Shaima Alawadi, Iraqi Woman Beaten To Death, Might Not Be Hate Crime Victim

Shaima Alawadi

EL CAJON, Calif. — Police investigating the beating death of an Iraqi-American mother of five sought clues at the troubled family's home to try to identify the source of a note that fueled international speculation the killing was a hate crime, according to sealed documents inadvertently released by court staff.

The daughter of 32-year-old victim Shaima Alawadi told reporters after the March 21 attack that she found a note near her mother that told the family to go back where they came from. Her comments sparked international outrage and speculation the attack was motivated by hatred.

According to an 11-page search warrant affidavit obtained by U-T San Diego, detectives did find a handwritten note at the scene, but forensic analysis indicated it was a copy and it was torn. The affidavit did not say what the note said but indicated detectives wanted to search the house for paper stock that could match the type of paper the note was written on.

Authorities also say they are seeking "any handwritten or typed notes that may contain threats or hate-crime related content ... and torn paper that can be compared to the torn paper note collected from the residence."

The documents were inadvertently released Wednesday when court staff misinterpreted which documents were to be sealed, said Karen Dalton, spokeswoman for the San Diego Superior Court.

El Cajon police have said the note indicated the possibility of a hate crime, but investigators have stressed they are exploring other possibilities.

According to the records, a relative of Alawadi said she planned to divorce her husband and move to Texas.

The documents also show the woman's 17-year-old daughter, Fatima Alhimidi, was distraught over her pending arranged marriage to a cousin. In November, the teen jumped from her mother's moving car and possibly broke her arm, the records said.

Alhimidi said, "`I love you, Mom,' opened the vehicle door and jumped out while the vehicle was doing approximately 35 miles per hour," the documents said. "Police were informed by paramedics and hospital staff that Fatima Alhimidi said she was being forced to marry her cousin and did not want to do so, (so) she jumped out of the vehicle."

The teenager was with her mother in the Lakeside home at the time of the March 21 attack. She called 911 after finding Alawadi unconscious.

While police were interviewing Alhimidi after the attack, she received a text message reading, "The detective will find out tell them (can't) talk," according to the search warrant affidavit.

The victim's brother, Hass Alawadi, who moved to Texas from the San Diego area two months ago, told U-T San Diego that he has not drawn any conclusions about who killed his sister or why. His family is waiting for police to complete their investigation, he said.

"I want people to know what really happened," Alawadi told the newspaper. "We hope for the best, hope for it to come out. I hope they found who did it."

No arrests have been made, and El Cajon police have said little about the investigation since a March 26 news conference.

Lt. Mark Coit, a police spokesman, said Thursday the department was not commenting on the ongoing investigation in which the FBI is assisting. But he noted authorities were "not happy" the sealed documents were released.

The family told police a similar note was left at their home weeks before the attack, but they did not keep it or file a report with police.

The teenager told police that on the night of the killing she heard glass break and her mother squeal, but she thought it was a dropped plate. She said she found her mother unconscious 10 minutes later.

Alawadi had suffered at least six blows to the head, possibly caused by a tire iron. She died three days later.

A neighbor reported seeing a man carrying a brown box running from the area of Alawadi's house around the time of the attack.

The victim and her family left Iraq in the early 1990s after a failed Shiite uprising. They lived in Saudi Arabian refugee camps before coming to the U.S., said Imam Husham Al-Husainy of the Karbalaa Islamic Education Center in Dearborn, Mich. Saddam Hussein's troops hanged Alawadi's uncle.

The family arrived in the Detroit area in 1993 and later moved to San Diego. Alawadi was a religious Shiite Muslim who wore a hijab, said Al-Husainy, a family friend. Alawadi's father, Sayed Nabeel Alawadi, is a cleric in Iraq.

The moment is coming where some of us get to say "I told you so!"

I remember a lot of Huffington posters accusing others of religious bias because we felt the evidence, testimony of the daughter, and circumstances were too suspicious of a hate crime. I still think the suspicion lies on the daughter and her boyfriend.
09:34 AM on 04/11/2012
Fact is, most people are murdered by someone they know. The only difference is motive.
10:13 AM on 04/10/2012
A Minor, forced to marry her first cousin.

That is wrong in so many ways.

I will NEVER defend or support Islam; it has no place in the USA. We cherrish our freedom too much and we will never permit Sharia Law here. We do not marry women off to their blood uncles or first cousins, either. At least not legally.
03:22 PM on 04/11/2012
What about the First Amendment and freedom of religion?
09:42 PM on 04/12/2012
Shaira law is not a religion.

This is horrible, I hope they find out who is responsible soon. For those who say that it is permissible in Islam for a husband to kill his wife if she wants a divorce needs a reality check. Also, honor killings are NOT Islamic, they are cultural.
09:49 AM on 04/10/2012
Honor killings might be cultural.
They are definitely Islamic.

Honor killings occur in every Muslim country.Cultures in those countries are different; reliigon is the same - Islam.
10:42 AM on 04/13/2012
Volanj- Not everyone living in the Middle East is Muslim, and regardless of religion, this is a cultural practice.
08:22 AM on 04/16/2012
Honor killings happen every day in the USA. We just don't call it that........but that is what it is when a man kills his wife, girlfriend or ex because she wants her freedom from him.........and he thinks that if he can't have her than nobody can.

I've been following this story and I believe the daughters had something to do with it.

