Dianne Feinstein Places Hold On Controversial Concealed Weapon Bills

WASHINGTON -- Senator Dianne Feinstein (D-Calif.) on Tuesday placed a hold on two controversial pieces of legislation that would force states that allow the concealed carrying of guns to recognize each other's permits.

Feinstein informed party leadership that she would oppose the quick passage of two concealed carry reciprocity bills that critics argue would cause a "race to the bottom" in terms of concealed weapon law in the United States. The senator cited the shooting of Trayvon Martin, an unarmed teenager killed in Florida, as one of the reasons she was applying the legislative brakes.

"Besides putting domestic violence victims in danger, the concealed carry reciprocity bills would also create potentially life threatening situations for law enforcement officers," Feinstein wrote in a letter to Senate Majority Leader Harry Reid (D-Nev.) and Senate Judiciary Committee Chairman Patrick Leahy (D-Vt.).

"In recent weeks, our nation has witnessed tragic gun violence in Sanford, Florida and in Oakland, California, which is only a short drive from my home. Notably, George Zimmerman, the man who shot and killed 17-year-old Trayvon Martin in Sanford, Florida, had been issued a concealed carry permit under Florida law, even though he had previously been subject to a court order for domestic abuse of his ex-fiancée. Congress should heed the warnings of law enforcement and not force states to recognize the permits issued to individuals by other states."

In putting a hold on both bills, the "National Right-to-Carry Reciprocity Act of 2012," and the "Respecting States' Rights and Concealed Carry Reciprocity Act of 2012," Feinstein is denying them the easiest avenue of passage: unanimous consent.

The hold does not eliminate the possibility of passing the bills through regular order, with 60-vote requirements to start and end debate. But it's unclear whether enough support actually exists in the Senate. Sen. Scott Brown (R-Mass.), for instance, has said he would oppose the first bill, which cleared the House of Representatives in November with 43 Democrats supporting it and only seven Republicans voting against it.

If, in fact, both bills stall in the Senate, it would constitute a rare defeat for the gun rights lobby, which has had a series of legislative wins on both the state and federal level. And for that, Feinstein's hold gave fellow gun control advocates a rare reason to gloat.

"We hear regularly that senators of both parties are getting tired of being ordered around by the gun lobby, and forced reciprocity is exhibit a," emailed Mark Glaze, the director of the group Mayors Against Illegal Guns. "It has nothing to do with the second amendment and everything to do with replacing individual state decisions about public safety with the NRA leadership's wish list."

Interesting how Feinstein apparently believes that sexual discrimination is acceptable by singling out males in as being the only ones capable of committing domestic violence.. I guess based on her letter and opinion; It would be acceptable for a female who has committed domestic violence to obtain a concealed carry permit and travel across state lines to confront her boyfriend... Hmmmm... Close-minded, tunnel vision, and dangerous!!!

Feinstein is a real piece of work. Just wait until after the fall elections...the repubs will take control and get his passed. More people, even democrats, support this legislation...it's a fundamental/basic right.
Almost every state has the same requirements as California; however, most stats are "Shall Issue" states whereas CA is "May Issue". In may issue states, it's very difficult to obtain a CCW.

Feinstein was quoted as saying, "these dangerous bills would allow all people to protect themselves to a fraction of the degree that I enjoy, considering that I not only have my own concealed carry license - a difficult feat where I come from - but also have a security detail, paid for by these same subjects - uh, i mean, people - of trained men with fully automatic weapons. This sort of thing is completely out of the question. If people are allowed to have the ability to effectively protect themselves from rape, murder or robbery, what will they need us for? And who will pay for my security detail?"

When will she and others like her realize that CCW carriers are some of the most safe, law abiding people? Why does she think not having a CCW would stop a person intent on committing a crime from doing such????

Do we (regular citizens) need to wait until AFTER our lives have been put directly in jeopardy to be able to defend ourselves? Is Diane Feinstein's life more valuable than anyone else's?

then the article states is would be hard to get enough votes to pass it so where in here would there ever even be unanimous consent possibility???

She is an idiot anyway bringing up the border crossing abusing boyfriend who will then threaten his ex. And it what world prevents this guy from carrying illegally???

Everyone knows that CA does not like CCWs and maybe this Senator would notice that they have a horrible gun related crime rate....maybe a few CCWs would actually help?

I guess Fienstien wants to make sure women do not have the right to protect themselves where ever they may go.
but the Press has conspired with the radical socialists to make sure Americans are disarmed so they can live safely like a black American can in Chicago. Oh wait that is not so safe now is it. lets try DC, nope, how about Camden? nope.

Think about this, most violent criminals are in favor of strict gun control. Reason being, a safe work enviroment for them. They won't get shot at while robbing, raping, or pillaging.

FYI if you have a Concealed permit you can carry in 47 states in the US. I have mine in Florida and when I travel I can carry it. This Reciprocity bill would make the states that don’t allow you to carry recognize your permit. I know I cannot carry in Illinois, California and New York. In these states it is next to impossible to get a permit to carry.

Incorrect. Florida is only reciprocal with 34 states.

If you are a Florida resident and you travel with a concealed weapon to a state not on this list, you are breaking that state's concealed weapons laws.

In addition, Florida has one of the most extensive reciprocity agreements; not all states are typical. Georgia (of which I am a resident) is only reciprocal with 26 states:

Exactly, Greg. A patchwork system of firearms reciprocity is not a solution any more than a patchwork system of abortion rights or a patchwork system of civil rights. Any right guaranteed by the constitution (or interpretations of it due to modern developments, such as abortion rights) should be protected equally in all 50 states. I don't support any one state attempting to wear away at or infringe upon a person's right to carry any more than I support any one state's right to wear away at a woman's right to privacy and to choose her own health care.

Has anyone ever thought about the possibility that the government commits certain acts to get the populace stirred up in to a fury? People say the attack on the towers was caused by the government, What about small scale acts like the Trayvon martin case? Just a thought.. Maybe it is maybe it isnt...

I love guns, I own 7 and I have had months of training and shooting practice and there should be no reason to have concealed weapons permits. People are impetuous, hot headed and not always capable of making the best decisions and guns with that and its not a great combination.

I am certain that you will be able to justify your opposition to concealed weapons permits by demonstrating that the establishment of "shall-issue" based concealed weapons permit systems universally results in increased rates of violent crime and that a disproportionate representative of violent crime cases are concealed weapons permit holders.  Please do so.

Abstract:
The article examines the frequency of homicides in the large urban areas of Florida, Mississippi and Oregon, before and after their shall issue laws began. On October 1, 1987, Florida adopted a shall issue law that greatly expanded eligibility to carry a concealed weapon. The Mississippi law was similar to the Florida law, except that it did not require firearms safety training. Oregon's law required county sheriffs to provide a concealed handgun license to any qualified adult who had taken a firearms safety course. Shall issue licensing might reduce crime by deterring criminal offenders. On the other hand, shall issue licensing also might raise levels of criminal violence. For all areas except Miami, the study covered the period between January 1973 and December 1992. After developing suitable noise models, intervention models were added to measure changes in homicides following the shall issue law. Firearms homicides increased in four of the five areas in the post-law period. It is worth noting that the levels of each Florida firearms series decreased after the waiting period and background checks began. In each area, there was positive relationship between local homicide patterns and patterns in the nation.
