Trayvon Martin Shooting: Attorneys In Case Make Arguments

MIAMI -- Attorneys for the family of Trayvon Martin and the Florida neighborhood watch captain who fatally shot the unarmed teen joined the national chorus of voices calling Saturday for justice in the case.

As demonstrators took to the streets in major cities such as Washington and Chicago to voice outrage over Martin's death, an attorney for the Martin family told board members of the National Association of Black Journalists that federal and local officials have assured the family that the case is a priority.

Meanwhile, an attorney representing the neighborhood watch captain, 28-year-old George Zimmerman, broadly defended his client and said he believes evidence will show that Florida's "Stand Your Ground" law was properly applied.

Zimmerman has not been charged in the Feb. 26 shooting that has ignited racial tensions and raised questions about the Sanford police's handling of the case. Martin was black, and Zimmerman's father is white and his mother is Hispanic.

"Is George a racist? The answer is no, absolutely not. He's not a racist," attorney Craig Sonner said about his client. "The incident that transpired is not racially motivated or a hate crime in any way. It was self-defense."

Sonner said he's spoken with several of Zimmerman's friends, including some who are African-American.

"They only have good things to say about him," Sonner said.

They're reluctant to come forward, though, because they fear that the backlash over the investigation will make them and their families targets, too, Sonner said.

Sonner declined to detail what transpired between Zimmerman and the 17-year-old Martin, but he said he believes the case falls under Florida's stand-your-ground law, which dictates that a person has the right to stand his or her ground and "meet force with force" if attacked.

"I believe what the evidence will show is that this case does fall under that," Sonner said. "I believe we have a good case."

If charges are brought against his client, Zimmerman would be willing to turn himself in to police, Sonner said. "We will follow the law," Sonner said.

Sonner would not say where Zimmerman was.

A spokeswoman for the Maitland mortgage risk-management firm where Zimmerman reportedly works, Digital Risk, said she couldn't confirm anything about Zimmerman's employment, but that he had not been at work since the shooting.

"Our utmost concern is for the safety of our employees, specifically based on the potential turmoil that could arise from the recent announcement of a bounty for his capture," Brandie Young said Saturday.

Amid the outcry over the lack of charges against Zimmerman, the Sanford police chief and state's attorney in the case have both stepped aside.

The U.S. Justice Department has opened a civil rights probe into the shooting, and a grand jury is scheduled to meet April 10 to consider evidence in the case.

Daryl D. Parks, the Martin family attorney, said federal officials and local officials met with the teen's family Thursday and gave them "a strong sense that (the Department of) Justice was very committed" to investigating the case.

"For us to have had all the people who were there with us and the magnitude of the conversation . this is a very high priority for this administration," he said in a wide-ranging interview with the black journalists' group in Boston.

Indeed, President Barack Obama weighed in Friday, calling the shooting a tragedy and saying, "When I think about this boy, I think about my own kids."

But Parks added "it was clear from Justice's statements that charges of a hate crime are going to be a challenge."

Parks also said the Florida Department of Law Enforcement has told the family's legal team that they know Zimmerman's whereabouts, but that it was not clear whether they are offering protection to Zimmerman, who has been in hiding and has received death threats in recent weeks.

Martin's parents also met Friday with the newly-appointed special prosecutor in the case, and the family's legal team plans to pursue a civil case against the Twin Lakes homeowner's association, Parks said.

About 400 people rallied Saturday in downtown Chicago to protest Martin's killing. In a racially divided city beset by shootings, gang violence and run-ins with police, the teen's death brought to mind the 1955 slaying of Emmitt Till, a 14-year-old black boy from Chicago who was shot and bludgeoned to death while visiting Mississippi for supposedly whistling at a white woman. His body was found in the Tallahatchie River.

No one was ever convicted, but Till's killing galvanized the civil rights movement.

"It's a precedent that with the right excuse it's OK to gun down black males," protester Ashten Fizer said of Martin's killing. "It's a return of Jim Crow."

In Washington, a large crowd gathered in Freedom Plaza to call for justice in the shooting.

Among the demonstrators Saturday was Jimmy Neal, a District of Columbia resident who said his daughter has been asking him questions he didn't want to answer.

