Texas Granted Stay By Federal Appeals Judge In Planned Parenthood Case

AUSTIN, Texas — A federal appeals judge stepped into the fight over the Texas Women's Health Program on Tuesday, saying he wanted to hear arguments on whether the state should be prevented from enforcing a law that bans Planned Parenthood from participating in the program.

Less than 24 hours after a federal judge in Austin ordered Texas not to enforce a rule banning clinics associated with abortion providers from receiving state funds, Fifth Circuit Appeals Judge Jerry Smith granted Texas an emergency stay lifting the Austin court's order.

"We are disappointed in the stay granted last night," said Sarah Wheat, interim CEO of Planned Parenthood of Austin Family Planning. "When presented with both sides, the District Court agreed the rule was likely unconstitutional, and that implementation would cause a serious problem with health care access for Texas women."

Stephanie Goodman, spokeswoman for the Texas Department of Health and Human Services said Tuesday that the order allows the agency to exclude the clinics from the program effective today. She said women having trouble locating a health care provider should contact the agency.

In court papers, the state's attorneys argued that the state may ban groups from the Women's Health Program that don't agree with the state's policies.

"Although Planned Parenthood shares some of the program's goals – such as promoting women's health and reducing unwanted pregnancies – it also contravenes the very purpose of the program by actively promoting elective abortion," the attorneys said. "Planned Parenthood and its affiliates have every right to hold that belief and advocate for elective abortion, but they are not entitled to receive taxpayer subsidies from a government program that is designed to encourage preventative birth control and discourage abortion."

Planned Parenthood replied to that argument Tuesday afternoon, saying that the organization and its employees should not have to give up their constitutional rights to free speech and freedom of association to qualify as health providers in a state program.

The emergency stay is the latest development in a dispute over which criteria Texas can impose on a health care provider that participates in state-funded programs for the poor.

When Texas lawmakers renewed the Women's Health Program last year, they made it clear they didn't want any state funding to go to clinics affiliated with abortion providers, even if those clinics don't provide abortions and are legally and financially separate from those that do. The state has already banned organizations that provide elective abortions from receiving state funds.

Earlier this month, Planned Parenthood filed a federal lawsuit saying the rule violates the group's rights. On Monday they celebrated a victory when Judge Lee Yeakel agreed that they had a case and ordered the state not to enforce the law until he could hold a trial.

The $40 million program provides health care to roughly 130,000 women who are poor and don't have health insurance, but would otherwise not qualify for Medicaid, the health insurance program for the poor and disabled. The program provides basic check-ups, contraception and cancer screenings. Planned Parenthood officials say that 97 percent of the services they provide do not involve abortion.

The federal government funded 90 percent of the program, but cut funding last month because officials said the new rule violated federal law.

Texas Attorney General Greg Abbott has filed a federal lawsuit in Washington calling that decision a violation of state's rights. Gov. Rick Perry ordered the state Department of Health and Human Services to find funds to continue the program. Allowing it to end would cost the state more that continuing it because it would lead to a spike in unplanned pregnancies.

I wonder how many of the state's women who are married to conservative men take advantage of these services. Not all conservatives have employer paid health care or can afford to pay for it themselves.

The first issue is hypocrisy, as the right ran against the idea of activist judges.

The claim regarding "slaughter of the unborn" I will avoid belaboring the fact that PPH provides a large range of health care services for women. The issue of the unborn is one which posits a religious view of identity independent of context against one that sees consciousness as a requisite for personhood, therefore something that develops rather than inserted with potential outcomes. Even vonMises, the father of the right-wing economic theory does not consider a fetus a person, and Exodus 21: 22-23 distinguishes the fetus as inequivalent to a person, so there is a range of opinion, even on the right. There is also a range of religious perspectives and philosophical perspectives having equal standing in a country where people get to chose their beliefs and so each decision is best left to the woman and her own conscious. Anyone inclined to impose a certainty in the matter is suspect of simplicity of understanding and ignorance of the principle of religious freedom requiring a tolerance of diversity of opinion. Conceivably one could hold the perspective where the fetus choses to speak to the woman's conscious conveying its wish to be aborted rather than be brought into a world of religious intolerance, ignorance and poverty. Let the women decide for themselves and allow the services to be available for those who think differently than yourself or indeed think at all, in contrast to you.

You can't just put the word "period" at the end of a blanket statement that clearly panders to blind emotion and call that an end-all argument, especially when it doesn't even address the statement you're responding to. That is not effective discussion.

The poster before you didn't even IMPLY that liberal judges haven't done the same. And there are so many caveats to saying that Planned Parenthood "slaughters" the unborn that you willfully ignore. Abortions can save women's lives, and on top of everything else, the bottom line is that t's not YOUR uterus (even though it clearly concerns you what happens in there), so why are you so angry about it? Smoking slaughters people; companies will still pay for the insurance. Men (who are essentially making ALL of these decisions) can get away scot-free for making sexual mistakes, while women, many poor and many with nowhere else to go, are being told that they alone must bear the full consequences of their mistake because people like you have zero empathy for their situations.

