Court Upholds Ban On Texas Immigrant Housing Law

DALLAS -- A federal appeals court Wednesday upheld a lower court ruling that stopped a Dallas suburb's ban on undocumented immigrants seeking housing.

The 5th U.S. Circuit Court of Appeals ruled that Farmers Branch overstepped its authority in 2008 when it passed a law calling on the city's building inspector to check the immigration status of anyone wanting to rent an apartment who wasn't a U.S. citizen.

Under the law, undocumented immigrants would have been barred from rental housing, and landlords who knowingly allowed them to stay could have their rental licenses barred.

The appellate court said the city was seeking to exclude undocumented immigrants, particularly Latinos, under the guise of policing housing.

"Because the sole purpose and effect of this ordinance is to target the presence of illegal aliens within the City of Farmers Branch and to cause their removal, it contravenes the federal government's exclusive authority over the regulation of immigration and the conditions of residence in this country," the court's opinion stated.

The city had appealed the decision of U.S. District Judge Jane J. Boyle, who ruled two years ago that the law is unconstitutional after a lawsuit was filed by apartment owners and tenants.

William Brewer, the lead attorney for the plaintiffs, said he sensed a "strong undercurrent" throughout the appellate court's decision that Farmers Branch was engaged in discrimination. The ruling is particularly meaningful because the 5th Circuit has a reputation for conservatism, he said.

Brewer noted that the ruling affirms Boyle's decision that Farmers Branch must pay the plaintiffs' attorney fees, which before the appeal were nearly $2 million. He called that portion of the decision "a strong deterrent" against other cities seeking to pass similar laws.

"Clearly, both the trial court and the appellate court recognize that this ordinance was discriminatory," Brewer said.

Farmers Branch Mayor Bill Glancy said he will talk with City Council members before deciding whether to push for the matter to be heard by the full appeals court or the U.S. Supreme Court.

Glancy, who took office last year, said he supported the law and other efforts to keep undocumented immigrants out of Farmers Branch, a suburb with nearly 29,000 residents northwest of Dallas.

"Basically, it has discouraged people who are illegal from coming into the city," he said.

Kansas Secretary of State Kris Kobach, a nationwide advocate for tougher illegal immigration laws who participated in the Farmers Branch case, said he was not surprised by Wednesday's ruling. Two of the three judges who heard the case last year indicated they opposed the city's law, Kobach said.

"The case is definitely not over," Kobach said.

Mexico? dont forget the Louisiana Purchase and remember the Alamo... why kick the Mexicans out of their own land and make them get a visa just to return to their homes?

Most people are not against immigrants. They / We are against those who come here illegally and stay for extended periods of time paying no taxes and using our health care i.e. hospitals on the tax payers dime. My statement does not include all nor does is single out Hispanics.

All four of my grandparents came over through Ellis Island and they did it legally. So without immigrants I would not be here. A law is a Law so why do many (not all ) Liberals feel that they have the right to cherry pick which laws to follow and which not to?

You may look at the past as a template to this great country but you can not look at the past as the standard. If we did then we would still have slavery, maybe there would still be a Union and a Confederacy. Maybe women would not have the right to vote.

Illegal immigrants are not legal citizens they do not have the same rights, yet we are constantly protecting under these rights. Why? I am not taking away from the fact they are people and I'm am in no way saying they are lesser people, I am simply stating they are BREAKING THE LAW by being here illegally and why can we as a society not enforce our own laws?

Where were you when the Natives were being slaughtered for their land? so many Human Laws that were broken back then. Whats good for the goose,,,,,, or the pot calling the kettle........ etc etc etc... ,MAY GOD BLESS AMERICA... by the way illegal aliens dont get tax refunds they just add to the coffers, and they dont qualify for health benefits of any kind. they pay out of their pockets,,cash.

Every Country in this world has either conquered or has been conquered through out history. Don't sit here and blame only those in America for doing such atrocities.

Illegals may not get health benefits but if they walk into a hospital they get care. And they do not get turned away because they have no money in their pocket. Tax payers end up paying that bill.

They don't need tax returns, they don't pay taxes.

This land was founded by immigrants in the 1600rds. Pity you didn't come then. But pretty much since then, the land was founded, made to run, and demonstrated democratic government to the world.

In the late 1800reds, just about every government in the world was trying hard to dump their sick and illiterate on us. They wanted to shuck the welfare burden. New story now, and citizens as well as Immigrants want the illegal aliens gone, and the very expensive workers returned to their own country.

Realtor, and businesses with rogue employers, support that ban. But not the people. And if the Federal Government thinks that law is infringing on the Federal Immigration Law, we would like to see an explanation on the matter of how that is.

We won't get it of course. Obama was unable to force his immigration law through, and so, he has found another significant way to foil the intent of our laws. But you have to wonder... what else will we find when he loses the White House.

And/or how about passing some sort of parenting course to have children. I know it would never happen but knowing how to take care of and be responsible for a child really should be a prereq to being allowed to propagate.

Even if you had half the country with local laws like this, the illegally present aliens could just avoid those areas and live in other parts of the U.S. Since housing verification is such an effective deterrent (better than employment verification due to breadth), the obvious way to make housing verification effective is pass it at the national level. That way you deter illegal aliens from living in the country, not just certain parts of it.

The illegal aliens will then gravitate towards the states that roll out the red carpet for them and avoid the states where there will be fewer benefits offered. This way those who feel that illegal aliens make tremendous contributions are free to live among them and those of us who prefer to live with other citizens and people who are in the country legally may do just that. This may not necessarily be a bad thing. At the very least is would be an improvement over what we have now.

Send all the illegal aliens to California. We constantly change the laws to accommodate those that break them. Come to california - we will give you a free education, free food, free health care. Want to drive without a license - no problem. We will make it easy on you to get your car back. No more 30 day impound. That will curtail your ability to get around. 24 hours and you get your car back.. providing you have someone that will come and get you that has a forged drivers license. no insurance.. no problem.. just show the police the proof of insurance from someone else. No need to show ID that has a matching name.

many undocumented are given IRS tax id numbers to pay taxes. This tax is combined with sales, property,and rent. which subsitizes our social security program. the actual law being broken is being in the country undocumented- which is on the same level as urinating in public ( law wise). I know some of you feel more " american" by supporting this "tough guy patriot bs" - but the truth is the majority of republicans are chickenhawks. there are more democrates who actually served. the moronic republicans wrapp theyselves in a flag they avoid defending. i thought self deportation was a myth- due to 10 year bars and detention at all ports of entry- however, why is it that stupid redneck states continue to push it? btw AZ LAW was not drafted for the " benefit of americans" but more so for the benefit of AZ private prisons. 90% of all prisons went private CCA , Gov brewer held stock in these prisons. prisons work like hotels. do the math, and your tax dollars are being channeled for stock holders personal gain. she was caught red handed look it up. btw the war talk - your not "more american; for doing it. put on a uniform and serve.

I'd believe that. Read the article in the Nation about how the private prison companies are informing their shareholders that their profits could drop off if immigration arrested were lower or marijuana was legalized.
