Man Tries To Evict His Mom, Mary Kantorowski, On Her 98th Birthday (VIDEO)

NEW HAVEN, Conn. — Peter Kantorowski wanted his 98-year-old mother to move into a nursing home or live with him. She wouldn't go; she didn't want to leave her home of nearly 60 years.

Finally, Kantorowski went to court – and served his mother with an eviction notice shortly before her 98th birthday in December.

Mary Kantorowski says she won't leave the small yellow house she's been in since 1953, raising her two sons and cooking for the church she attended daily. The house her late husband wanted her to stay in until she died; the house she says is her "everything."

"I don't know why he wants me to leave," she said Friday.

The epic mother-son feud is headed to court next month.

Peter Kantorowski, 71, became the owner of the Fairfield home several years ago when his mother transferred ownership to him but retained the right to live there, in what's known as a quit claim, Mary Kantorowski's attorney said.

The retired taxidermist said he's concerned about her well-being, that she's seemed disoriented and has been living in poor condition.

"I'm not throwing her on the street," he told WTNH-TV in New Haven. "At her age, at 98, I'm sure that she should be with people of her peers. She should have her meals on time."

Peter Kantorowski and his attorney didn't return telephone messages left by The Associated Press on Friday.

Mary Kantorowski's attorney, Richard Bortolot Jr., said she can take of herself, still does some of her own cooking and is seen regularly in her home by doctors and nurses. A judge ruled she was competent and appointed Bortolot to represent her in the eviction.

Her younger son, Jack Kantorowski, says his mother is in relatively good health. He's on his mother's side of the family feud.

"If there is a money problem or anything else, he should have said something a long time ago instead of just trying to get rid of his own mother," Jack Kantorowski said.

Peter Kantorowski, who lives about 20 minutes away in Trumbull, hasn't seen his mother for eight months, her attorney said.

"I'm appalled a son would do this," Bortolot said.

Jack Kantorowski said his father worked multiple jobs to buy the house and built additions over the years.

"He was always trying to protect my mom; she'd always have a place to live," he said. "If something happens to me, there was always going to be a home for her to stay for the rest of her life."

Peter Kantorowski filed a complaint against his mother in December after she refused to follow an eviction notice filed Nov. 30 to vacate the premises by Dec. 7. A trial is set to begin March 2 in Bridgeport Superior Court.

Bortolot says a probate court stopped Peter Kantorowski from trying to sell the house, valued at $330,000, after the eviction papers were served.

Asked where she might live next, Mary Kantorowski's voice catches.

"I don't feel very good about it," she says. "I want to stay right here in my own home."

Interesting the opinions of people commenting. You do not know this woman or what her mental state is or what the son has observed. The courts and lawyers will often say someone is able to represent themselves even though they can't. If my mother was as old as this lady, trash started piling up around her when there was none before, and she was regularly not eating, you bet your a** I would try to force her to move in with either me or go to a decent community living center. This man is doing what's best for his mother, at least on the surface. He could also be trying to get her out so he can rent out the house and bring more money in for himself, but that'd be nonsensical since he'd have to pay for his mother to stay in a good nursing home at the same, and those places cost a fortune.

Satur9 I'm sure he'll sell the house for a nice amount of money. He could easily get her into a nursing home without paying a dime. He can go to any good estate attorney and since she has no assets she will be eligible for Medicare. Do you really think he would pay to put her in a nursing home?

According to Probate Court records, Mary Kantorowski and her husband, John, agreed to transfer the house to a trust administered by Peter Kantorowski on the condition that Mary would live there until her death, and upon her death, the house would go to Peter and his younger brother, Jack, the newspaper reports.

In July 2005, however, Peter Kantorowski quitclaimed the house from that trust to another he and his wife control, giving him ownership of the house. Six years later, in Dec. 13, 2011, his mother's 98th birthday, Peter Kantorowski had his mother served with eviction papers.

Wow. What an ungrateful "child". "The house her late husband wanted her to stay in until she died; the house she says is her "everything." This man is selfish beyond belief. And if she has a quit claim or life estate, he can;t evict her. She has a right to be where she's comfortable in her remaining years.

My friend who passed away at 89 asked me to make sure she could stay in her home until she passed. She knew if she transferred her assets to her niece, they would immediate put her into a rest home. So, she transferred everything to me and I took care of her for the next two years until she passed in her own bed in her own bedroom. It was an honor to help her with that. I was prepared to pay out of my own pocket if necessary to allow her that dignity.

I signed the petition, but I think the law is on her side. The house was transferred into a trust for her benefit. It is a standard estate planning/elder care tactic. It was not transferred for the son's benefit. Yet he transferred it out of the trust. The courts don't take kindly to people abusing trusts.
He also diverted her SS checks. I think that could be a felony, if she presses charges. I think he has opened himself up to a few charges.

Yesterday I wrote in the defense of the son, thinking he was concerned. That was before I watched the video. It tells a whole different story than what I thought was going on. The guy wants the money.

I applaud your willingness to look at all sides of the story, however there isn't much room for a man that is trying to evict is 98 year old mother. Something would really have to be wrong for me to find justification for that.

The use of the word "evict" here is getting people's emotions fired up. It would still need to be used even if the son was completely justified. I did not watch the video so I am clearly missing that angle.

Mary has been found competent which some people here seem to think that it only means she can represent herself. obviously, they haven't read the laws regarding Competency and Capacity. Simply put, Competency is the determination that a person retains the capacity for a specific action. Capacity In the context of geriatric psychiatry and forensic psychiatry, refers to the intact ability to respond to a particular situation with appropriate appreciation and to act in one's own self-interest. mary can, if she wants, change her will, change any advance directives and even at the age of 98 Mary is allowed to decide for herself where she wants to live and with whom. as for those who think that Mary shouldn't be living alone if they had read the article they would see that she is visited regularly by doctors and nurses. and you can bet that her lawyer is there as well.

This story has been all over the papers here in Ct. What hasn't been reported is that the son also made his mother pay the property taxes on the house out of her small Social Security check. This was done after the house was deeded into a trust which stipulated that the trust would pay the taxes.
Later he quit- claimed the house and put his name and his wife's name on the new trust. The son also diverted the mother's mail to his house. He then opened a checking account into which his mother's social security checks were deposited and left his mother very little money on which to live.
The mother says that her son has financial problems. I would say that he has more than financial problems. I hope that she disowns him.
