Germany Sex Offenders Castration

BERLIN — Germany should do away with the practice of surgical castration of sex offenders, the Council of Europe's anti-torture committee recommended Wednesday, calling the procedure degrading to the convicted criminals.

In a report released in Strasbourg, France, the European Committee for the Prevention of Torture acknowledged that the procedure is voluntary and carried out only under extremely well-controlled circumstances.

Nonetheless, the committee said it still has "fundamental objections," pointing to its "irreversible physical effects."

It urged an end to the practice, saying that "surgical castration of detained sexual offenders could easily be considered as amounting to degrading treatment."

It said no official statistics on castrations are available but, according to information it has collected, "fewer than five per year" were performed in Germany.

The German government said in a written reply that it is "currently being reviewed whether this issue should be discussed in the context of a debate" but doesn't commit to change the regulations.

The German government noted that surgical castration is seen as treatment rather than punishment. It said the procedure is strictly voluntary and the process can only be initiated by the sex offender himself, who must be at least 25.


Among other safeguards, an expert commission must advise the subject, and there is a waiting period between when the decision is made to have the procedure and when it is carried out, so a subject can change his mind.

The government cited a 1997 study of sex offenders who had been castrated, which indicated only a 3 percent recidivism rate. A control group whose petition for castration had been refused or retracted in the same period showed a 46 percent rate of reoffending.

The committee's recommendation came as part of a wider report on Germany, based on a two-week visit at the end of 2010.

Tim Dalton, who led the delegation, told The Associated Press the committee's point is that in any individual case, there is no guarantee the procedure will prevent reoffending.

"It's a highly controversial issue. There are divided opinions on the subject – some justify it on the basis that the results validate the process," he said in a telephone interview from Dublin.

But the panel's "fundamental position is that it's not an appropriate response to the threat of reoffending to mutilate a person, which is in effect what is involved," he said.

In 2009, the committee criticized the Czech Republic for its use of surgical castration.

Other countries have been moving ahead with laws allowing chemical castration for sex offenders, which involves the administration of testosterone-suppressing hormones intended to curb sexual drive.

Russian lawmakers in October gave first-round approval to a bill that would impose chemical castration on repeat sex offenders. Poland legalized the procedure in 2009 for offenders who rape minors or close relatives.

Already, Britain, Denmark and Sweden offer chemical castration drugs to sex offenders on a voluntary basis. In the United States, several states have laws allowing chemical castration.

How could anyone possibly question the effectiveness of castration? Everybody knows that guys who are impotent always stop trying to pick up women.

Yes, we must all be exquisitely qtuned to the senibilities of convicted criminals. It wouldn't do to hurt their feelings after all.

Actually, it was used here for many years, but then was stopped because it is a violation of the 4th amendment. Cruel and unusual punishment.

well it isn't really cruel since surgical procedures more complicated than this are everyday events all over the world.

as for unusual, not if it is widely practiced!

It's my understanding that molesters have no rights as long as the state can claim "treatment". Certainly the federal government keeps them in custody without criminal sentence.

After any prison sentence, California places molesters in treatment that includes frequent aversion therapy sessions. Such therapy is typically life long and custodial. In English that means they are tortured until they die of old age. Money was saved by placing the facility near a natural asbestos deposit where they can get mesothelioma and die young.

California is a dangerous place to commit statutory rape.

This seems to be the will of the vast majority of Americans. While I question what that says about us as a people, we do live in a democracy and it is the will of the people.

Move to California. It is mandatory in California. (Chemical or actual, molester's choice.)

It's still morally wrong, but it is popular.

A better solution would be to segregate child molesters and keep them from children. Since most aren't violent, a minimum security prison/mental health facility would be all that's needed.

Unfortunately the desire to keep them politically isolated causes most states to require that they stay in the communities where they offend. (It wouldn't do to have them forming a voting block.) Better a few children suffer than risk an election loss seems to be the attitude.

The problem lies in their heads not their testicles. A lobotomy would seem more appropriate or lock them up forever. The ability to cure this is questionable and the risks from failure high!

U.S. government would be the last one you'd want to start doing this. It would be abused and used against anyone the government deemed undesirable, not just sex offenders.

What about the permanent emotional and physical scars that are left on the victims??? By not taking avenues to prevent more victims from surfacing later, you are choosing to allow sex offenders to inflict their sickness on others, because they will!!! If castration helps, even a little bit, DO IT!!!

Besides, if it's voluntary, where is the problem?

If the victims suffering is taken into account the proper response is to kill the offender, not main him. Besides it sets up a gender bias as female offenders can't be castrated.

Still I agree that if it's voluntary and part of treatment I can't object. But as punishment, even in the form of reduction in sentencing, it creates a gender bias as well as being inhumane.

I think it should be mandatory and involuntary court mandated punishment for anyone that has raped and killed a child...period. This along with no parole...EVER.

I can appreciate matters of principle. But the fact is sex offenders have the greatest risk of repeat offenses.

The proceedure is voluntary. The alternative is life in prison.
