Texas Child Abuse Case: Children Removed From Home After Found Restrained To Beds

By MICHAEL GRACZYK and NOMAAN MERCHANT 02/21/12 09:41 PM ET AP

Texas Child Abuse
Three buildings and a travel trailer sit in the backyard of a Dayton, Texas, house Tuesday, Feb. 21, 2012, where 11 children, some of them reportedly found in restraints, were removed by children's protective services last month.

DAYTON, Texas — Texas authorities said Tuesday they removed 11 children from a crowded home where a registered sex offender lives after they found eight confined in a small, dark bedroom with restraints tying some to their beds.

Along with the children, 10 adults were living in the one-story, 1,700-square-foot home in Dayton, about 30 miles northeast of Houston, Child Protective Services spokeswoman Gwen Carter said. One month after a raid on the house, authorities are still trying to determine how the children are related and why they were there, she said.

The children ranged in age from 5 months to 11 years. Three who were age 5 or older had not been enrolled in school, Carter said.

The children were removed after authorities found two 2-year-old children tied to a bed during a January visit to the home, according to a court document.

A legally blind, 5-year-old girl "was in a restraint on a filthy mattress, and appeared to be in a daze," the document said. One child had a black eye and knocked-out tooth.

The adults told investigators they tied the children when they slept or took a nap during the day "for safety," the document said. An investigator noted that none of the adults said they saw anything wrong with the arrangement.

Two of the children had what authorities feared was pneumonia and were taken to a children's hospital. All have since been placed in foster homes, Carter said.

The case is still under investigation, and Dayton Police Sgt. Doug O'Quinn said officials are looking into criminal charges. Liberty County District Attorney Mike Little said his office would present a case to a grand jury next month, but he declined to discuss possible suspects or charges.

"Our primary concern was to make sure that the children were stable and safe," Carter said.

The home with a "No Trespassing" sign out front is in a subdivision near land used for farming and ranching. A tricycle and other toys were in the backyard Tuesday, and several cars were parked outside.

People leaving the home declined to talk to media assembled outside, and other residents and their relatives declined to comment or didn't respond to phone messages.

One person in Texas' online sex offender registry listed the house as his address. Mark E. Marsh III was convicted in Michigan 15 years ago of criminal sexual conduct with a 15-year-old girl. He did not have a working phone number listed.

Neighbor Wayne Hardin said he never saw the youngest children and had no idea so many people were living in the house. Though he often saw eight or more cars parked outside, Hardin said he was told the residents had a big family.

"I was shocked," said Hardin, who had called police about loud music blaring from the house. "We didn't have a clue."

Along with the children, two teenage runaways with a stolen car were at the home, authorities said. The boys, both 16, admitted running away from foster homes, smoking marijuana and driving a car they knew was stolen, authorities said.

Carter said the home was not registered as a foster home or day care.

I be around many people, and I see kids are treated terrible by people of other race. Children are use as a work horse, and can not complain. I see many Africans, Mexican etc treat thier children as slaves. Racism have nothing to do with it. Everyday in the news around the world about how childern are being treated wrongfully. Many things about children is hidden in the US. I can understand if you protecting your race. I am black and I see wrongbehavior being put on black children in the US. Much of it is from slavery! The issue is the mistreatment of children.

Sex with under age children is legal in some countries. This is when Nationality become a problem. I do agree with you.

This reply is to Gooddoc1: I agree with you about child abuse. People doing child abuse should be punist. Many kids who were abuse become abusive to thier children. The biggest problem the US. has is allowing abusive people into the country. Child abuse is becoming the biggest crime in the US.

This reply is Elizabeth: I did say are Mexicans are illegal. Mant of my friends are Mexicans and Africans. Many Mexicans and Africans I met are hiding from the law because of being here illegal. I had African women try to pay me to marry them for citizenship. It is illegal! I have high respect for Mexicans, but I like them to be legal to prosper. They are hard workers, and do obey the law. All people have the right to be US. Citiziens, but they should do it the honest correct way. I do not visit another country illegal.