"She's asked me the question ... `Why, daddy, when he was carrying candy and a soda or iced tea and why did the man kill him?' I had to explain that to her. And those are discussions you don't plan to have with your kids," Neal said.

"Hoodie Marches" were organized Saturday in two South Carolina cities over social media. Many of the people participating carried bags of Skittles and wore hooded sweat shirts, like the one Martin wore when he was killed.

Martin was holding a bag of the candy while walking to his father's fiancée's home from a convenience store when Zimmerman started following him, telling police dispatchers he looked suspicious. At some point, the two got into a fight in the gated community and Zimmerman pulled out his gun.

Meanwhile, authorities say a Florida man is charged with threatening the police chief who temporarily stepped down from the investigation.

The Seminole County Sheriff's Office says John Carnduff Stewart of Melbourne Beach emailed Sanford Police Chief Bill Lee on Friday, saying Lee and his family should be killed. Melbourne Beach is nearly 70 miles south of Sanford.

The sheriff's office says Stewart has sent threatening emails previously, including to Penn State University assistant football coach Mike McQueary.

Stewart was placed on electronic monitoring as a condition of his $10,000 bond.

Feeled like I've been misled by the media the past month.Trayvon didn't deserve to be shot and killed but he was no saint the media and his parents have put him out to be either.Sounds like he admired the gangsta life.Starting to think Zimmerman did act in self defense.

Wether or not Zimmerman is a racist or Hispanic is irrelevant, he acted like a racist and a seventeen year old innocent kid is killed because he was black. Zimmerman claims he acted in self-defense;in case there was a confrontation and someone acted in self defense it had to be Trayvon Martin, now dead, who was terrified because he was being followed like a criminal and 'looked suspicious' only because he was black. Zimmerman would have been arrested right away if he had killed a white kid under the same conditions.

If everything was done correctly and statements are true then the fact a national network like MSNBC is stirring racial tensions it does nothing to help our country. The fact the President of NBC and MSNBC permit Al Sharpton to hold a rally which is covered by Bashir and Ratigan only to be reported from by Sharpton in his normal time slot. The might as well check the journalism ethics handbook at the door to 30 Rock because they clearly have let their emotions cloud their judgment and aren’t reporting both sides of this story. It’s just as bad as Schultz being paid $200k by the AFL-CIO ($100k is verified to have been donated to cancer research/prevention but what about the other half) and reporting hard core for the unions each night and even on-site in Wisconsin with a panel of only pro-union and progressive members.

That isn't the point, the point is so called journalists shouldn't be race baiting. "Journalists" shouldn't be taking $200k from the AFL-CIO and then have 100% of the panel be pro-union and progressive. "Journalists" don't fly to a location to create an event an hour or two before their broadcast and then report on their own event as if it is hard news and they are honest brokers,

So often it is easy to jump to conclusion when you are on the outside and not privy to all of the information. I want justice in this case however; I don’t want a man who may honestly have been protecting himself to go to jail. There are reports of a skirmish, a bloodied nose, and a gash on the back of Zimmerman’s head. These were all corroborated by a third party by the police. One might think this is why Zimmerman has not been arrested. In these situations I think of the Duke Rape case where the stripper (or prostitute) went to the frat house and then accused the lacrosse players of gang raping her. All of them were tried in the court of public opinion; the television commentators had a heyday with them, convicting them on air before they had their day in court and then charges were dropped (rape and eventually kidnapping and sexual offense charges) as we learned the stripper’s story changed more often than a baby’s diaper.

Naturally I’m not saying one who can’t speak for himself is concocting a story. What I’m clearly stating is the national media is convicting a man who hasn’t been tried. Frankly, Attorney General Holder’s Justice Department has said it doesn’t look like there are hate crimes so he won’t be getting involved leaving this to the state of FL whose AG’s office will do an overview of the case to ensure nothing was missed.

Moving west to Philly. African-Americans made up 84% of the murder victims in 2011. From the attached article:

"Responsibility has to be taken by members of the African-American community to address the issues that deal with this particular problem," Gillison said. "African-American males killed by other African-American males is literally the elephant in the room."

Chad Dion Lassiter, president of the Black Men at Penn School of Social Work, agreed: "Some of the black politicians in Philadelphia sit quiet on institutional racism and the black homicide rate. If I was giving them a grade, they'd all be in summer school."

