Philadelphia Priest Trial: Reverend Thomas Smith's Passion Play Allegedly Used Naked Boy

By MARYCLAIRE DALE 04/17/12 09:18 PM ET AP

James Brennan
The Reverend James Brennan is one of two priests on trial in Philadelphia in a sex abuse scandal that's rocked the archdiocese.

PHILADELPHIA — A Philadelphia jury heard Tuesday about Catholic schoolboys who said they had to strip before a priest and endure whippings as they played Christ in a Passion play.

Prosecutors pursuing a child-endangerment case against a church official said the Rev. Thomas J. Smith remained in ministry despite those 2002 accusations. Church officials and an in-house review board didn't think Smith was seeking sexual gratification when he allegedly had boys undress or get naked with him in a hot tub.

Smith was removed in 2005, after another accuser said Smith had taken several boys to a motel in the late 1970s, put ice down their pants and made them remove their underwear so it would dry. The accuser said he awoke to find a naked Smith rubbing his body against the naked boy.

Smith, now 64, was defrocked in 2007. The Associated Press could not immediately determine his current whereabouts. The Archdiocese of Philadelphia cannot comment because of a gag order imposed in the trial of Monsignor William Lynn.

Lynn, 61, is the first church official in the U.S. charged with child endangerment and conspiracy for allegedly helping the Roman Catholic church cover up the sexual abuse of children by priests. Lynn is fighting the charges, with a defense based largely on his insistence that he took orders from the powerful archbishop, the late Cardinal Anthony Bevilacqua.

Lynn served as secretary for clergy from 1992 to 2004, nearly all of it under Bevilacqua. Lynn's lawyers point out that Lynn had no training – in law, psychiatry, social work or other fields – to tackle the unfolding sex-abuse scandal.

For the most part, Lynn was dealing with old complaints stored in secret files that he reviewed when he arrived at headquarters from the archdiocesan seminary, where he had been dean of students.

But toward the end, more adults like Smith's accusers were coming forward.

Smith had put on the Passion play at several parishes over nine years. He would take the lead actor to a room and have him strip while Smith pinned a loincloth on the boy, several accusers said.

The boys said he then had other children whip them, to the point of pain, during the crucifixion story. Asked by church officials why he had them naked, Smith later said, "for authenticity," while he conceded it was poor judgment.

At least one boy wanted to quit, but his proud, unsuspecting parents wouldn't let him.

It was later clear to at least one regretful father who met with Lynn in 2002 that Smith "likes to look," according to a memo Lynn wrote about the meeting, which was shown in court Tuesday.

Smith by then was a regional church administrator for suburban Delaware County. Cardinal Justin Rigali approved an "educational sabbatical" in 2004, after the loincloth allegations surfaced. But Smith continued living at his Springfield parish for at least another year, until a man came forward to complain about the ice-cube antics.

Smith had been taking several teens on a retreat when his car supposedly broke down in Valley Forge, leading him to bunk with the boys at the hotel, the accuser said. Another priest picked them up the next day. Springfield is about 20 miles from Valley Forge.

Meanwhile, prosecutors told the judge Tuesday they're having trouble getting a West Virginia priest to come testify about Lynn's co-defendant, the Rev. James Brennan. Monsignor Kevin Quirk was a judge at Brennan's church trial on child sex-abuse charges.

Assistant District Attorney Patrick Blessington wants Quirk to testify about statements Brennan allegedly made in the proceeding. He said Quirk initially agreed but had to notify his superior, Bishop Michael Bransfield of the Wheeling-Charleston diocese. The cooperation has since stalled, and court officials in Wheeling have intervened, seeking assurances that Quirk is needed as a material witness, according to Blessington. He said he may need to seek a trial delay if the stalemate continues.

Common Pleas Judge M. Teresa Sarmina agreed to take it up with court officials in Wheeling.

A SIN TO LOOK AT YOUR OWN NAKED BODY !!!

This is too important to be posted as a a reply. A debt of thanks and gratitude to *pageleft*.

Wow! ~Pageleft~ just answered "The $64,000 Question": "....a sin to look at your own naked body..." I had to underscore what ~padeleft~ said with capital letters because of the extreme importance to highlight what was taught to tens of millions of children.

This absurdity in similar myriad forms is the root cause of ALL sexual dysfunction which was foisted onto millions of innocent children. This irrational stupidity created the "Poison Fruit Syndrome."

