Midwest Hutaree Militia More Like 'Social Club' Than War-Ready Faction Against America: Defense

DETROIT — An undercover informant was paid about $31,000 in cash for his critical role in an investigation that led to charges against members of a Midwest militia accused of plotting rebellion against the U.S., an FBI agent testified Tuesday.

Agent Leslie Larsen was the first witness at the weeks-long trial of seven members of a southern Michigan militia called Hutaree. She answered a series of friendly questions from a federal prosecutor, mostly describing the timeline of the 2008-10 investigation and certain milestones in the case.

Larsen said informant Dan Murray secretly recorded conversations with the militia while he trained or attended meetings with members, especially leader David Stone. Murray received $25,000 for his time – 300 to 400 hours – and $5,600 for expenses, such as his cellphone, tent, mileage and sleeping bags.

Larsen wasn't asked how the FBI determined his pay but said she didn't know if Murray reported the money to the Internal Revenue Service or paid taxes. Murray will be a key witness later in the trial.

Militia members from Michigan, Indiana and Ohio are accused of conspiring to ambush and kill a police officer, then attack the funeral procession with explosives and trigger a broader revolt against the U.S. government. They deny the charges and claim authorities overreached.

"A new president comes into office. The agencies that are sworn to investigate and protect him are very, very curious about what's going on out there," defense attorney James Thomas told jurors in his opening statement. "That premise – that somebody would be out there who is going to be a danger, either to the country or to the president of the United States – got distorted.

"It was a conclusion that was brought to be supported by facts, facts that were manipulated," Thomas said.

Another defense attorney, Mark Satawa, signaled to the jury that Murray's credibility will be under intense scrutiny.

"There was not a single act of violence perpetrated by a single individual sitting over here. ... Don't let fear be the thing you fear," Satawa told jurors, a day after prosecutors during their opening statement held up weapons and military-style equipment seized during the 2010 arrests.

During her testimony, Larsen said Murray was paid $12,700 for work ahead of the Hutaree investigation. She said he attended meetings of at least one other militia but there were no indications of illegal activity.

Larsen said the FBI removed Murray from the Hutaree in January 2010, more than two months before charges were filed, because an undercover agent had been securely planted inside the group.

Murray had his own problems in February of that year when he fired a gun toward his wife and, in a separate incident, attempted suicide, according to court records. Defense lawyers have suggested that the informant's personal problems may have motivated the government to round up Hutaree members, not because of some threat against police as authorities have insisted.

Assistant U.S. Attorney Sheldon Light told the judge there's no evidence that the government intervened with local prosecutors to help Murray.

"Light's statement is accurate," said Maria Miller, a spokeswoman for the Wayne County prosecutor's office.

In court, the government played portions of videos apparently taken by Hutaree members and posted online. They show people dressed like soldiers firing weapons in the woods, crawling on their bellies and instructing one other about hand-to-hand combat. In one clip, a United Nations flag burns from a pole and is replaced by a Hutaree flag.

Larsen said she was concerned.

"Other militias have a designated training range, a designated firing range," the agent testified.

Of the original nine defendants, Joshua Clough, of Blissfield, Mich., is the only one to make a deal with prosecutors. He pleaded guilty in December to illegal use of a firearm and faces a mandatory five-year prison sentence. He could be called as a witness to testify for the government.

Besides Stone, the other defendants are Tina Mae Stone, Joshua Stone and David Stone Jr., all from Lenawee County; Thomas Piatek, of Whiting, Ind.; Michael Meeks, of Manchester, Mich.; and Kristopher Sickles, of Sandusky, Ohio. Jacob Ward, of Huron, Ohio, will have a separate trial.

Besides conspiracy charges, all face at least one firearm charge.

The "Bill of Rights" was added to the US Constitution to make it absolutely clear to the federal and state governments that it shall not ever infringe upon these enumerated rights fought for in a bloody revolutionary war against tyranny; our rights are God given rights, not privileges given to the people by government.

The "Bill of Rights" is also a means of judging the legitimacy of the government. When our inalienable rights are blatantly being violated by the representatives of "We the People", i.e. the government, then we are once again under tyranny. Today our rights and national sovereignty is being viciously abused. Either we elect RON PAUL, a true American that follows the United States Constitution, or we devolve into a second War for Independence against a tyrannical government. Remember during a bloody war no one is safe.

I often wonder about these so called militias. I can never understand just what is it that makes these militias think that they can OVERTHROW all four branches of our POWERFUL MILITARY. We have a military that has some of the most advanced weaponry on the planet, we are millions strong in all 4 branches, so, how does a band of several dozen/hundred/thousand THINK that THEY are going to WIN against all these military people, all the rockets, bombs, bullets, sophisticated technical smart bombs/smart bullets, missles, mines, radar, stealth equipment, etc etc HOW I want to know. Do these militias really think that they the MILITARY are just going to stand by and allow this to happen?, they would be wiped out in less that 24 hours I bet.

Unfortunately they are for REAL, and as of the last report I saw on this subject it was said that since way back in the 70s/80s these groups have grown in size and numbers throughout the country, from several hundred to several thousand as of late. But from everything I watched about them even videos of them "Training In The Woods" they are basically just a band of people with mostly small arms weapons, some high explosives, and the basic military gear like vests, nite vision, and other stuff developed as of late. But they DON'T HAVE HEAVY ACCURATE SMART BOMB STUFF, and the more sophisticated things, plus they are still OUTNUMBERED BY A COUNTRY MILE as they say. Can they make an impact? maybe, can they WIN? I SERIOUSLY DOUBT THAT, :>)

Perhaps you should study our history a bit more, the whole point of having militia's is to protect the citizenry from a tyrannical Govt. Oue military couldn't win in Vietnam, Iraq or Afghanistan, what makes you think it can beat Redneck America?

Any of you ever hear of Habeus Corpus? Personal feelings aside, I am curious to hear the evidence against them. Historically, paid informants tend to have a personal agenda that defies true justice. As far as armed revolt against the government, anyone who could really believe that they would be succesfull in that endeaver is obviously mentally incompetant to stand trial. Don't like the way things are in this country? Become proactive in your community. Stop just reading about all the political BS and start working to change things starting with your LOCAL government. As citizens, we all have an obligation to PARTICIPATE in our democratic, representational government. THIS IS NOT A SPECTATOR SPORT. Be the change you want to see...

I agree, people complain that the goverment does not represent them and that is true because we have become lazy and not upheld our end of gov by the people for the people. We sit on couches and let faux news and the such tell us what to think instead of getting out there and participating.

Well, this case is apparently built on several pillars that all intertwine to make a solid case. People make big mistakes when they try to pull one piece of evidence out and view it in isolation, and fail to see how all the evidence fits together as a whole. That is why jurors can't deliberate until all of the evidence is in.

my comment was not an assesment of guilt or innocence, just a statement that I would wait for a fair trial by a goup of non-biased citizens. The politics of fear have taken a front seat on way too many cases. I for one would be interested in hearing the evidence. I personally do not believe in violence, and I cannot justify any reason to commit the aleged heinus crime(s).