Now, I wonder if Ashten Fizer, from this article, also believes these black men have Jim Crow in their minds as they are perpetrating these violent crimes against members of their own race?

It's rather sad the authors, Kay and Haines opted to harken back to racially motivated murders of 1955 and the era of Jim Crow instead of examining the African-American community as a whole today including the elephant in the room. It appears taboo for reporters to examine why black on black crime explodes year after year, compounding upon itself. Instead, when a Hispanic-Caucasian (trust me, only in this scenario is Caucasian mentioned; if he was a Nobel Peace Prize Winner he would simply be Hispanic because it isn’t cool to be Caucasian but moving on) is man involved in a shooting (self-defense or otherwise), then it becomes a national news story justifying 24-hour coverage, Al Sharpton, Jessie Jackson, NAACP, the New Black Panthers, and even Occupy Wall Street. Yet, an increase of 15% four years ago and then 20% on top of that three years ago and another 31% (NYC) on top of that in 2011.

So who's to say that Trayvon wasn't standing his ground? If some stranger is following you at night as you walk home, are you going to just let him follow you? Lead him right to your house? If Zimmerman had listened to the dispatcher, who told him not to follow, Trayvon would be alive right now. The cops would've questioned him, he might've been a little insulted and peeved but he'd be alive. In short, Zimmeman wouldn't have had to "defend himself" if he had kept his a** at home.

With all the new details coming out, I feel like I have been bamboozled by the media. First of all, they show these innocent and goody two shoes photos of a 9 or 10 year old Trayvon so immediately you feel sorry for him. Second, now it comes out that it could have been most probably Zimmerman calling out for help in the "911" recording, according to his good black friend who defiantly defends him. Then it comes out that this boy was most likely a thief when the cops, according to an online Miami paper, reported finding like 12 pieces of women's jewelry and a screwdriver to probably break into homes was found in his backpack in high school. Who carries that kind of stuff, but a thief. Now Trayvon's mom is trying to trademark his image or name with the patent office. C'mon, a lot of dirt coming out so I don't know what to believe anymore.

Wow, thanks for the link. I wish the media would actually give us the entire story, and if not the entire story at least give us enough for us to know they are inciting racial tensions and trying to play the American people like a puppet so we will go find the real story on our own.
"Call7.wav" is not only a tearjerker but also demonstrates the lady said she heard, “’help me, help me!’ and they were wrestling,” (3:28) before the shot. Finally, the statement released by the department excellently explains so many of the pieces of the story we’ve missed in the media like: Many in the mainstream media (MSNBC & CNN) have asked why Zimmerman hasn’t been arrested? I'm wondering why the media sliced the 911 audio to one small piece that was so damning against Zimmerman? I didn’t even know the call was longer until hearing “call1” here; "call1" & "call7" in full paint a completely different picture. Also, the media claim Zimmerman disobeyed the 911 operator when in fact he simply stated "we don't NEED you to do that," a statement clearing the city of liability should Zimmerman get hurt while following versus a lawful directive. In this lawsuit happy land they say this so should you follow and be hurt the city isn’t responsible. Yet another piece lost on the media.

The (stand your ground) law is completely misguided & the police officers on the scene completely screwed up how they processed the scene & the shooter. I read the FL law in question. I find it a far stretch to apply even this outrageous law to this case. Trayvon Martin was simply walking down the street minding his own business. He was not engaged in unlawful activity. If he were trust we would have heard exactly what he was doing that was seen as unlawful because it goes to justify the shooting. It would also seem by clear cut common sense that if any one in this case was initially in a state of self defence it was Trayvon Martin defending him self from a stranger. Who from what we know by official record first followed him in a car, then exited the car, then pursued him on foot & finally confronted him. There is no doubt in my mind that Trevon popped George Zimmerman in the nose because he felt threatened. I don't believe for a minute that Zimmerman approached Trayvon with the intent to shoot him but the fact of the matter is by his own ignorance he found him self in a state of defense he did not for see. In my opinion he was panicked by the beat down Trayvon was giving him & he fired his weapon. Racial stereo type got the better of Zimmerman & I do believe he should be arrested, processed and

The Sanford Police didn't screw up. This shoddy investigationof Trayvon's murder was done purposely. They hold little value for the lives of black-males. Their history prove this. Just listen to the Sanford community complaints.
