Conrad Murray Seeks Bail: Michael Jackson's Doctor Requests Release During Appeals Process

LOS ANGELES — A judge who presided over the trial of Michael Jackson's doctor refused Friday to release him on bail, saying he would be a danger to any community where he might try to practice medicine.

Conrad Murray's lawyer asked for his release pending appeal of his involuntary manslaughter conviction, but Superior Court Judge Michael Pastor said he saw little chance that Murray would prevail in getting his case overturned.

Pastor made it clear that his view of Murray had not softened since he gave him a tongue-lashing and the maximum four-year sentence in the superstar's death. He suggested Murray hurt his own chances for freedom in a documentary interview broadcast after the trial saying use of the powerful anesthetic propofol in the home was appropriate.

Jackson died in 2009 of an overdose of the drug that Murray administered in his bedroom as a treatment for insomnia. Expert witnesses testified they never heard of anyone administering the drug outside a hospital.

"I didn't tell Dr. Murray to give an interview for a documentary," the judge said. "When he did, I listened to it and saw it and I was concerned about his attitude toward the use of propofol in the home. ... What he believes scares me."

Pastor also believes Murray, who was born and raised in the Caribbean, would pose a flight risk if he leaves jail. He said the doctor could go to a foreign country that might allow him to practice medicine, and anyone encountering him as a patient would be in danger.

"He was raised in Trinidad and has seven children by five women in different parts of the country, which does not reflect well on his stability," Deputy District Attorney David Walgren argued during the hearing.

Defense attorney J. Michael Flanagan petitioned for Murray to be released on bail, his own recognizance or under house arrest with an electronic ankle bracelet. He and appellate attorney Valerie Wass said Murray should be free during his appeal.

The judge, however, said the defense has not shown there is any substantial legal question likely to result in reversal of the verdict.

"No trial is perfect," the judge said, but nothing cited by Flanagan rises to the level of legal error.

Flanagan and Wass said the appeal issues would include Pastor's refusal to sequester the jury and his decision to allow broadcast of the trial. Pastor said he is confident those rulings and others were legally sound.

He also said he would not reconsider the bail request in the future.

"This is my last statement on this matter," he said.

Under current sentencing guidelines, Murray is likely to serve about half of his four-year term.

Outside court, Flanagan said Murray had lost at least 30 pounds since he went to jail Nov. 7. He said he is held in a single, five-by-eight foot cell with few chances to exercise or go outside.

Murray is considered a high-risk prisoner because of his notoriety.

Wass said she visited Murray and found him in remarkably good spirits.

publicity of it all is more than enough punishment. The Judge is emotional and should keep that out of it. Did Michael die because of Murray's callousness yes but does that amount to criminal negligence no. Nobody benefits from his stay in prison. Not Michael or his family or Dr. Murray himself. Society does not benefit either if the emotion of it is set aside he should be allowed to go about his business the

Conrad is not a danger to society! Conrad should never have been convicted of Jackson's death. Conrad was the scapegoat.

No he isn't a scapegoat. He is partly responsible for Jackson's death. He gave Jackson the lethal dose of drugs. He is a drug dealer. He deserves the time he gets.

yes, micheal was doing drugs..however the reason conrad is in prison is the propofol..it should not have been given outside of a hospital and it was... Simple as that

Dr. Murray is no risk to the public unless someone wants to pay him $150,000/month again. Other than that its been reported that he was a good dr in his private practice.

Elvis, Heath, Michael, Whitney, don't we get it now? Families could've hired kidnappers and forced these people into rehab but it would've never worked. They wanted the drugs and would seek them any kind of way. If they don't want help what is anyone to do?????

Conrad Murray could not have known that Michael Jackson was dosing himself with Demerol, incompatible with Propofol. Jackson was a junkie. He would have died of a drug overdose sooner or later. At least Murray's life was spent trying to do good. One cannot say that about Jackson.

Michael was not dosing himself with demerol, what a ridiculous statement, do some research on "Doctor" Murray, seven kids by five different women, over his head in judgments and debts, would do "anything" for money, obviously; no conscience, no morals, total abdication of his hippocratic oath as a doctor, lied to paramedics, tampered with evidence, failed to alert authorities at the first sign of trouble, as we know Michael could have been saved had this excuse for the "doctor" not failed him.

Why should he be out on bail pending appeal??? He has been convicted! All death row inmates have automatic appeals, so should we consider allowing them to roam free until they complete that process also??/ The judicial system has become a joke, that they would even waste time and money to consider such fodder.

That is why he won't get out. Good points. Favored, you went straight to the bottom line.
People will try anything, jail cannot be an enjoyable experience.
I had a medical procedure two days ago where they used propofol.....I am wiped out. I don't see how anyone could use it on a regular basis and function. The procedure took only a few minutes, but I lost an hour and a half of my day. Of course, I had someone to drive me.....why would anyone prescribe this to sleep?

im sure the doctor did not know that Michael was going to die, this is another injustice again. I'm sure he should have got something, but to do time is horrid. Michael knew what he was taking, they all knew, I mean I'm sure the family knew too, The doctor was getting paid by Michael he didn't intentionally kill him that was money to him, I mean come on really? there are other cases to try that are real. Really?

This is the most ridiculous comment I have ever read about this case. "I'm sure he should have got something, but to do time is horrid"...please tell me what is horrid about Dr. Murray doing time for doing something ILLEGAL? They are both to blame for what happened and M.J. is paying with his life and you think Dr. Murray serving a few years in prison is horrid? Do you even know what horrid means? Dr. Murray should NOT have been giving M.J. propofol. For one thing it is illegal to adminster this medicine outside of a hospital setting, for another thing, Dr. Murray was not an anesthesiologist, therefore he did not know how to properly adminster the drug. That would be like asking a heart surgeon to remove the tumor that's on your brain!!!! All Dr. Murray cared about was getting that paycheck from M.J., so instead of keeping M.J.'s health as his best interest, he gave him a lethal drug that ended up being the cause of his death! That not only breaks the law but also a Dr.'s ethical oath! This is a REAL case that other Dr.'s need to learn from.

I was given propofol two days ago for a medical procedure. My doctor had an anesthesiologist present who administered the drug. It is very powerful, and two days later, I am still wiped out. I don't understand why anyone would use it for sleep.....it puts one into total blackout mode. I lost an hour and a half of the day....the procedure only took a few minutes.
You are right about this doctor's money situation.....wasn't MJ his only patient? That in itself is not good at all. No good doctor would do that. He must have known MJ had a drug problem that may have started with all his surgeries, it appears he did what he was told to do.
The oath starts with "First, do no harm." He deserves to be jailed and his license revoked.

Sure enough, Conrad Murray is no danger to anyone... so long as he's locked up and unable to get his hands on any medications!

I was never a Michael Jackson fan, but he didn't deserve the treatment he received at the hands of a very well paid professional.

Conrad Murray was give a light sentence in my opinion and he needs to try and "man up, suck it up" serve his sentence and then head back to Texas.