I was there too. It is funny, really. As soon as there was a report of a xenophobic note, all the HuffPo regulars happily said it was a Rush Limbaugh-inspired hate crime. How quick people were to believe something as long as it fit their pre-conceived notions. This is quite similar to the Trayvon Martin case. The media runs in to proclaim the crime GOP-inspired only to look more than a little silly when the facts don't support their absurd claims.
09:49 AM on 04/10/2012
Huff N Puff is very Liberal. Say a single word against Ugly Xian practice and they cheer you on. Just try to talk about ugly Sharia Law and how Muslims believe in Stoning/Beating people to death, and the ignorant come out to froth and foam.

The truth hurts.

Religions that practice intolerance, hatred and suppression are poisons to the entire Planet, be they Christian or Islamic; hatred and violence is hatred and violence and only the ignorant stand up to support such ugliness.

Hope it's not a hate crime - already enough of that going around lately. I have a funny feeling it's someone in the family, the nature of the crime makes it seem pretty "personal".

The VAST majority of hate crimes are simple assaults, minor vandalisms, sometimes a punch in the nose. When you take the time to beat someone to death with a crow bar, the odds are you have pretty stong personal feelings about the victim. Those aren't "random crimes."

In moslems from abroad it is ALWAYS mandatory to first consider it an honor killing. The wife was planning to divorce the husband . Let this be a lesson to all those who bought into the 'hate' crime allegations. Plus the daughter's performance in front of the tv cameras was phony.
11:38 PM on 04/09/2012
"moslems"???!!!

Do you mean Muslims?

Are you saying that it is part of the Muslim religion for a husband to kill his wife if she wants a divorce?

In Islam, if a woman asks for a divorce from her husband, she may get it but she is entitled to take with her ONLY what she brought to the marriage in the form of a dowry. In CA, she is entitled to half of anything her husband has. Which system do you think Shaima was going to use? I think I just stumbled on "motive."

Sharia is Sharia whether it is in Azerbaijan or Zanzibar. Now, there are different Schools of Islamic Jurisprudence, called fiqh, of which there are around five (the Sunnis don't accept the shia schools). Hanbali is the most conservative and Hanafi the most liberal. Saudi Arabia is loudly Hanbali. Albania and Bosnia have always been Hanafi. If a country wants to be secular, they can place a secular on top of Sharia but most Hanbali Muslims refuse to accept any secular law as taking priority over Sharia.

In CA, Sharia has absolutely ZERO legal standing, whether or not Muslims want it to or not. And THAT is the source of the conflict. Under Sharia a woman who demands a divorce from a non-impotent and non-deadbeat husband is entitled to nothing. Under CA law, a women is entitled to half no matter what her husbands earning or reproductive abilities are. This is what sets up a conflict between Muslim women who decide to divorce using infidel courts, rather than Sharia courts, which all find against Muslim men.

I'm glad you are asking questions. Whatever you know about the West, Christianity/Judaism does not apply to Islam. I lived in the Middle East for 2 1/2 years and have a reasonable facility with Arabic. The people there live and breathe religion whereas for us, in the West, it's just something you do on Sundays, Christmas, and Easter. Islam is a whole-package -- economics, criminal law, civil law and literary critique.
09:53 AM on 04/10/2012
Yes, while the ignorant run their keyboards defending Islam, the truth remains; Beatings and Stonings are tenents of Islamic Sharia Law. They practice it, believe in it and they want to bring it to the U.S.

Fat chance of it happening; we have seen them first. ;)

Who ever killed that woman is going to find out the hard way if they are caught that we have laws that prohibit Sharia Lunacy.

i've been reading the back and forth throughout this thread about xtains and mohammadens.

The facts are, and have been shown in studies, that people want to live in peace and not get killed. there are terrorists among all major religious groups but they are not in the majority. an honor killing is not an act of terrorism.

honor killing is not an activity exclusive to the muslim religion. It is not, in fact, a religious-based action at all. in central europe and asia, honor killing is socially correct as well. yet those countries are primarily orthodox xtian.

Honor killing is not a religious practice. it is a social construct that seeks to keep the female of the species under control. It is similar to the kidnapping of women for marriage as well as forced marriages under polyagmy. Honor killing is just the extreme.

If this woman was killed by her husband, the police will figure it out. Don't use this act of a mad person as an excuse to shut down your brain and lash out at the easy target. The republican lawmakers of today are just as ready as any mullah to sacrifice a woman's life for their own ends. and they are most certainly xtians. the war on women is religious. honor killing is a technique.

Honor killing is a specific tenent of Sharia Law- which the majority of Muslims practice.

People need to stop tripping over themselves in their haste to appear P.C. at the rist of being wrong. You need to study the Qu'ran before you defend this religion.

"According to Dr. Shahrzad Mojab, a University of Toronto professor of women’s studies, followers of Hinduism, Islam, Judaism and Christianity have used their religions as a rationale to commit honour killings." there is abundant evidence that honor killings are not religious-based. Honor killing are mainly committed against women but they also include men.

You should do your homework before accusing anyone of defending any religion. Religion is a legitimatized form of slavery which treats women as less than fully human. to attach bad behavior to a single religion relieves other religions of the ignominy of their own practices

We were a minority. I remember getting insulted quite a bit because I said that Neo-Nazis, Klansmen, and general bigots don't usually go around beating women to death. At most, they break your windows, yell something insulting, and run away. This sounding like a family problem from the start to me too.
