BP Oil Spill Claims Process Set Up

March 8 (Reuters) - The man who has paid out billions of dollars to victims of the massive 2010 Gulf of Mexico oil spill has been formally relieved of his duties, and a federal judge has set up a new process to let more people and businesses collect some of their money immediately.

Thursday's order by U.S. District Judge Carl Barbier in New Orleans follows a March 2 agreement in principle for BP Plc to pay claims by a group of plaintiffs estimated to total more than 100,000, at a cost of about $7.8 billion.

The order calls for a new administrator to handle claims from the $20 billion Gulf Coast Claims Facility (GCCF), replacing the lawyer Kenneth Feinberg.

That fund had been set up to compensate fishermen, hotel owners, property owners and others for losses from the April 20, 2010, explosion of the Deepwater Horizon drilling rig and subsequent oil spill.

The disaster killed 11 people and unleashed an estimated 4.9 million barrels of oil into the Gulf of Mexico.

Feinberg, who oversaw a compensation fund for victims of the Sept. 11, 2001, attacks, has received about 1.06 million claims from roughly 574,000 claimants under the GCCF, and paid out about $6.1 billion to roughly 221,000 claimants. He could not immediately be reached for comment.

According to Thursday's order, claimants with final offers from Feinberg can recover 60 percent of their money immediately. If they are deemed eligible under the new program, then they may receive the remaining 40 percent or wait for new awards, which may be higher but take months to determine.

Until the new program is set up, claims will be reviewed during a transition period, and successful claimants can also get 60 percent of their money. Remaining claims would be determined entirely under the new program.

Lawyers on the Plaintiffs' Steering Committee, which negotiated the settlement with BP, have said the new program will be fair and transparent, although some lawyers outside that process have questioned whether it will be an improvement.

"In the new deal, God knows when you're going to get your money," said Daniel Becnel, a Louisiana lawyer who has many clients that have been processing claims through the GCCF. "You don't know what to tell your client."

A spokesman for the PSC declined to comment.

Lynn Greer, a Richmond, Virginia, lawyer, will coordinate claims during the transition period.

Patrick Juneau, a lawyer in Lafayette, Louisiana, will administer claims during that period and would continue in that role under the proposed court-supervised program.

Through March 7, about 41 percent of the $6.1 billion GCCF payout has gone to people and businesses in Florida. Another 29 percent has gone to Louisiana, 16 percent to Alabama, 7 percent to Mississippi, 4 percent to Texas and the remainder elsewhere.

By industry, retail and other services; food, beverages and lodging; and fishing and seafood processing have comprised the bulk of the allowed claims.

BP said it has already paid out more than $8 billion to claimants. It still faces claims by the U.S. Department of Justice, Gulf Coast states, and its drilling partners Transocean Ltd and Halliburton Co over the spill.

Federal claims alone for Clean Water Act and other violations could exceed sums paid to individuals and businesses.

That fund to the "victims" is like the 9/11 responder fund...just a rip off...90% suffered very little and now have hit the jack-pot in this rapacious country where $$$ isn't important, but rather the only thing.

Now I do feel sorry for the birds and other wildlife as well as the lives of fishermen etc. and I'm no fan of BP, but...."The Entire Southern Coast of the United States?" Hell, I live here and the coast looks pretty good to me. I know that oil didn't disappear either, that it's percolating down deep or between layers somewhere but the "entire southern coast?" I can't forget those Aqua Filters either. In fact, I'm actually happily anticipating the upcoming $8 per gallon gas. That should knock some sense into the craniums of O-Stupid voters.

There are risks in anything...but you have to weigh the risk to the potential good that may come of it. Keep in mind here the objective was to reduce our dependence on foreign oil...and without the necessary infrastructure to make "green energy" an economical alternative our reliance on fossil fuels won't diminish anytime soon. Having just returned from the Florida/Alabama Gulf Coast there is no evidence of an oil spill visible. There are pipelines...crude oil, gas, etc. running all over this country with no real threat. Of course the occasional accident happens, as it does with all things regardless of the care taken. But preventing a means to help us become more independent of foreign oil while researching and developing "green energy" to make it more economical it the only prudent thing to do. Oil pipelines run all through the area that Keystone wants to run their pipeline. A website with a map of all the pipelines that run under our feet is attached for your convenience.

Its about time these people get some money to get there fishing boats up and running again. They generate a lot of money changing hands bait , gas , nets , all the food and supplies for the trips. Also the out of towners that spend a couple days at a motel it all means jobs.

I saw that where people that did not even live in the states where it happened filed claims. You always get the scamers. And you know some of them lied on there tax returns and its coming back to bite them.But with all that there is legitimate ones out there.

They are back to fishing on the Gulf and the beaches are open. I just returned from Alabama Gulf Coast and saw no visible damage.

...yeah I wish....I did however change from oil to nat. gas for home heat. drilled my own gas well.on my property. and would love to produce alcohol (legally) to run the farm equp. and vehicles, but the %$#$ govt. makes sure their permits and regs. are so costly and such a hassle it isn't worth it. They're all sleeping together. I'm trying to do my part to get away from big oil. What are you doing about it besides rolling over and taking it in the shorts? (and making stupid comments)

I have a friend who is a travel agent here in Florida. She lost 75% of her businewss due to the oil spill and was turned down by BP for reenbursment. They said she couldn't prove loss of income. Come on BP, didn't you put the gulf coast through enough. it's still screw the little guy, no matter how much you spend in ads saying your with us. You failed to keep your word.

She lost business because the media scared vacationers from going there. I just returned from the Gulf Coast and there was no visible damage. But the pictures the media kept replaying over and over put tourism in danger...but I found nothing but beautiful clean beaches and fresh gulf fish that were plentiful.

But if she lost that much business woudn't it show on her tax returns. Her income from the previoius year would have been much higher. All she has to do is show that to prove she lost money.

Obama got 19.625 billion more than Bush's old oil disaster plan, Under Bush an oil company only had a limited liability up to $375 million dollars Thank you President Obama. The people of New Orleans were so devastated and Bush did nothing but send food to Iraq.. And what sre we going to do with the remaining millions of gallons of oil on the gulf floor.

obama has sent more money and arms to all the countries we have soldiers fighting in. That is not counting all the infrastructures that we gave to Iraq. BP said they would pay more. Obama didn't do it. He put this idiot in to pay people and they ended up with nothing.
