T.J. Lane Charged As Juvenile In Ohio School Shooting

Ohio Shooter Charged

First Posted: 03/ 1/2012 5:25 pm Updated: 03/ 2/2012 8:32 am

A 17-year-old boy was charged with three juvenile counts of aggravated murder on Thursday for the shooting that left three people dead and two more wounded at an Ohio high school earlier this week.

Geauga County prosecutor David Joyce announced the charges against Thomas "T.J." Lane, the accused Chardon High School shooter. Lane allegedly opened fire with a stolen semi-automatic pistol at Chardon High school as students gathered in the cafeteria early Monday morning, MSNBC reported.

Lane is also charged with two counts of attempted aggravated murder and one felony count of assault, according to CBS News.

Prosecutors have already stated that they will attempt to try the boy as an adult, which could result in a life sentence if Lane is found guilty. If Lane is convicted of the juvenile counts, he will face only a few years of detention, the Associated Press reported.

Lane, 18, had pleaded guilty last month to shooting at students in February 2012 at Chardon High School, east of Cleveland. Investigators have said he admitted to the shooting but said he didn't know why he did it. This is said that end up this way. Kid had been gay and grown up with a father image that he had fear of showing his real boy feelings to someone. Being mix feeling had end up bad and could not be acpeted in the family.

WHY does the title of this article say he's being charged as a juvenile? That's very misleading.

If he isn't tried as an adult and put away for life, it will encourage more teens to try to commit these outrages. Showing "remorse" as is claimed, even if true, is way to late. He has the notoriety he was looking for already. God have mercy on his soul. God Bless the families of the murdered teens.

no. it won't. Kids who are damaged will react with irrational violence regardless of how the courts treat them. But unless you are willing to allow kids under 18 to drink, vote, have sex and so on, they should be treated as kids when they commit crimes. They are NOT adults.

It's time for parents to take partial responsibility for these events. Where are TJ's parents and why are they keeping a low profile. There has been no sign of them, no apologies, no responses and no support from the two people who should have been there but weren't for their troubled son. They share in the guilt for being insensitive to his growing depression and for selfishly choosing to turn their backs on a child that was hurting. They need to show up for once and do something positive in this kids life. No more having kids and neglecting them physically, emotionally or spiritually. Be a good parent or DON'T have a kid.

His parents were never married. Both were arrested for domestic violence when they were together. I saw an allegation somewhere that his mother abused alcohol and drugs. His father was arrested numerous times for abusing women. One, not TJ's mom, was beaten as he held her head under water in a washing machine. TJ, his brother and sister lived with their father until five years ago when he moved in with his grandparents. That house remains empty. Former neighbors said that they never saw the kids playing and that there are padlocks on the bedroom doors.

Sounds like a kid who grew up abused, surrounded by violence. I don't know what caused him to snap in the end; hopefully it will come out at the trial. This doesn't sound like a psychopath; there's no history of violence that has been published thus far, other than the altercation with his uncle- in which the report I read stated that he came to the defense of his brother. The descriptions of him by people in the area describe an introverted but bright and kind boy. He pulled the trigger, but there is a lot of blame to go around.

Teens Accused of Shooting Boy Charged as Adults

DETROIT (AP) — Two 15-year-olds accused of critically wounding a 6-year-old boy during an attempted carjacking in Detroit are being charged as adults.
*******************************************************************************
If this killer were Black or Hispanic he would be tried as an adult. The case above is typical when Black and Hispanic juveniles are charged with the loss of life. They get tried as adults.
The parents of the children murdered by this killer, TJ Lane, should insist he be tried as an adult.

Some people have the worst possible lives, I personally know a few who have had lives right out of horror stories, but they never went out and murdered anyone. There is no excuse for murder, period. He should be tried as an adult and receive the punishment any other adult would receive for these crimes.

This is a travesty. The charge should not be aggravated murder and being tried as a juvenile, regardless of whether he is committed to a psychiatric institute or juvenile detention, he will almost certainly be released by his 21st birthday. We might as well say that mass killings at schools are no big deal. Makes no sense at all to me. If he is tried as an adult he doesn't necessarily have to be imprisoned for life or put to death, which I feel he deserves but wouldn't happen anyway for aggravated murder, but at least he can be put away for a more reasonable amount of time than four years. Might as well give him probation.

LIFE IS TOUGH. Nobody EVER said it was easy. EVER. Girlfriends dump you for other guys. You're parents are wacked and you grow up homeless. You get bullied in school because....you're small for your age.....you're a whiner.......your dog had puppies....or you're just plain weird.

NO EXCUSE to murder. PERIOD.

I just read another article on another site that contradicts what the prosecutor said - that Lane didn't know any of the victims and that the shooting was random. That article states that friends of Lane's ex-girl friend told ABC news that the girl was going out with one of the boys Lane killed, Russell, King Jr. In fact, witnesses said that Lane went straight for King that morning.

Those friends also told ABC news that all the students knew one another. The other site has a news clip showing that Lane had an assault charge in 2009 for punching a boy in the face and putting him in a choke hold when Lane was 15; the charges were eventually reduced to "disorderly conduct." So, perhaps, something more should've been done in '09 to help Lane to take his violent tendencies seriously.

If Lane needed psychiatric help, therapy should've been arranged in '09. However, whatever the problem was back then was allowed to fester and as a consequence, three boys are dead in 2012.

Here's what the actual Ohio law says regarding juveniles.
Q: At what age can a child be tried as an adult in Ohio and what is the process?
A: A child, defined as a person under age 18, can be tried as an adult only if the child was age 14 or older at the time of the offense. Nearly all such cases begin in juvenile court with a felony charge. The court must conduct hearings and make certain determinations before the child can be transferred to another court for trial. The process is sometimes referred to as bindover, transfer, waiver, or relinquishment proceedings. In some cases, the child must be tried as an adult. In others, the child can be tried as an adult only if the court orders it.
Q: When is trial as an adult required?
A: Trial as an adult is mandatory in certain very serious cases: (1) when the charge is aggravated murder or murder, and the child is 16 or 17 and has been committed to an Ohio Department of Youth Services (DYS) facility; and (2) when the charge is a certain serious felony offense, and the child is age 16 or 17 and either has previously been committed to a DYS facility or used a firearm while committing the offense. If the court finds that these conditions exist and that there is probable cause to believe that the child committed the offense, the child must stand trial as an adult.

Again folks, these are just the initial charges. To try a juvenile as an adult, there often has to be a separate hearing, basically a competency hearing. If the court determines him to be competent, the prosecutors can re-file to try him as an adult. In this case this hearing is next week and as the article above states, "Prosecutors have already stated that they will attempt to try the boy as an adult".

On the fence in general since I agree about how hopeless these outcast kids might feel, but cannot ignore the 3 dead and others injured. I think it just comes down to the simple fact that he has to be put away for life. Perhaps some treatment, but even if it seems effective, he just needs to go on to regular prison for life. Could anyone deny that once someone has become desperate enough to commit this kind of crime, there is a much greater chance it could happen again? Sometimes, no matter the circumstances, we just cannot let someone who has committed this type of crime to ever be on the streets again.
