Robert Bales Lawyer: Shooting Suspect Remembered Smell Of Human Bodies, Gunfire

OLYMPIA, Wash. -- The U.S. soldier accused of killing 17 Afghan civilians suffered a traumatic incident during his second tour in Iraq that triggered "tremendous depression," his lawyer said Wednesday.

Lawyer John Henry Browne said he could not discuss the details of the matter because it remains classified. But he expects the issue to become a focal point in the case against Army Staff Sgt. Robert Bales.

"It caused him tremendous depression and anxiety," Browne said.

The lawyer previously said Bales experienced other major dangers in his deployments, including a serious foot injury and head trauma. In addition, a fellow soldier's leg had been blown off days before the Afghanistan massacre, he said.

Bales was charged with 17 counts of premeditated murder and other crimes. He is being held at a U.S. military prison at Fort Leavenworth, Kan.

A defense team is now in Afghanistan to collect evidence and interview other U.S. soldiers who knew Bales.

"Everyone they've spoken to in the military has nothing but amazingly positive things to say about him," said Browne, who is not part of the team in Afghanistan.

Due to security concerns, Browne doesn't think the team will visit the villages where the killings occurred. The investigators are likely to stay in Afghanistan a few more weeks.

Browne questioned the U.S. government's case against Bales, noting there is no preserved crime scene to assess.

"It's going to be a difficult case for the prosecution to prove," Browne said. "There's no `CSI' information. There's no DNA that I know of. There's no ballistics that I know of."

Bales has indicated that he had no recollection of prescription drugs he may have been taking before the shooting – something the attorney took as an indicator of larger memory problems.

The lawyer also said his client has a sketchy memory of the night of the shootings. In a separate interview with The Washington Post, Browne said Wednesday that Bales remembered the smell of gunfire and of human bodies but not much more.

Browne added his client reported suffering from nightmares, flashbacks of war scenes and persistent headaches after his multiple combat tours. Bales told his legal team that he has long woken up with night sweats and often replays memories of a grisly scene in Iraq that he and his infantry company witnessed several years ago, Browne said.

The lawyer stressed that Bales did not confess and seemed surprised when his weapon was taken away, the newspaper reported.

U.S. military officials said Bales was drinking on a southern Afghanistan base on March 11 before creeping away to two villages at night, shooting his victims and setting many of them on fire. Nine were children.

Bales has had incidents involving alcohol and violence in the past.

In 2002, He was arrested for a drunken assault of a security guard at a Tacoma casino. That charge was dismissed after Bales completed 20 hours of anger management training.

In 2008, a couple accused an intoxicated Bales of grabbing a woman's hand and thrusting it toward his crotch before kicking and punching the woman's boyfriend, according to a police report. Prosecutors declined to pursue that case.

Mr. Browne is suggesting the Army is not providing him with the necessary information for his own defence of his client. I don't believe there is any timeline on this revealment of evidence except the stipulation the Army provide all that Browne is requesting before the Preliminary Hearing. Mr. Browne says he does not have access to the witnesses; however, on "Upfront" on CNN yesterday an investigative reporter gave a good account of the attack by one of the boys who was shot. After three weeks, in any case, in a case that won't go to trial for a year or so. I don't understand Mr. Browne's concern. If CNN can interview witnesses, why can't he? He says the Army has a "weak case," but the Army has witnesses having seen Bales leave the compound twice and return twice, the last time "surrendering' to an Army search party and forced to strip down. The Army might be relunctant to give Mr. Browne's "investigative" team access to its own personnel. This I can understand. In any case, the Army seems to hold all the cards, with strong circumstantial evidence. Browne has only the assertions of his client, in prison, in the States. His client is a "jailbird," whilst the Army has personnel at the base upholding their claims, who will take the stand during the trial. The "burden of proof' is upon Browne, not the Army.

Nobody ever said that war was a beautiful thing. The media exposes more of the realities of war in today's time. I'm sure a lot more unthinkable acts like this have happened in previous wars.

i have seen a lot of people wondering why tis guy is getting a trial so quickly, while the fort hood killer hasnt been. i cant say why the fort hood killer(i forget his name) has not been tried yet, but i have a good idea as to why this man is facing trial so quickly. this is a politicaly bad situation. the US is trying to better realtions with the afghans. so when a US soldier goes on a killing spree of afghans, the US has to do something. the obvious answer is to try him quickly and, more than likely, find him guilty to show the afghan people that "we support em'". thus, we gain good feelings from politicians and (at least a small amount) of trust from the people. in theory of course.

just the way i see it. as for Bales, i dont think "PTSD" is a good excuse to kill 17 people in cold blood. but i dont have the condition nor have i been in a war zone, so i wont pretend like i know what it is like. however my grandpa said that he had some pretty bad PTSD after Vietnam and said he never thoguht about killing anyone.

I know many war veterans who have been to Iraq and Afghanistan, and honestly what ssgt Bales is accused of having done, happens quite often. The only reason Bales is put on trial so fast is because the media happened to be there. think of a situation where the same murder(s) occur in a village far from a city or army base, where no media exists. Please remember this when you are analyzing this case.

Let us observe the statistical data from previous wars:

The average combatant during WWII saw approximately 40 days of actual combat.

In Korea, the average was approximately 180 days, but this is difficult to verify.

In Vietnam we saw an average of approximately 240 days of combat per tour. Most of us did one tour; some two, and very rarely three.

Now research is revealing that our troops serving in Iraq and Afghanistan are experiencing over 310 days of combat ( “Day of Combat” is a day that you don’t know if you will live or die that day).

Even "Berserker," a word not in our psychological usage, is a nonsense word being use in part as an adjunct to PTSD as a defense for the insane actions of Bales. Search far and wide for anything that will excuse this man from his admission he was there. He remembers nothing between the times he left the Post and the time he returned, thus admitting that in-between times he quite well remembers the smell of Human bodies and gunpowder! Sort of an implied confession. Browne isn't needed as Defense Attorney to lose this case; it is lost already by Bales loose lips!

Why is there so much uproar over this killing by an American soldier and the Muslim Army Captain that killed all the Americans at Ft. Hood has still not been put on trial ? I guess this is OK as long as it's the infidels that are getting killed and not the killers. Far as I'm concerned the entire country should be put on notice, "We're outta' here, take care of yourselves. Enough double standards. No more American lives wasted for these pigs.

Why does it matter that Hasan was Muslim? I don't see anyone probing into what ethnicity Bales is, or which church he attended.

Sorry for repeating myself here, but again he murdered 9 children, after previous acts of violence against innocent civillians, "involving alcohol and violence in the past."

The guy just snapped. Operating under the guidelines the military sets forth dooms the men and women from the start. Shooting our military people by Afghanis deemed trustworthy outrages anybody. We're now seeking that a governor be tried for killing an Air Force officer and a servicewoman. A governor, no less. This created the feeling in Bales' mind that all Afghanis are the enemy.

This was not out of charactor for him, this is just the first time he has been held accountable. Perhaps if he *had* been held accountable before, it would not have gotten this far.