What I'm saying is that people like you who make giant, bold statements ending with the word "period" like it creates some kind of undeniable truth and damn-all-the-other-facts-connected-to-this-issue are going to drive this country into the ground.

See the repubs pull out bs rules to claim they have a right to end something like planned parenthood, which they claim advocates for abortion. It does not advocate for abortion. It gives women a choice..noone would say, you should have an abortion...that is ludicrous........but organizations like alec continue to enjoy tax free status....sick country we live in....

Republicans are ending or trying to end Public Television, NPR, Planned Parenthood, A.C.O.R.N., AARP, Medicare, Social Security, Medicaid, Public Unions, Private Unions, Abortion, National Health Care, Public Education, Public Transportation, and everything that an Average American Worker needs to survive.

Republicans are for expanding tax loopholes, military force, police force, Private schools, Private Health Insurance, Private National Parks, Oil and Coal for ALL Fuel, Vouchers for everything, Private owned bottle stores, Casinos, silly television dance shows, and everything that dumbs down or restricts the Average American Worker.

Planned parenthood is a private corporation .I wonder why tax payer is used to subsidize this special private corporation with tax payer money whether profit or nonprofit.Honest liberals cannot answer any honest question but like to subsidize abort fetuses on the expense of all tax payer money.

It's time for Texas and its exceptionalist mentality to leave the union. The PP controversy kind of reminds me of the position taken by southern Christians regarding the Iraq war .... gung ho on the lead in to the war (WMD, Saddam is oppressing his people, etc), but nowhere to be found when they learned the US got it wrong and grievously injured without justified cause the Iraqi people ... oh these Christians will want the abortions to be stopped, but once a saved baby is out of the womb, will these same Christians put their money where the mouths are ? Maybe we should just ask the Iraqi people on that one.

I gave this whole nationalized whole sale war on womens right s to make any decisions for themselves thing. If Texas can single out Planned Parenthood legally without violating any discrimination laws. Does that mean any legislature is free to single out any organization it like for any arbitrary reason and defund them, block their mission or subjugate them? I don't like NASCAR. Can I prohibit their cars from using Texas Funded roads? I am not find of country music. Cna I defund the Grand ole Opry if I hate them? A true american institution, but I don't like them. Can I go after blue grass music? Tractor pulls? State Fairs? You know, I =have never understoof=d why we fund the special olympics. Lets defund them too. Or maybe, we should consider that "liberal phase" the "common good". I can't step dance, but I saw it done in Texas and I can tell you there are some cowboys and Cowgirls out there who make it look like gravity is optional. i dont do it myself. But I can see my tax dollars supporting those who do. I can also see my tax dollars supporting a young lady who just doesn't want to get cancer again or pregnant before she finishes college.

As a Canadian citizen living in the US (yes, I'm thinking of moving back to Canada), I can't for the life of me understand why the Republicans go out of their way to cater to the Rich & go out of their way to undermine the poor in this country, particularly women.

We made the decision to live in the US based on my husband's job at the time (an electrician) -- but 17 years later, it's clear to us that the Republicans are completely out of touch w/realty.

We were young when we made the decision, & did not factor in a housing meltdown or a healthcare crises -- when I moved to the US, I didn't realize that the US didn't have a universal healthcare plan -- I was too young & naive. I thought universal healthcare was a given, like in most civilized countries. Unfortunately, I was wrong & soon learned about PPOs & HMOs, etc.

Interestingly, my condo in Vancouver has done nothing but raise in value, our house outside of Seattle is under water.

Thank goodness I never gave up my Canadian citizenship.

However, there is no constitutional requirement in the USA to provide free healthcare to anyone, female or male.

It amazes me that a sexist argument that women deserve unlimited free healthcare without mentioning healthcare for men goes unchallenged.

I agree w/your constitutional argument .. but all civilized countries provide some healthcare, including Israel & Mexico, to which we provide aide. So are you stating that foreigners are entitled to medicare but American's are not?

As far as healthcare for men, I agree that we should provide prostate care -- which brings me to healthcare for all Americans.

However, what truly bugs me is that the Republicans think that as a country we should ban (even control as employers) women's healthcare issues, while not even addressing men's Viagra issues --

I've never heard of such ridiculous nonsense -- men want Viagra vs. women's need for contraception . . . Has the US really lowered itself to Viagra vs. contraception? You tell me?

Viagra has no medical value, where contraception helps females.

Judge Smith is a joke who has a recent history of abusing his power. Last month he went on a rant against government attorneys because he didn't like the POUTS's comments regarding the possibility that the Supreme Court might overrule Obamacare.
In this case he issued a reversal of an injunction by himself, without the 3-judge panel which is almost always the procedure. He reversed an opinion by the trial court judge that had taken weeks to craft, and was 24 pages long, two hours after it was handed down. He did not give a reason, and probably had not even read the opinion.
Smith is an extreme ideologue, and should be impeached. How much more of this do decent people have to take?

I was wondering who this judge is - you are absolutely right that this is a very backwards decision. Any responsible judge would keep the status quo and make sure that women continued to receive health care. I had no idea this was the same judge that was giving the attorney general a hard time.
