Shelby County Juvenille Court Racism: Report Finds Memphis African-American Children Treated Unfairly

A review of thousands of juvenile cases in Tennessee's Shelby County Juvenile Court led the U.S. Department of Justice to conclude that African-American children are treated unfairly compared to white children.

(Reuters) - Black youths arrested in Memphis, Tennessee, were much more likely than white juveniles to be jailed and tried as adults, discriminatory practices that also affect Hispanic youths in other cities, the Justice Department said on Thursday.

A review of 66,000 juvenile court cases in Memphis, where numerous abuses drew Justice Department investigators in 2009, revealed "serious and systemic failures" in the way youthful offenders were treated, Assistant U.S. Attorney General Thomas Perez of the Justice Department's Civil Rights Division said.

"We found African-American children treated differently and more harshly," Perez said, summarizing the findings of the department's report in a conference call with reporters.

Black juveniles who were arrested in Memphis and surrounding Shelby County were twice as likely as whites to be detained in jail and twice as likely to be recommended for transfer to adult court, where a conviction generally brings harsher punishment, Perez said.

Juveniles prosecuted as adults are more prone to commit new crimes after release, he said.

In addition to racial and ethnic discrimination, the report said it found other problems in the Memphis and Shelby County juvenile justice system.

The Justice Department said it uncovered failures to protect juvenile suspects from self-incrimination, a pattern of youths arrested without a warrant not getting timely hearings, inadequate protections for detained juveniles who were in danger of harming themselves, and a tendency for jailers to overuse physical restraints on juveniles.

The problems experienced by juveniles in Memphis and Shelby County - which has a population of 928,000, more than half of them black - were singled out by the Justice Department but the area is not alone, Perez said.

Similar problems have arisen in the juvenile justice systems of other cities, especially those with large Hispanic populations, he said.

"The challenges confronting the system in Memphis exist in many communities across America," Perez said.

Perez was encouraged that the local judiciary in Memphis had already begun enacting reforms there. No federal sanctions had been put in place, but he said there still could be steps taken.

Shelby County Juvenile Court Judge Curtis Person, who is heading up the reforms in Memphis, said in a statement in response to the report: "I deplore and will not tolerate discrimination of any kind at the Juvenile Court, whether it is based on race, gender, religion, age or any other factor."

Perez said he was "optimistic we can indeed transform Memphis into a model for the nation ... Our goal is not to fix blame but fix the problem."

"Time is of the essence," he said. "We can't afford to squander any moments here. Liberty is at stake."

I actually really appreciate candour of this blog article. It's pretty much the same situation in the UK; slightly better for girls (who, when they come of age, suddenly become irresistible to most white guys in both urban and rural areas) and slightly worse for guys.
We suffer most from casual racism and dehumanisation by likening our appearance to popular black television stars. This which starts in nursery/primary school in rural areas and high rise urban areas, and is perpetuated by parents and teachers alike who water it down as being merely 'banter'.
Whilst i love children and would love nothing more than a son or daughter I'm worried sick at 24 about how my kids will turn out, hell I'm still not sure if I'm going to be okay.

It is deplorable to think about the state of our society being an inhibiting factor when considering parenting. But if I were to consider my son or daughter going through the same disgusting situations as I had to endure in school I think the decision not the rear kids would be very easy to make. I pray things change. But I'm not holding my breath.

People who make excuses for racist behavior cannot help but write illogical posts. This report is yet another evidence that actually injustice exists. It also exists in the treatment of women, as Rachel Maddow reported in her April 30 show ("Women Get Paid Less than Men for the Same Work"). She discovered that conservatives deny the fact that women are paid less (about 25% less) than men for the same work. This is a fact documented over at least 3 decades by many different authoritative sources. People who cling to denials in the face of solid facts do not help themselves or anyone else. Not surprisingly, the majority of Americans are turning away from such deniers, which is why racists and sexists are becoming more desperate in their rhetoric.

Some people here understand about controlling variables to get at the truth.. Numbers alone say nothing. It depends on the type of crime. How extreme it was. Whether it was gang related. The number of previous offenses. The behavior of the offender, etc. One thing we know for sure is that many young Black kids (especially boys) are growing up without learning responsibility mainly because of a whole culture of absent and irresponsible fathers. That is what we need to solve and it has nothing to do with that old cop out "racism"

My comment will probably upset many but here goes. First of all, the research needs to be conducted based on the same crime. In other words, if a white kid steals a $20 CD, and a black kid stabs someone I would certainly hope the black kid got a harsher punishment. Secondly, you need to take into account the history. If one person has a criminal history and another doesn't, then certainly the one with the history should get a harsher punishment. And Lastly, if the two teens have the exact same crime, exact same history and the exact same judge..... I'm sorry but that judge is going to give a more strict punishment to the teen that is being less respectful. It's kind of the "I will treat you how you treat me" attitude. If a white kids walks into court in a suit and tie and says "yes your honor" etc and a black kids walks in with his baggy pants, a T-shirt and talks disrespectfully to the judge he is going to get a harsher punishment.

This is not news. This starts in kindergarten and follows black males all throughout. In school a black child will ALWAYS be punished more harshly than a white child. It follows them into the criminal justice system, in the county I live, the black children that get busted for pot go to juvenile hall while the white kids go home. A black man will be judged more harshly any where he goes. This is why we still need things like Affirmative Action. The folks that use the race card term are nothing but racists and they just won't acknowledge it. There is good reason for such programs. It has not even been 50 years since the Civil Rights Act. One would think that we could move along a little faster in becoming better human beings. It is unfortunate that having our first president that is black has brought out so much ugly; the overt ugly as of late is just vile.

