Catholic Colleges File Lawsuits Against Feds Over Birth Control Rule

Four colleges have filed lawsuits against the federal government over the new policy by the Obama administration mandating that employees of religious institutions have access to contraception free of charge.

Ave Maria University in Florida, Belmont Abbey College in North Carolina and Colorado Christian University have each filed lawsuits, represented by the Becket Fund for Religious Liberty. A fourth school, Geneva College, filed a lawsuit with the aid of the Alliance Defense Fund.

A controversy erupted after the announcement by the Obama administration that employers would be required to provide birth control without co-pays. There were 18 Catholic colleges and groups that petitioned the administration to repeal its decision.

To accommodate religious institutions, President Obama announced a compromise on Feb. 10 that requires the insurer -- rather than the employer -- to provide contraceptive coverage free of charge for women employed by the entities in question.

The compromise is tailored toward religious institutions such as Catholic hospitals who have to cover their employees' health care coverage, and colleges that offer health care coverage for students. The policy already exempted churches.

But the lawsuits contend that's not good enough for them, as the universities claim having to cover their employees -- who may or may not be religious -- violates their teaching that birth control is immoral.

"Allowing a U.S. president of any political party or religious affiliation to force conformance to his or her religious or secular orthodoxy through executive action, is a perilous precedent," Ave Maria president Jim Towey said in a statement.

"The state shouldn't punish people of faith for making decisions in accordance with their faith," ADF Senior Counsel Gregory S. Baylor said in a statement. "Every American should know that a government with the power to do this to anyone can do this -- and worse -- to everyone."

However, there are many students at Catholic universities who have been supportive of the decision to cover birth control.

"I'm paying $50,000 a year to go to college," Callie Otto, a student at Catholic University of America, told The Huffington Post recently, "I think that I should be able to get birth control with that $50,000."

The Obama administration wants coverage for contraception as preventive care. Birth control is not just used to avoid getting pregnant, it is also frequently used to protect women from developing ovarian cysts or getting cervical cancer.

Polling also shows 68 percent of sexually active Catholic women have used birth control at some point in their lifetime.

The Becket Fund is also representing the Eternal Word Television Network, in a lawsuit filed just before Obama announced the compromise.

CORRECTION:Following multiple media reports, a previous version of this article cited the statistic that 98 percent of Catholic women had used some form of artificial birth control. The researchers who produced that study have clarified their findings and this article has been revised.

I thought her 50K was to pay for her education, next they will want their booze covered. As far as those that work for the catholic colleges, I am no longer catholic but I do think they have a right to their beliefs. So if you don't agree then you need to get a job elsewhere, period!

Does the Catholic Church support insurance coverage of Viagra, Cialis, etc., for unmarried men? I'm no longer Catholic, but just wondered how consistent their enforcement of sexual policy is. (Why would a nonprocreating male need a drug like Viagra?)

All Catholic women who take BC and are work for Catholic institutions, should withhold church donations. Let the church know that their decision is costing people serious money.

When money in the collection plates dries up, it gets noticed.. One thing the church understands is money.

Too bad the bishops weren't as quick to jump on the pedophilia disaster.

OMG! I hope that the powers that be are not influenced by the Jehovah Witnesses that do not agree with blood transfusions! If this was not against women, it would not have been passed. UNITE WOMEN!! Don't have sex if they won't let us control our own bodies!!! Religion should not dictate public policy, HELLO, do we really need to discuss this again!!! Ignorant people with power. They can be. There are medical conditions which the combined contraceptive pill treats. Polycystic ovary, painful cramps to name a few.

The mandate has no dependency upon Federal funding, it applies to all employers.

The lawsuits are being provided pro bono.

Correct.
NO individual HAS to work for any employer whose teachings/beliefs clashes with the individual's. That person is perfectly free to work anywhere else where there's no conflict.

Where do you get the crazy notion that any woman has a "right" to birth control? Where's the document that declares such?

Any woman has the "right" to go to a doc, get an Rx for whatever birth control method she wants, run it to the pharmacy, get it filled. & PAY FOR IT.

First, the GOP has so successfully effed up the economy, it's not realistic to say someone can go just anywhere and get a job. Read the news, jobs are hard to come by.

Where do I get the 'crazy notion' that 'any' woman has a 'right' to birth control? What makes you think there needs to be a separate document making such a statement? IT'S BASIC HEALTH CARE! BASIC HEALTH CARE IS A RIGHT!

In your final paragraph, you admit that any woman has the 'right' to blah, blah, blah... What you're failing to acknowledge is that MANY women don't have the financial means to 'go to the doc, get an Rx, run to the pharmacy, get it filled & PAY FOR IT." That's where her health insurace provider comes in. Doesn't it seem strange to you that the ONLY entity NOT complaining about the HHS ruling is the INSURANCE COMPANY? Do you want to know why? Providing coverage for birth control is not only in the best interest of the patient, it's CHEAPER than providing coverage for pregnancy. Now how often do you suppose it happens that EVERYBODY wins?

It's not like people are being forced to use the contraception if they don't believe in it.
It's obviously an issue of money.
If anything, it's a matter of economic policy... the best way to approach the issue of a ballooning world population is preventative maintenance.

The 'world population' is not a concern in this issue. The USA is barely maintaining the replacement birth rate, and that is only due to immigration (legal and illegal). But don't worry, Obama is using US funds to pay for abortions in the Third World.

When the government forces an employer to purchase a policy providing services contrary to their beliefs, the employer is being 'forced'.

And how is Obama funding third world abortions?

Policies might cover other services that my employer doesn't agree with, but if I feel I need and want it, and it's relatively cheap, who is that employer to tell me what I can and cannot do as far as my health options? And don't say "find another employer", as I doubt anyone has that luxury in these times.

It should be a basic healthcare right as it is cheaper than pregnancy and a "responsible" choice by most sane standards.

I'm sure there are many other federally mandated issues that companies would love not to follow, but in the interest of good public policy and popular demand, companies cannot be trusted to play fair and provide for those who make them the profitable giants they are.

In Colorado, following state law, they have already been providing insurance that includes birth control to all their employees with no exemptions for church employees. Suddenly this is an issue.

The law does not cover employers who self insure, in which case an 'entity' is not issuing the policy to an employer.

This is such a stupid controversy. It's not about religious institutions' rights. They don't have to pay for it. It's about women's health not being dictated by religious patriarchs. Individual freedom from religion is every bit as important as church freedom from gov't.

Ok, let me spell out the correlation between Jehovah Witness/blood transfusions to Birth Control/pharmacies that don't have to give out the pill if it is against their religion and federal funding for birth control...

One sector's religious beliefs overruling a person's rights. Religious beliefs are a personal choice and should not dictate medicinal choices or a person's right to healthcare.