This is the SOURCE of ALL sexual dysfunction and desperately needs to be called out for the lunacy that it is. Every sex crime that occurs is connected to our weird lunatic notions and attitudes of human sexuality. This is also the basis for “priests sexual abuse of children.

This laughable idiocy has caused immense psychic and physical pain for untold millions of people in the so-called, civilized world. THIS is the foremost reason I stopped being a Catholic.

This is the craziness coupled with the fear of being cast into Hell that has ruined and destroyed so many lives and has made the Roman Catholic Church the single richest entity on our planet.

Time to TAX all religious institutions. Amen.

I vividly remember going to catechism as a child and being told by the nuns it was a sin to look at your own naked body yet church officials found nothing wrong with boys getting naked with priests? Apparently Jerry Sandusky missed his calling.

"...court officials in Wheeling have intervened, seeking assurances that Quirk is needed as a material witness"

This is my hometown and yes, the city is corrupt. The city of Wheeling and the Diocese are in cahoots. There is no logical reason for Wheeling court officials to intervene. Quirk's lawyer should be doing the work instead of the city.

City of Wheeling, you really, really don't want to get involoved in this, but since the town is run by the Diocese, I guess you're in too deep. How horrible and terrible that you seem be condoning the cover up of abuse. This makes me sick.

Thanks for sharing. Just thinking of all kinds of chicanery religions do in the name of Jesus is nauseating. I wonder how many atheists have this as their backdrop, If only people smarten up and tax these pseudo holy ones.

Freedom of religion is one of those rights our forefathers fought for. So, if someone decides to practice that right they may. I DO NOT AGREE that the priests are above the law and they should fry for molesting. The fact that the parents may have been aware of the abuse of stripping naked and of physical harm that maybe we need to do the demeaning actions on the parents. So, denying the freedom of religion isn't the way to go about it.

Freedom of religion requires accountability because every human involved is just as sinful as everyone else. Unfortunately, the parents in Catholiscism are undercut by the belief promoted by the "authorities" in this 'reiligion" in that they are considered in some way holier and closer to God than the "civilians."

Exactly where did you see that I said it was okay to abuse the child? I said they can practice religion. I never said it okay to abuse the kid. If they did this they should be held accountable for their actions..

I never said sexual abuse is okay. Re-read it. I said the people who abused the child she be held accountable. I did say that they have the right to practice the religion they want to.

I have seen many comments regarding the lifting of the celibacy rules, and I agree wholeheartedly. What puzzles me is how anyone can make the logical assumption that this will fix anything regarding the abuse of little boys. I have enjoyed women in all of their splendor my entire life, if my wife left me and I found myself without the "benefits" of her affection, would I begin to desire BOYS?!?! Of COURSE NOT, this is an absurd leap!!!! These men are sick and twisted from the word go and would ONLY find solace in a hellenistic environment propogated by homosexual extremists.

For a while I thought you were going to say something intelligent. Then you went homophobic. What the catholic church is doing is not abou sex, or homosexuality. Allowing them to marry will not stop their sadistic aberrant practices. Those are the acts of abusers who wish to control their vicitms. Rape is not about sexual attraction is is about control and feeding on the pain it causes.

Your reply to me was removed for obvious reasons, @Justin Credible69 - yes the children were raped - adult sex with children cannot be consensual. And again; it is not about sex but about control and sadism feed by the pain and fear of their victims.

IMO, if they lift the celibacy requirement they will stop attracting ped ophiles and start attracting normal men who have adult relationships with women (or men, for that matter,) who have famlies and all the problems that everyone else has. But having said that, it's a pathetic dysfunctional c ult they call rel igion that has brought such a blight on civilization. All are in on the cover up, from the Vat ican on down, so there can never be any trust in that rellligionnn or any other. One can believe in God on their own and do good, they do not need these leeches who don't have a real job. Just look at the wealth and pomp and luxury that the Cath olics in the Va tican live in.....at the expense of the poorest of the poor. It's true of many other religions as well....remember Tammy Fay Baker and that debacle? Absolute power corrupts absolutely.

Concur with most of your post. Lifting the celibacy requirement will do nothing to stop pedophiles because it is not a sexual urge but an aberrant sadistic practice of control that feeds on the pain caused on the victims. You are spot on the rest of your post.

I do not practice any religion! In my opinion, I think religion disturbs too many minds! it's brainwashing! No thank you!

They really need to think about lifting the celibacy thing for priests....I mean hasn't there been enough horror bestowed on little boys? It's too much. So much damage to so many humans over some ridiculous religious belief - it's not making sense.
