Raymond Van Arnam, New Mexico Divorce Attorney, Caught On Video Breaking Into House (WATCH)

A New Mexico divorce lawyer got to experience the opposite side of the courtroom Tuesday, when he was convicted and sentenced for helping a client break into her ex's home.

Raymond Van Arnam, 60, was sentenced by Otero County Magistrate Judge Gene Galassini to spend 30 days in the Otero County Jail for charges related to kicking in the back door of client Melissa Stonecipher's estranged husband’s home.

Once released from jail, Van Arnam will be required to serve 334 days of supervised probation and must complete 100 hours of community service. Van Arnam was further ordered to pay $5,000 in restitution for damages caused by his crimes and an additional $2,500 in fines.

The charges stemmed from an incident that occurred on Oct. 28, 2011, when the Alamogordo Police Department responded to a 911 call at the home of Anthony Stonecipher. The victim claimed that Stonecipher and Van Arnam were attempting to break into his home.

By the time New Mexico State Police arrived on the scene, Van Arnam and his client were gone but their misdeeds had been captured on surveillance video. When officers reviewed the recordings, they saw Van Arnam attempting to gain access into the home by kicking the front door. At that time, Anthony Stonecipher and a roommate left the residence through a back door and got into a vehicle. Outside surveillance showed Van Arnam confront Stonecipher and attack his vehicle, causing damage to the driver's side window.

During the outside scuffle, Anthony Stonecipher can be heard warning Van Arnam about the cameras, and Van Arnam mocked him. Once Stonecipher left the area, video showed Van Arnam forcibly break in a back door. Video then showed Van Arnam and his client enter the residence and embrace.

"I need a hug ... I need some relaxation," Van Arnam said, according to the Dreamin Demon.

After the embrace, the couple open the front door and invited in Van Arnam's law office staff. Van Arnam instructs everyone to gather particular items of interest and to act quickly because they did not have much time.

The video also captured Van Arnam removing and destroying several "No Trespassing" signs that were posted throughout the residence. Afterwards, Van Arnam and his crew can be seen taking legal paperwork, truckloads of furniture and the family pet.

Authorities quickly learned Van Arnam had no legal authority to enter the residence and remove any property.

At the sentencing hearing Tuesday, Van Arnam claimed he did not have time to get an order from the Court because the incident occurred late on a Friday afternoon. Van Arnam also claimed that "if Stonecipher would have just opened the door, none of this would have happened."

District Attorney Matthew Chandler disagreed.

"This was a home invasion disguised as a legal process. Mr. Van Arnam gathered his crew of employees and his client, pulled up to the house in droves and demanded entry. When he couldn't get in, he intimidated the victim into leaving his own property and then forced his way into the house where he and his posse cleaned this victim out. It was a planned attack against a person and his property, without any legal backing at all, and Van Arnam needs to be punished," Chandler said.

The DA also argued that Van Arnam is now a habitual criminal and said he has two prior felony drug convictions that occurred in Las Cruces. According to KOB.com, Van Arnam was temporarily disbarred for possession of cocaine in 2002.

Per the terms of a previously agreed upon plea agreement, Van Arnam pled to one count of criminal trespassing, one count of criminal damage to property, one count of knowingly removing, tampering with or destroying a "No Trespass" sign, and one count of larceny.

"I would not want to live with what I viewed," Judge Galassini said about the surveillance video evidence. "I believe we're a court of two purposes. One purpose is mercy. The other purpose of this court is justice."

Van Arnam's attorney, Todd Holmes, said he believed his client could have done things better, but he is human and made a mistake, the Associated Press reported.

Melissa Stonecipher also pled guilty on Tuesday to Criminal Damage to Property of a Household Member and was placed on supervised probation for a period of 364 days.

At this time, Van Arnam continues to practice law in New Mexico. He is scheduled to appear in front of the Disciplinary Board later this year.

