Boy Scouts To Turn Over Files In California Sex Abuse Cover-Up Case

SANTA BARBARA, Calif. -- A judge overseeing a lawsuit brought by the family of a California boy molested by his troop leader in 2007 has ordered the Boy Scouts of America to hand over confidential files detailing allegations of sexual abuse by Scout leaders around the nation.

Known as "ineligible volunteer files," the documents have been maintained since the 1920s and are intended to keep suspected molesters and others accused of misconduct out of Scouting. Scouts officials have resisted releasing them and won't discuss their contents, citing the privacy rights of victims and the fact that many files are based on unproven allegations.

The officials deny that the files have been used to conceal sexual abuse.

"These files exist solely to keep out individuals whose actions are inconsistent with the standards of Scouting, and Scouts are safer because of them," Deron Smith, public relations director of Boy Scouts of America, told the Times.

The Santa Barbara case is significant because it seeks to unlock files that have never been turned over by the Scouts, including all since 2005. It also alleges wrongdoing that took place relatively recently, even as the Scouts have stepped up protective efforts.

The trial is scheduled for April, nearly five years after the boy, then 13, was molested by volunteer troop leader Al Stein at a Boy Scouts Christmas tree sale in Goleta. Stein pleaded no contest to felony child endangerment in 2009.

He was sentenced to two years in prison but was paroled early and is living in a Salinas motel with other sex offenders, his attorney Steven Balash told the newspaper.

The victim's name has not been released. His mother claims that David Tate, then the Los Padres Council Scout executive, asked her not to call police after she reported her son's claim of abuse.

"He said that wasn't necessary, because the Scouts do their own internal investigation," said the woman, whose name the Times withheld to protect her son's identity. "I thought that was really weird... I thought it was really important to call the sheriff right away."

The lawsuit, which seeks unspecified damages, contends the Scouts knew or should have known that Stein had put the boy at risk and cites Tate's reluctance to call police as evidence of an effort to conceal widespread sexual abuse.

Tate, now a top Scouts official in New York, declined to comment.

The boy's lawyers contend the files will expose the Scouts' "culture of hidden sexual abuse" and its failure to warn boys, their parents and others about pedophiles in the ranks of one of the nation's oldest youth organizations.

"They have created these ticking time bombs who are walking through society, and nobody knows their identities except the Scouts," said Timothy Hale, one of the lawyers for the Santa Barbara County boy.

Some of the estimated 5,000 files have surfaced in recent years as a result of lawsuits by former Scouts accusing the organization of failing to exclude known pedophiles, detect abuses and report offenders to police, and allowing predators to remain at large.

It is disappointing that there are still people who take advantage of children. As a mother, the idea of my children being harmed or lost is not something anyone wants to consider. Children are at their most vulnerable as a target of sexual assault at the age of 15. As a former short timer in BSA back in the early 70's I can tell you what went on in my troop before I quit. There was no such thing as two adults deep. Leaders and fathers drank heavily on campouts. One of the leaders was another member's uncle who had an affection for teen boys, including his own nephew.

I was lucky to escape untouched after a few months. When I quit BSA I did not tell my parents what was going on, since it just seemed kinda creepy and embarassing to talk about. I never did tell them why I left.

Meanwhile, Uncle Eddie continued in scouts and continued to molest his nephew until suddenly his nephew was shipped off to live with another relative, never to be heard from again.

Sure, there are rules and regulations. Remember the old saying, "Rules were meant to be broken"? I'm sure this stuff still goes on, especially in areas where there are poor and disadvantaged, fatherless boys. Sad.

It's a real shame that child molesters can't have what society deems as 'normal' or acceptable sexual desires. You cannot control who you're attracted to. Be it straight, gay, chubby chasers, weird fetishes, etc. These people have been cursed with the desire for children. Nobody wakes up and says "I prefer children". Its just a something inside of them that develops over time for reasons we can't quite understand. As sick of these people come off, its not like they can control what there feelings. THAT SAID, I am not saying they shouldn't be held accountable for their actions. Its a crime and there is a victim. I'm just saying that as well as the victims, in a way I feel sorry the perpetrators for not being able to have "normal" sexual desires.

It may be true that they are sad victims of whatever "abnormal" forces drive them, but they have to know these are NOT acceptable urges, and that they absolutely MUST resist them! They can and must be in control of their actions. If they can't seem to manage that, then they need to be put where they can't act on those urges ever!

WOW! That is one of the most unexpected desplays of compassion I have ever seen! You must be a wonderful person. You also raise a real problem. What do we do with them ehen they're caught. We obviously can't leave them on the street. What their fellow prisoners are going to do to them once they find out what they're in prison for is probably worse than what they did to the kids. In the past I've always thought--iI thought at all--"Well, they deserve it." Your comment makes me blush. But what can we do?

Replying to both Sally and skeehanson. Unfortunately there is nothing you can do, at least not now, other than protect the victim and punish the abuser. They have to be held accountable because they know its wrong and they know its illegal. As Sally said, they have to never act on those urges. I say if apprehended and in prison, Psychiatrists and Psychologists should try to see if there is an underlying cause and see if they can be re-programed.

What are you talking about? No church was mentioned in the story.

Each troop is individually chartered by a community organization, a church/synagogue/mosque/temple, VFW, American Legion, Izaak Walton League, etc. and the chartering organization owns the troop. They charter the BSA program.

Due to my nephew and several boys in his troop being victimized 20+ yrs. ago, by another scout; who was transferred by their Council due to a "personality conflict" I am at every meeting & very involved now that I have two sons in Scouting. CORI's are supposed to be done every 2 years on all leaders/volunteers; however, if they've never been caught there's nothing on their record. Two deep leadership is required but if someone is up to something - they won't follow the rules and they'll find a way. Parents must teach their children to never be alone with a leader - no matter who it is. For that matter, there should never be only two scouts alone anywhere, based on my family's past experience. My sister & the other parents got local & state police involvement, they attend every parole hearing and guess what - 20 years years later Michael Nickerson is still in jail in MA, although he was allowed to change his name (why?) and is now a "minister". He had been transferred twice by the BSA, my nephew's troop leader contacted the prior two troops and found out he was accused of the same thing in each of them; those leaders were told that the BSA would "handle" it and not to contact police, they were not happy with what happened.

It's true that the BSA has policies designed to ensure known predators are kept out. But, in this case, the alleged coverup is a key factor. The BSA's reluctance to release these -- names redacted, I assume -- shows the BSA's protective policies are shallow and opportunistic.

This news report lacks context, because the legal responsibility as the BSA is organized is in the charter organization, I think. The BSA doesn't "own" the troop; the church or community group sponsoring the troop owns it. When I was a charter rep for a BSA pack, it was entirely up to the charter organization to screen and act. The BSA could only threaten to yank the charter if it wanted something contrary, which is what happened in my experience.

We had cubmaster with sexual convictions in his past who BSA finally compelled the charter org to remove, many months after I raised a red flag to the charter org. Under threat of reprisal, I alerted the BSA district anonymously. The BSA was right to intervene, but it and the charter org were wrong in that they never advised Scout parents so that parents might ask their sons what they experienced. The past convictions were public record. I found out by happening upon an old newspaper article in which he was arrested in a sting topped by the arrest of a public official.

The guy had cleared local police check because the conviction was in the neighboring town. BSA did nothing about that
