Robert Bales, Afghan Killing Suspect, Plagued By Money And Job Strife

SEATTLE — With formal charges looming against his client within days, the lawyer for an Army sergeant suspected in the horrific nighttime slaughter of 16 Afghan villagers flew to Kansas and was preparing for his first face-to-face meeting with the 10-year veteran.

John Henry Browne of Seattle said he planned to meet Monday with Army Staff Sgt. Robert Bales, who is being held in an isolated cell at Fort Leavenworth's military prison.

Bales, 38, hasn't been charged in the March 11 shootings, which have endangered relations between the U.S. and Afghanistan and threaten to upend U.S. policy over the decade-old war. But formal charges are expected to be filed within a week and if the case goes to court the trial will be held in the United States, said a legal expert with the U.S. military familiar with the investigation.

That expert said charges were still being decided and that the location for any trial had not yet been determined. If the suspect is brought to trial, it is possible that Afghan witnesses and victims would be flown to the United States to participate, he said.

Military lawyers say once attorneys involved in the initial investigation of an alleged crime involving a service member have what they believe to be a solid understanding of what happened and are satisfied with the evidence collected, they draft charges and present them to a commander. That person then makes a judgment on whether there is probable cause to believe that an offense was committed and that the accused committed it.

That commander then "prefers" the charges to a convening authority, who typically is the commander of the brigade to which the accused is assigned but could be of higher rank.

Bales' defense team said in a statement late Saturday that "it is too early to determine what factors may have played into this incident and the defense team looks forward to reviewing the evidence, examining all of Sergeant Bales' medical and personnel records, and interviewing witnesses."

The lawyers' statement also said Bales' family was "stunned in the face of this tragedy, but they stand behind the man they know as a devoted husband, father and dedicated member of the armed services."

Military officials have said that Bales, after drinking on a southern Afghanistan base, crept away March 11 to two slumbering villages overnight, shooting his victims and setting many of them on fire. Nine of the 16 killed were children and 11 belonged to one family.

Court records and interviews in recent days have revealed that Bales had a string of commendations for good conduct after four tours in Iraq and Afghanistan. But he also faced a number of troubles in recent years: a Florida investment job went sour, his Seattle-area home was condemned as he struggled to make payments on another, and he failed to get a recent promotion.

Legal troubles included charges that he assaulted a girlfriend and, in a hit-and run accident, ran bleeding in military clothes into the woods, court records show. He told police he fell asleep at the wheel and paid a fine to get the charges dismissed, the records show.

Rebecca Steed, spokeswoman at Fort Leavenworth, said Bales would be able to meet with Browne in what is described as a privileged visit. Along with medical visits, such meetings are generally more private than others conducted in the prison.

Browne, 65, has represented clients ranging from serial killer Ted Bundy to Colton Harris-Moore, known as the "Barefoot Bandit." He has said he has handled only three or four military cases. Bales will also have at least one military lawyer.

Tall and stylish, Browne has been a prominent figure in Washington state legal circles since the 1970s, known equally for his zeal in representing his clients and his flair before television cameras.

What a cold, nasty article by Gene Johnson. How about mentioning that this was Sgt Bales' fourth deployment, and he had been promised there would be no more after the third. He didn't want to go; he'd seen a buddy's leg blown off a few days prior to this so-called "slaughter." He was working in an environment where Afghans are simply murdering US soldiers, and there is no fuss about it; indeed some murders have even been kept secret. How would Gene Johnson feel and behave under similar circumstances? What is being asked of the Coalition forces is beyond reason; every single one of them must surely be suffering PTSD by now. Gene Johnson pays more attention to the fame of the lawyer representing Bales than he does to the genuine troubles of the suspect.

Bales had some nerve. Didn't he realize that our drones, and guns, and bombs,under the guidance of our esteeemed leaders are supposed to be killing babies, NOT the individual? He should at least have to do community service.

It was TWO DAYS BEFORE THE SHOOTING, not one, AND BALES DIDN'T SEE THE EXPLOSION, just the aftermath, Browne said."

He was not the star, just a well-regarded young man who seemed to try to do the right thing. That was Robert Bales, “our Bobby,” friends said. He was a busy, popular kid, but he made time for the autistic man down the block. Other neighborhood boys admired him. As a high school linebacker, he was good enough to be captain, but also gracious enough to help a more talented player take over his starting position. It was good for the team, he said.

Bobby Bales has a very selective - and convenient - memory:

"He has some memory of some things that happened that night. He has some memories of before the incident and he has some memories of after the incident. In between, very little," Browne told The Associated Press by telephone from Fort Leavenworth, where Bales is being held."

Yet somehow he remembered to ask for a lawyer upon his triumphant return from the slaughter.

PTSD account for his stealing from the elderly, too?

ccording to the report, the Liebschners, a couple from Columbus, were once Bales' clients. The Norwood native was in the financial services industry for June 1996 to December 2000, so says documents filed with FINRA.

Mrs. Liebschner said that her husband was ill, so she decided to sell some of their stocks through Bales' company to pay for medical fees.
She says that's when Bales started pocketing their money.

By May 2000, the couple filed a complaint against Bales. He joined the military almost a year later. The matter didn't go to arbitration until 2003. Bales was not present at the hearing because he couldn't be located — now we know he was in active military service. The hearing sided with his former clients. According to the disposition details on FINRA's web site, Bales was found to be “engaged in fraud, breach of fiduciary duty, churning, unauthorized trading, and unsuitable investments.”

When all was said and done, he was found personally liable for about $1.5 million in damages. The couple haven't seen a dime, again, because they could never locate Bales.

Breaking...Robert Bales defrauded money from an elderly Ohio couple in 2000. The woman needed to sell stock to pay for her husband's medical expenses and Bales pocketed money from the sales.

He was found liable for damages...1.5 million! A year later he enlisted. Hmm!

Exactly. Just like his assault against a woman, which he was court ordered to complete an anger management course. Reports say he dragged one of his victim's out of a home and banged her head against a wall, repeatedly.

How do you have PTSD when you keep reenlisting. People who are trying to rationalize his behavior should be greatly ashamed of themselves. This guy went into houses and shot innocent little children for goodness sake. He disgraced The US Army, his uniform and his country.

This guy was in the army for over 10 years. As you say, he re-enlisted and re-enlisted. He was a trained, professional sniper in the army. He wasn't baking cakes. He clearly enjoyed killing for a living or he wouldn't have kept going back for more.

I think he slaughtered those civilians because he was pi$$ed off that he and wifey didn't get the cushy deployment to Italy or Germany or Hawaii -- they thought the military "owed" it to them. Probably they also wanted to flee Washington State and their foreclosure and impending bankruptcy.

One can have a mental illness and continue to re-enlist. Perhaps the military should send them through a battery of tests before being deployed over and over. How do you feel about the muslims taking away parents who were flown into buildings for Allah??? Do you think of those children?
