So can I draw from this that the liberal wing of the Court is monolithic and unyielding, while the conservative wing is able to consider cases outside of the political framework? Or to put it another way, liberals don't think but conservatives do.

The Liberals need no help they will get help from those Insurance and health care corporations that stand to make a boat load of money from the health care law!

I predicted a long time ago the law will be upheld 7-2 or 6-3,mandates and all.It would be immoral for any justice to deny you and your kids the opportunity to have health insurance while they do.The lawyers representing the administration in their brief all they have to say to Thomas,Robers and Scalia is.

What would you do if you, your wife, partner, your children and grand children were told that they cannot be insured because they have some pre existing condition or some other concocted evil reason for denial of insurance...yes what would you do? So why do you think an ordinary American should accept that denial and live in a state of anxiety and health insecurity.

Health insurance for all is a moral, ethical and necessary right for all Americans,to say otherwise is offensive. As for the mandates it was a long standing position for republicans and conservatives until it was signed into law by President Obama. Now why is that?
I will continue to insist that if the mandates were approved and signed into law by a white president, this matter would not be before the supreme court as we speak and tha's a fact

Personally I think a lot of Republican politicians are privately hoping Obama-care survives its court date. Despite its faults it tries to build on the current system. The real danger I suspect to conservatives would be that health reform fails, and the social safety net provided by medicare and medicaid collapses. Public anger over such an event could result in true socialists that make democrats look conservative being swept into office. Socialists who would replace the health insurance system with a Canadian style public heath care system before moving on to other facets of the US they feel needs social improvement.

or the end of the democrat party as you know because of epic failure.
11:35 PM on 03/16/2012
The democrat party may fall, or the Republican party may fall. But the dynamic will remain the same. There will be those who seek to help people by growing the government and those who believe the people are best served by limiting government as much as possible. And of course both sides will be under the corrupting influence of money and greed.

Obama will blame Bush when the Supreme Court rules the individual mandate is Unconstitutional.
11:58 AM on 03/16/2012
No, he'll blame the conservatives both on the bench and off of it. He'll strike hard on Republicans supporting the right of health insurance companies to dump policies when people get sick. He'll hit conservatives with being shivs for greedy health insurance companies. He'll strike with Republican being unwilling do to anything over increasing premiums and lessening coverage.

In short he'll use it as a club to crush the Republicans in the elections of 2012.

One of things in the obama care bill that I wonder about is, why are they stopping the Doctors from owning any new hospitals or enlarging the ones they presently own. But the Insurance companies can and are buying and building hospitals?

Funny thing about the mandate it makes sure insurance companies will make a very good living off of it, are you sure after the Republican talking heads like Mitt Romney and Newt Gingrich along with those in the Heritage foundation want to see the mandate go away?

Don't have much confidence in the Supreme Court allowing the US to finally get some affordable health care. The court that ruled corporations are people will probably side with the health care for profit corporations, because they're people too.

Hopefully it goes well, we need competition for the health insurance cartel. Health insurance companies are parasites on our society.

The best think that can happen to Obama is that the health care legislation is deemed unconstitutional. If not, it will certainly be the one thing that he will never be able to shake and will sink his legacy!

The individual mandate as used under the Interstate Commerce Clauses will be found constitutional. The case law and precedent are numerous enough that a 6-3,7-2 outcome is highly likely. If they don't, the business law upheavel would be alot worse than Citizen's United is to free speech. I bet Roberts is having nightmares already.

The Supreme's have lost their credibility! They are no better than our worthless congress.
