Medicare Fraud Crackdown: 100 Doctors, Nurses, Social Workers Charged In Historic Bust

MIAMI -- Federal authorities charged 107 doctors, nurses and social workers in seven cities with Medicare fraud Wednesday in a nationwide crackdown on unrelated scams that allegedly billed the taxpayer-funded program of $452 million – the highest dollar amount in a single Medicare bust in U.S. history.

It was the latest in a string of major arrests in the past two years as authorities have targeted fraud that's believed to cost the government between $60 billion and $90 billion each year. Stopping Medicare's budget from hemorrhaging that money will be key to paying for President Barack Obama's health care overhaul.

Health and Human Services Secretary Kathleen Sebelius and Attorney General Eric Holder partnered in 2009 to increase enforcement by allocating more money and staff and creating strike forces in fraud hot spots.

On Wednesday, hundreds of federal agents fanned out around the country, raiding businesses, seizing documents and charging 107 suspects in Miami, Los Angeles, Houston, Detroit, Chicago, Tampa, Fla., and Baton Rouge, La. The government suspended payment to 52 providers as part of the investigations.

"When President Obama took office he asked Attorney General Holder and me to make fraud prevention a cabinet-level priority," Sebelius said in remarks prepared for a news conference in Washington.

Among those arrested Wednesday were the owners of two community mental health centers in Baton Rouge, charged with billing $225 million in their scams. Hoor Naz Jafri and Roslyn Dogan allegedly recruited vulnerable patients, including elderly people, drug addicts and the mentally ill. Patient charts were doctored to show services that were billed to Medicare but often never given, according to an indictment.

Authorities suspended their companies in May 2011, but the pair continued billing Medicare after purchasing another fraudulent company, according to the indictment. When feds shut down that company, the pair tried to sell their "beneficiaries" to other providers in an attempt to keep making money.

During the investigation, federal authorities tried to put a hold on the company's bank account. Dogan asked to visit the U.S. Attorney's Office to review and copy documents that had been seized as part of a search. After the visit, "Dogan and co-conspirators bragged that, while pretending to copy files, they actually stole incriminating documents from the files and later destroyed them." Dogan referred to herself as a "smooth criminal," according to the indictment.

Another co-conspirator bragged to Dogan and others that he had a "bonfire with fabricated notes that law enforcement officers had failed to seize during the search," according to the indictment.

They could face life in prison if convicted. A woman who answered the phone at one of the companies hung up and an email to the company was not immediately returned.

Five others were charged in connection with the Baton Rouge scam, capping a six-year investigation.

"The results we are announcing today are at the heart of an administration-wide commitment to protecting American taxpayers from health care fraud," said Attorney General Eric Holder. "We are determined to bring to justice those who violate our laws and defraud the Medicare program for personal gain.

More than 50 defendants were also arrested in Miami in unrelated scams totaling $136 million involving community mental health centers and home health care agencies. A handful of those arrested also had criminal backgrounds, according to federal agents.

Community mental health centers are the latest trend in Medicare fraud, which has developed more complex schemes over the years, moving from medical equipment and HIV infusion fraud to ambulance scams, as crooks try to stay one step ahead of authorities. The scams have also grown more sophisticated using patient recruiters who are paid kickbacks for recruiting patients, while doctors, nurses and company owners coordinate to make it appear they are delivering medical services which they are not.

"Medicare fraud also exposes some of our most vulnerable citizens to identity theft, and, in some cases, endangers patients' lives," said Gary Cantrell, Deputy Inspector General for Investigations for HHS. "The indictments announced today demonstrate that we're fighting back."

Wednesday's arrests come as top lawmakers appealed to health care professionals in the private sector to help combat Medicare fraud. Six members of the Senate Finance Committee, led by Ranking Member Orrin Hatch (R-Utah) and Chairman Max Baucus (D-Mont.), announced a bipartisan effort to begin soliciting ideas from interested stakeholders in the health care community looking for a fresh perspective and potentially solutions that may have been overlooked.

"To date, numerous efforts have been made to reduce fraud, yielding a mixed record of successes and failures," according to the letter.

Sebelius said her agency and the Justice Department have more than quadrupled the number of strike teams around the country, charging hundreds of individuals with Medicare fraud.

Medicare fraud has been a hot button issue as federal officials have repeatedly come under fire for seemingly staying one step behind the criminals, using outdated technology and not coordinating efficiently with law enforcement.

But Sebelius touted a new data system that will allow authorities to spot trends in billing patterns more quickly, which will ideally stop payments before they go out the door.

The Centers for Medicare and Medicaid Services launched a $77 million computer system last summer to serve that purpose, but the program has yielded few results in the early stages and drawn criticism from the Senate Finance Committee.

