game.

Why would the legislature of Virginia legalize the abortion of lab fertilized eggs, but offer legal protection to eggs fertilized the old fashioned way?
If they believe that a fertilized egg is a human unless it is created in a lab, that creates two classes of fertilized eggs; real ones and lab ones.
The scientific, legal, ethical etc. reasons are then immaterial. The second class human is not granted the same 'protections' as the first class human.
If you cannot abort a first class human but you can abort a second class human, at what point do you grant full human rights to second class humans?

And if you can find legal, medical, rational reasons to abort second class humans, those same reasons must be applicable to first class humans as well. The Constitution does not allow us to apply different rights and protections to second class humans.

There is a thing called "seperation of Church and State" this is clearly a religious issue and needs to stay in that realm. Just because people of one religion does not like or approve of something does not mean that they have the right to utilized legislation to enforce their particular religious doctrin on those that do not agree with it. It is similar to someone walking up to me and saying " I do not believe in your church so I am going to make a law that tells you, you have to attend mine. As for the facts, Morer children are kiiled every hour by issues that are caused by over population< disease, hunger, war,> than there are in a month due to abortion.

The United States of America, once upon a time, the proudest leader of modern civilization and progress, now only a moral wannabe leader and guardian of human rights (lol have to laugh here) who destroys entire countries and condemns entire cultures because of similar laws. The US is becoming what they fight against. If it continues in this direction the middle east will have to wage wars on us in 50 years because we will be the oppressors of humanity.