Some whites continue to ignore or make excuses for an unequal justice system. They have convinced themseles that blacks are just more dangerous and deserve to be racially profiled & given harsher sentences. Maybe it's a way for them to feel better about all the horrible crimes whites have committed throughout history and today. Regardles of the reason it is foolish. In 40 years whites will be the minority in this same unequal system. Since they aren't thinking ahead they will get a dose of their own BS soon enough.

The problem is you're only thinking linearly, you seem to discount any problems with today's black culture and insinuate the violent crime rate of blacks is strictly due to racism. Do you think black parents in general put the same amount of emphasis on education as other races? Even if the parents of a poor black kid in South Philly try to emphasize education he still has to deal with a culture where if he wants to study physics at a university he's made fun of for "acting white". Those obstacles are by far the biggest reason blacks are underrepresented in education and overrepresented in the prisons.

You reinforce my point by continuing to make excuses. I never discounted anything. Problems in the black community are no excuse for blatant racism. Poverty is what leads to most violent crime not having black skin. You seem to think you are an expert in black culture & parenting so I will allow you to wallow in your stereotypes. There are problems in every culture, and I don't pretend to know why. I don't know what white parents are teaching their kids thats leading them to mass shootings and a high rate of drug use. Hopefully they recognize their own issues and are working on them just like the black community. I do know that white kids are using more drugs than black kids and therefore should be getting arrested more for drugs. That would only be fair right? All those non-violent drug offenses keep blacks from financial aid but hey that couldn't possibly have an effect on college attendance right? Atleast in the mind of someone who benefits from that unfairness. Don't count on your false stereotypes being enough to keep the system rigged in your favor.

I can't make an educated conclusion without all the facts. Once again the "race card" has been drawn without all the information. This is what gets everyone in an uproar with unnecessary assumptions.

Hey, we live in an ignorant and corrupt world that believes in the fairytale notion of race. However, to choose to commit crimes, KNOWING the unequal system, they are their own worst enemies. Since this is about black juveniles, let's talk straight. Don't commit crimes, and you can't be unevenly treated for those crimes. There are enough problems for minorities who even try to do right. One must take responsibility and not feed "thug" stereotypes. Stay in school young man, and stay off the streets. It's a vicious cycle, b/c these young cats hardly have any role models, and statistically have few fathers to teach them. But one can play the blame game for all eternity. You know that the system is unequal; stay away from the "gangsta" life brother. It leads to a wasted future and an early trip to the coffin.

This is exactly right. Although, even when there isn't any evidence informing people that there's unequal treatment of blacks/hispanics what have you. Black people will ALWAYS play the race card, always. It's just their automatic response when it shouldn't have to be. They shouldn't be getting themselves into situations where they purposley make them self a target to law and to feel no justice.

Another clueless soul. A black male doesn't have to commit a crime to be assumed a criminal and targeted. Just ask Trayvon. A black man in a suit driving a benz will probably get pulled over more than a black man in a bucket with rims. Why? Because the cops will assume that black man got the benz selling dope rather than getting an education and a good paying job.

Brother, you are the clueless one. No matter what perceptions/prejudices people have towards minorities, education is key. Unfortunately, you have to earn respect sometimes, as it isn't always given freely. Somebody can hate minorities all their life, but when they need a transplant and the best doc around is black, it doesn't matter anymore, does it. When that hypothetical cop needs a lawyer for his raped daughter, and you're the best qualified lawyer for those cases, he HAS to put his prejudices aside, doesn't he. Don't place yourself in a criminal situation and then complain about being treated as a criminal. I can't spell it any more simple than that. Education liberates, brother. With it, prejudice doesn't matter, for those people WILL respect you. BUT, they don't have to respect you if you make yourself a criminal and feed their false notions of superiority. Get it?

Thomas Perez only mentions inequalities in numbers; there is no control for types of crimes committed or special circumstances.

These types of irresponsible comments are typical of the Holder Justice Department and Obama admin.

It also doesn't mention the number of gold grilles, dreadlocks and gang tatoos.
Obviously gold teeth are not illegal and dreadlocks certainly are not. What they represent though is a culture that is in rebellion against the presiding one.
Please don't preach to me about the reason that rap is so violent and why these kids are angry, that is not the point. Angry, mouthy and resisting arrest will not turn out as well for the apprehended as submission and silence. Does this factor in? ? ? I'm guessing it does at times.
Also, this doesn't mention if the percentage of repeat offenders per race. Also could have much to do with this.
I am not in favor of ANYONE being on a path that takes them to prison. I just am AGAINST people spending all of their time trying to find creative ways to justify their shouts of racism. The very people that want to turn EVERYTHING into a race issue, are keeping the anger alive in the hearts of young blacks, by teaching them that the man is against you and you can't succeed in this country.

Exactly, such good points. It's as if they are born and raised to believe that they're living in the 'white mans world'. And that they are incapable of a good education and a life away from crime. Thing is as soon as they are in school they have equal opportunity as any white boy/girl in their classrooms, it's up to them to deter themselves away from crime and following their families footsteps. .

Did you see that overlay where they showed the section 8 people and criminal activity once the housing projects were closed. It was what we call a one to one correspondance. Maybe these guys were already caught and released criminals in the projects and thought they had easy pickings in the suburbs but their record caught up with them.