Watch the video at the end knowing every state abuses our children to gain access to our social security fund and feeds the judicial system to get away with it. FRAUD IS FRAUD and every state is guilty! Foster care and adoption funding must stop paying states to remove and adopt children away from their families. Innocent families are being decimated and abused children intentionally left in danger for the sole purpose of further reports increasing funds. The system is out of control and not accountable to anyone! Save seven trillion dollars and our children's lives. Do away with the system and make child abuse laws tougher!

As long as we continue to de-regulate these greedy criminals will continue to scam the system! There must be oversight and regulations in every segment of our society! You even have corruption within the US Immigration and Custom Service where an Inttelegence Supervisor and other co-workers were scamming the government to a tune of hundreds of thousands of dollars by forging hotel and traveling vouchers! If you have cops stealing can't you imagine what's going on else where?

Under GW Bush, his administration cut the number of people and dollars for enforcing Medicare rules to 96,000 member doctors or medical services who provide services to over 40,000,000 Medicare consumers. As noted above, President Obama increased the number of enforcers, the enforcement budget, the communications between Health and Human Services and Department of Justice AND, he gave them a mandate to disappear this white collar fraud and crime.

It's interesting that Republicans used to be the voice of Tough on Crime, as they were once the voice of responsible spending --- not just before Bush II, but before Reagan. Since then, they have created the massive deficits of Bush II AND this white collar crime spree,... until today, they are loud and vociferous about talking and talking and talking their talk, but their Bush Years make them untrustworthy and incompetent to walk the walk. And it takes a Democrat --President Obama -- to walk the walk that they shoulda walked instead of straying into Karl Rove's and Frank Luntz"s economics and empty promises.

Well said. Obama's response to medicare fraud has been to increase the monitoring and policing of fraud and make sure people in need are getting the services being paid for.

The neocon approach to reducing fraud is to cut the medicare budget and hurt the people already being victimized.

The coordinated takedown in seven cities by the Department of Justice and the Department of Health and Human Services' Medicare Fraud Strike Force as the largest in its history, authorities said. Miami was the first "Strike Force" city in the county in 2007.

Most private insurers don't process that many claims annually.

Probably better to use this as a percentage comparison.

As in, this fraud represents less than 1% of total medicare expenditures in 2011.

Fraud in the industry in general is thought to be well over 1%.

If the computer program was a failure how did they identify all those people? That doesn't make sense. What else doesn't make sense is that the fraud has continued for years which falls on the committee that oversees Medicare. Every congressman/woman is assigned to a committee, to oversee what they are doing and what the costs are, so what the heck have they been doing? Nothing apparently, until Obama made it a priority. They should be fined for the same amount they defrauded and all their possessions sold to pay the fine and should be handed sentences that will make others weary of trying the same fraud.

With all the fraud happening in the United States right now, it's no surprise that other countries are watching us, the former "leading nation of the free world", swimming around in our own fecal matter without a lifeboat to save us.

I mean, look at us. We're in monstrous debt to China that will probably NEVER be paid back, resulting in default. We don't export much anymore: all of our corporations have sold us out and hire overseas, resulting in cheaply-made goods that contain lead or other poisonous chemicals. Food has reached astronomical rates because it's being imported, rather than using the land Mother Earth has provided for us RIGHT HERE. The cost of insurance has driven us back to the days of the monarchy, where only those with money (1%) can afford the necessities of life and everyone else (99%) are tossed scraps to fight over. Illegals of all nationalities hop on the gravy train and feign poverty so they can get all the free money/food/housing they can. WHAT HAPPENED TO THIS COUNTRY????????

Kudos to the Health and Human Services Secretary and the Attorney General for their efforts.
Business and individual ethics have been on the decline in this country since the eighties when Reagan came up with the notion that government needs to stay out of our lives. I will never understand why so many Americans do not understand that "stealing " from the government equates to stealing from every citizen. How can someone call themselves patriotic if they knowingly defraud the government; fail to pay taxes; utilize tax loopholes to avoid paying their fair share; or hide assets in overseas accounts? Perhaps the loss of citizenship should be considered as a consequence for those citizens who have willfully participated in such actions associated with cumulative sums in the amount of $25,000 or more.

The big picture is that I unlike you, hold individuals for their unethical behavior. I don't view the government as a scapegoat for all that is wrong. I would rather expend energy on improving systems and focusing on positives.

All that link shows is that the investigations have been growing and more pressure has been piled on since then.

It in no way even begins to take away from this news. If anything, it shows that fraud is so systemic when it comes to private companies trying to screw taxpayers that people are no longer surprised by it.

Yeah, I'm not surprised that private companies take advantage of taxpayers at every single opportunity.