This should have been found a long time before this. Chain all those adults & treat them like they did the innocent children. Eye for an eye.

I only wonder why it always takes so long for the authorities to raid these places. It almost sounded like fiction when they got to the part about the two 16-year-old runaway foster children who smoked marijuana. It is a horror story that we seem to read about all the time.

No child needs to live in squalor. No child should be abused, neglected, beaten, and sexually molested. by any man, woman or another young person. Children are the our future let us create a different safe world for the children now.

Even though I am a sex offender this kind of thing sickens me. My crime was in my house when the wife refused and the daughter decided to take her place and seduced me. I know I did great harm to her and am responsible for what happened. She was and is innocent. The fact that people don't understand why some sex offenders do what they do causes them to paint all of us with a brush that says PREDATOR. We are not all predators.

Yes.. you are.

You still refer to your wife's daughter as having "seduced you"? You deserved to be painted with that brush.

FYI if a sex offender in Iowa, where I commited my offense and was incarcerated is declared a "sexually violent predator" they will be civilly committed to the Civil Commitment Unit for Sex Offenders. I was not referred to the committee that does such probable cause hearings because incest is caused by a family dynamic. What you have stated shows your ignorance of psychology. Until you know their whole story you have no right to judge another. incest-information.coffeecup.com

Ewwwww, way too much info...classic case of transferring responsibility when you say the daughter seduced you. Was this your biological daughter? A predator is anyone thats advantage when they are being seduced, if you weren't one you would have realized she needed help and gotten her some and walked away...and gotten yourself a grown hooker to take care of your needs...not a child.
07:24 PM on 02/23/2012
Good idea. Go to a hooker. How when my wife would not allow me access to any money above $5 ? She was a controlling bitch which you would know if you bothered to read the story on the web site. Also read the Causes of Father Daughter Incest which is taken from a book by 2 PhD psychologists who treat incestuous families in the Houston area. It's not my opinion but theirs.

As to the questioning of schooling, Weaver said the children are home-schooled just like she was.
"She does home school very good. It’s a Christian curriculum. It’s the School of Tomorrow. She’s got all of her school books, so I don’t see anything wrong with that," Weaver said.

Wow, way to knock this into the ballpark, for the people just now tuning in, the child restrained to a bed, yes ONE child, was blind and and done so to help protect her while she was sleeping so she wouldn't fall out and hurt herself, they had visited this 'family' before and nothing was found wrong. Regarding the sick children, there is only a possibility that two of them have pneumonia, that information was put out without checking.

Regarding the SEXUAL PREDATOR.. He had misconduct with a 15 year old when he was 19 (NINETEEN) 15 years ago.

I'm amazed at how the media is portraying this.. it was in a different light earlier.

How does being blind necessitate being tied to a bed to prevent her from falling out of it? There are bed side rails that can be purchased for that purpose. HP is not the only source stating that more than one child was being restrained. A child was beaten. As for the children, they were diagnosed with pneuomia and hospitalized. I also read someplace else that there was more than one person with a criminal sexual past living in the home. Whatever all the details turn out to be, this is UNACCEPTABLE and those adults belong in prison if they are convicted.

This is disgusting. What makes me soo sad to read is 'Placed in foster HOMES' PLURAL. To be put through such an ordeal and then be taken away and separated from your siblings (possibly cousins to unless they were all siblings) is just beyond sad to me. If I could I'd take in all 11. Poor dears. This is just henious. I hope all the adults are charged and punished.

You would take in 11 children if you could, yet don't even take in one? You sound like an anti-choice republican!
10:20 AM on 02/23/2012
Suspect you missed part of the poster's point - that they would have taken in all 11 to keep the kids together in one household. And I see no need for the namecalling nor for attempting to bring politics into it...