@nmJohn If this was about getting things for our daughter why vandalize my flag pole and lower my flag? If this was about getting things for our daughter why did Melissa not get a civil standby AS SHE WAS TOLD TO DO AT 1400 BY THE POLICE? If this was about getting things for our daughter why did Raymond VanArnam rip down all the notice that were posted? If this was about getting things for our daughter why did Raymond VanArnam assault my car? If this was about getting things for our daughter why did Melissa plead guilty to the domestic violence charge of criminal damage to property of a house hold member? Why did Raymond VanArnam “a lawyer” plead guilty unless he knew he was guilty and a plea was the only way to serve less time?

The truth is if she had called the police they would have been arrested, lowering my flag was harassment, removing the notices was to avoid criminal prosecution, the assault was all about intimidation. They plead guilty because they are guilty.

Interesting, I just read more from another site. One of the main things taken was baby furniture? So the lawyer and the ex show up to get the baby's things, Stonecipher is ther and ignores the knocks? He would rather be difficult and controlling than give his child the furniture it needs? Sounds like the guy I served with. Why not open the door and allow them to remove the things? Because they never made arrangements? Did Stonecipher not answer his phone, making it impossible for the child to have the items it needs? I can see how a lawyer might get upset with that. Make no mistake, it is still no excuse, but the picture is getting clearer.

Why didn’t I open my door for a stranger who was acting aggressively you ask? Kind of a dumb question. Now if Melissa had show up asking for a few things or that I grab “this and that” and meet her somewhere on my way out things would have been different. I am glad I have the entire day on video so Bozo’s like this guy don’t have a leg to stand on. Anyone who would like to can go on youtube and watch as Melissa carted off station wagon load of her clothes and baby things 12 hours before her lawyer broke down the door. Breaking into my home was more about harassment and intimidation than anything else.

The Albuquerque Journal has the whole video. Including when Van Arnum first walked to the door, calmly knocking while playing on what appeared to be his cellphone. He waits a minute, knocks again before wlking away. He reapproaches agressive after that. Love to know what caused the change.

Birds of a feather do stick to together so I guess you must be getting your information from fellow “Blue Falcons”. I will just let my military record stand for itself. I served honorably and have received an Honorable discharge. My personal file shows a list of honors that speaks for its self however your missing one “this is me myself and i” I received a letter of acclamation from my commander at the 49CS and received a coveted commanders coin.

Finally, something we agree upon. You military career does speak for itself. The one reason the military exists is to go and fight. Your one deployment you were sent home early, leaving your fellow airmen down a man and other airmen to babysit you all the way home. Sounds like the ultimate Blue Falcon action. Like alway,you focus was on you, not those around you. As for you honors, te Air Force has a reg for everything, the Tongue and Quill covers how to write every type of corespondense and never lists a letter of acclamation. It doesn't exist. Enjoy your fantasy world, I am done with this topic.

Imagine a young wife calling Iraq to talk to her husband. Mr. Stonecipher answers, and instead of telling the wife her husband is out repairing some equipment on base, as he was, he thinks it funny to tell her he was hit ot wia mortar. Just one of many true tales of his shortened military career. Trust there is more to this story too. This guy is not the innocent victim.th young wife caImagine

I can't prove what you are saying to be true or not but I can say that anyone who would post such a thing is a Blue Falcon for sure.

This young man was no buddy of mine. You would be hard pressed to find anyone who served with him that would call him a friend. I have a hard time with anyone who treats his fellow airman the way this young man did. If you can't see this, well it says more about you than me. And it is simple why I post this, so this young man doesn't continue to get the sympathy he is begging for; but I am sure you know this because I wouldn't be surprise if you aren't Mr. Stonecipher himself. I wouldn't even know about this if it weren't for it being spread around from people who worked with him. And, my words were probably nicer than any of what the other folks had to say!

Why hasn't this man been permanently disbarred? What kind of Bar Association does New Mexico have. I thought Oklahoma's was pretty bad. One judge didn't get disbarred until after he had completely served his felony conviction. Disbarment should be automatic upon felony conviction. The excuse that he "is human" and "made a mistake" is lame. As an officer of the Court and layer, he should be and needs to be held to a higher standard. As a lawyer he should be fully aware what is legally allowable and the late Friday afternoon excuse doesn't hold up either.

It is weird that an attorney would do this for a common client in a divorce case. The fees he gets are not worth commiting crimes. I think the Mrs and the attorney were having something going on between them so he took it personally.
