Amina Kocer-Bowman Shooting: Jamie Lee Chaffin And Douglas Bauer Plead Not Guilty

Accidental School Shooting
The accidental shooting of eight-year-old Amina Kocer-Bowman led to a juvenille detention hearing for the 9-year-old boy who brought the gun to school.

SEATTLE — A prosecutor said he will try to stretch the law to go after a Bremerton woman and her boyfriend who are accused of having a role in a shooting that critically wounded an 8-year-old girl when the woman's 9-year-old son took a gun to school.

The couple were charged with unlawful possession of a firearm and felony assault for allowing the boy access to the gun, Kitsap County Prosecutor Russ Hauge said.

"It's not been done before, that we know, but we're confident in our research," he said Thursday. "We think the law in Washington is sound – that under the definition of cause that Washington uses, the situation that was created by the mother and boyfriend that allowed the boy to come into possession amounts to them being legally responsible for it."

The boy took the .45-caliber handgun from a car glove box and brought it to Armin Jahr Elementary on Feb. 22 in a backpack, authorities said. It fired when he dropped the backpack on a desk.

The bullet struck Amina Kocer-Bowman, who remains in Harborview Medical Center in Seattle. The little girl was transferred out of the intensive care unit Thursday and is now listed in satisfactory condition, a hospital spokeswoman said. The child has a shattered elbow and serious injuries to internal organs. The bullet is still lodged in muscle near her spine.

Hauge initially charged the boy's mother, Jamie Lee Chaffin, and her boyfriend, Douglas L. Bauer, with unlawful possession of a firearm. Hauge added the third-degree assault charges Tuesday. If convicted of the felony, Chaffin and Bauer could be sentenced to up to five years in prison.

Chaffin, 34, is charged with two counts of unlawful possession of a firearm – one for allegedly having a gun in her home as a convicted felon and the second for allowing her son access to a gun. Bauer, 50, is charged with one count of allowing access.

Chaffin and Bauer both pleaded not guilty Thursday.

Chaffin was arrested during the court appearance and led away in handcuffs. She was being held on $50,000 bail as a convicted felon. She has a history of drug-related offenses, Hauge said.

Bauer has no prior record and was released without bail. Both are due back in court March 21.

Bauer's lawyer, Wayne Fricke, told the judge the assault charge was a "novel application of the law," the Kitsap Sun reported.

It is unusual to bring the unlawful possession charge for enabling access to a weapon, Hauge said, adding that there were at least three other loaded guns in the home.

"It's just one small step removed from them saying, here are the guns lying around the house; here, take one," he said.

The boy was visiting his mother, who does not have custody, when he took the handgun, which belongs to Bauer, authorities said. The boy was reportedly planning on running away and took the gun for protection. He pleaded guilty last week to reckless endangerment and was sentenced to probation and counseling. He is expected to testify in the case against his mother.

The school shooting was the first of three child shootings in three weeks in western Washington.

Last Saturday, the 7-year-old daughter of an off-duty Marysville police officer was accidentally shot and killed when a sibling found the officer's gun as the children were left alone in a van parked near the Stanwood City Hall.

On Wednesday, a 3-year-old accidentally killed himself when he found his father's gun under a car seat after the family had stopped for gas in Tacoma and the parents were out of the car.

Which is essentially what these two (and anyone else who doesn't lock up their firearms) said to the boy when they didn't lock the weapon up.

We have 2 guns in our home (locked up in a safe that is only opened by fingerprint identification), live in the suburbs, and have a small child. Because of this we should not have a gun? Why is that? Also we have a 80 pound Pitbull that is around our child all the time.

We have guns for protection in our home. If your answer to that is "this is why we have police then you are sounding foolish. Someone who would want to hurt you will not be stopped in time for the police to arrive. This is also why we have a Pitbull. If you only know Pitbulls from the news like it sounds you know about guns then you must think we are horrible people. To inform you Pitbulls are very friendly and child safe dogs, but I don't think you would even be able understand this since you get all your information from what is shoved in your face.

To add to this, my partner was with someone that was abusive to her and it was found out after that he was to his former wife. he also broke into his ex-wife's home and beat her to an inch of her life and also the man she was living with. If they had a gun this would not have happened. This is not something that is going to happen to us.

I own a gun, but I keep the dam thing locked up, and my daughter knows what can happen if she should encounter a firearm. When I travel, it's locked in the trunk.

I don't get these folks who feel they can keep kids from being curious, particularly when the parents regularly extoll the virtues of being armed, and leave the macho-maker around for the kids to find....

These irresponsible people noted in the news accounts have NO EXCUSE. They may as well left hand grenades lying around for the kiddies.

IF you're gonna date a convicted felon, best to keep your gun somewhere else, or get rid of it. They will go down for 5 years if it's in thier house at all, regardless of whose name is on the registration.

I was kind of thinking the same thing. I grew up around firearms myself. My father kept his broken down hidden in the basement. It wasn't until I was in the boyscouts and was trying to get the rifle and shotgun merit badge that I learned that he had any. At which point he taught us even more firearm safety. When he eventually purchased pistols he kept them locked up. Why the h*** would you keep a firearm in the glove compartment unless your going to rob a liquor store? This one real big tragedy and I really feel for the kids, both of them. They are the ones who are going to suffer with this for the rest of their lives!

I wonder how many of these people were gun-toting, God-fearin' NRA right-winger types before the loss of a child in a senseless gun tragedy? And how many of them have since rethought their position, possibly from a prison cell?

There was a bumper sticker back in the day: "The only way they'll take my gun is from my cold, dead hands", or something very close to this verbiage. This is the sort of thing imbeciles get loud and proud about. It means "why, you-all will hafta kill me to git my gun".

The bumper sticker should say: "The only way they'll take my gun is from my kid's cold, dead hands" or something like that. Today again a 3 year old shot himself with his dad's conceiled weapon. In what kind of undeveloped country do we live in?

I own guns and have done so my whole life. I wonder how many think of out lawing cars after a senseless accidents that kill someone? Let's out law knives after so many are killed by knives. YES, it's the same thing. if someone WANTS to kill they don't need a gun, history proves me. This parent should get substantial jail time, it's time for all parents to take responsibility for their children.

Besides child-endangerment? What else do you call leaving a loaded gun in a place easily accessible to a child, then to be so negligent as to not notice when said child takes the gun out of the glove compartment and puts it into their book sack?

Tragic. Gun proliferation, which the NRA backs, leads to gun use killings. 30,000 Americans are killed by gun use yearly. Keeping a loaded gun in the glove box is reprehensible.

Unless it can be proven the child did not get the weapon at his mothers home, she's guilty. She's guilty of failing to protect her child and putting his life and the lives of others in mortal jeopardy.

I don’t know if she was doing drugs at this time but I find it horrifying that they have SERVERAL loaded guns in the house lying around! If you own a gun you have responsibilities to make sure the gun is secure. If you fail to do that then you are responsibly.
