FCC Head Julius Genachowski Blasts AT&T

NEW ORLEANS/WASHINGTON (Reuters) - The top U.S. communications regulator on Tuesday defended his opposition to AT&T Inc's failed bid for T-Mobile USA last year and fired back at claims that the decision caused price increases for the wireless carrier's customers and more inefficient use of wireless spectrum.

Federal Communications Commission Chairman Julius Genachowski blasted AT&T for suggesting that U.S. regulators worsened the spectrum crunch or prompted higher prices, during a keynote speech at the CTIA annual wireless industry conference in New Orleans.

The U.S. Justice Department and FCC both challenged late last year AT&T's attempt to add capacity to its network through a $39 billion plan to buy smaller rival T-Mobile USA from Deutsche Telekom.

The government said the deal would reduce competition and lead to higher wireless prices for consumers and businesses.

AT&T gave up its bid in December, but its chief executive, Randall Stephenson, has repeatedly sharply criticized the FCC after the decision.

"Some have recently argued that the government's review of transactions in the wireless space - or, let's be frank, review of one specific transaction - is somehow causing a shortage of spectrum and leading that company to raise prices for consumers," Genachowski said. "The overall amount of spectrum has not changed."

He also lashed out at the notion that the country's spectrum could be used more efficiently if the market had fewer bigger competitors who could invest more in their networks.

"The notion that competition drives spectrum inefficiency is at odds with our history of mobile," Genachowski said.

Instead Genachowski said that operators should look for ways to manage their networks more efficiently to get more out of the spectrum they own while the FCC works on making more spectrum available.

AT&T countered by referencing Genachowski's statements at last year's CTIA conference, where he said consumers would face higher prices if the market were forced to respond to supply and demand.

"The FCC was within its rights to withhold its approval. But it is incorrect when it denies the impact such decisions have on the price of wireless services," Jim Cicconi, AT&T's chief lobbyist, said in a statement on Tuesday.

NETWORK CAPACITY

Genachowski also said on Tuesday that the telecoms regulator will move ahead with tests for sharing spectrum between the government and commercial wireless operators.

The move is one element in a bigger FCC plan to increase capacity for rapidly expanding consumer demand for mobile data services, Genachowski said.

In 2010, the administration said it would make 500 megahertz of spectrum available in the next 10 years.

The growing use of wireless devices like Apple Inc's iPad tablet and Google Inc's suite of Android-powered smartphones has added to the urgency to find more airwaves.

Spectrum is expected to be a major topic at the show among wireless operators.

Genachowski said the FCC is ready to work with the National Telecommunications and Information Administration (NTIA), which manages government spectrum, on the tests aimed at discovering whether it is feasible for government users to share the same spectrum with commercial wireless operators.

NTIA proposed in March giving wireless companies access to another 95 megahertz of spectrum - almost 20 percent of the target set by the Obama administration - by relocating some federal systems and allowing others to share spectrum with commercial operators.

The agency said sharing would be necessary as the proceeds from an auction of that spectrum band might not exceed the cost of relocating government operations and could take more than a decade.

NTIA said it will begin convening discussions between industry and federal agencies at the end of the month to sort out concerns over their spectrum sharing proposal.

Of course their Lobbyist is gonna say that - that's why he's paid. If you've sided with AT&T on this issue how do you defend that choice? AT&T has been gouging customers for decades. How much did Randall Stephenson make last year while 10's of thousands support agents barely make a living wage, have been slighted of benefits during hi profit years... come on - take a look at this company. Pure hustle at the cost of customers and employees...

We were rid of ATT and they came back on us (Bellsouth Customers). They are gouging the daylights out of us again. They charge you $2.00 if you press "O" on your phone for the operator and $1.79 if you dial 411 for information. Plus a five dollar late fee if you forget to pay your bill.
How can they do this ?...Al-

Just got a notice on my last AT& T bill my home line is going up AGAIN. Every month my
payment is different and so many added taxes that half my bill is taxes! Plus have their internet service but don't have their long distance through them and my bill is over a $100.00 dollars a month! I'm switching to magic jack services! Found some of my friends have same service and their monthly bills are all different! Had my cell phone with them and had billing problems so quit them. Had problems with charges on long distance and stopped getting long distance service with them. Found out AT & T hires another long distance billing company called AMDOCS a billing company located in another country, to do their billing! NO SCRUPLES....and rip off customers. They have more customer complaints than any other telecommunications company! Glad the FCC finally saw the light! More state Public Service Communications need to get AT&T to shape up and start fining them for their lousy service!

So ATT increased prices because theyre greedy and then blamed it on the FCC in order to try and push away some slack. FCC officials arent elected... so public opinion isnt exactly a very powerful weapon in this case.

And FWIW:
There is no shortage on airwaves. This is pretty evident. The shortage is on the company and the cash they maintain for infrastructure growth and maintenance. This is why its like having to "Keep up with the Jones'" when it comes to mobile devices and the features they offer. Thats why all the propaganda about 3G/4G differences and how it would take so much longer to get the same message if you were on the 3G and not the 4G? Give me a break!! They do this so that all you simple minds thinking you need to upgrade your phone and your service when you purchase that new phone will continue to pay more and more because your being conditioned to think that paying $100/month for cellular is justified. Well, its not. Considering, that typical landlines cost on avg. around $24-32/month and yet we continue to pay this outlandish fee(s). Get real, you're only paying for them to improve their infrastructure, not your plan, nor your service reliability. Notice, this didn't start happening until Apple decided to allow other carriers to offer the Iphone as a product offering and stripping AT&T of its SOLE base for offering the device. Again, greed kills and they want to cry about it...

I worked for AT&T for over thirty years and they are without a doubt one of the biggest bad guys on the corporate block Randall sits on the board of ALEC they have been caught suppressing technology and cheating their customers. UP until the merger they have gotten pretty much whatever they have wanted i am hoping that this will set a trend of regulators doing their jobs and going after companies like AT&T....

I spent two years in the retail side and when Is aw the proposed merger I knew in my gut it wouldnt happen and that the costs when it would fail would be born by the customers and by the employees ( meaning pay plans/commission plans get bumped down, quotas raised to keep from paying out commissions to help offset it). Dont beleive th hype, the have alot of unused spectrum that they are haording and not releasing but claim to be in a crunch, Just the other day or buddy Ralph De La Vega says unlimited data a mistake.

In the end its not the FCC at fault here, it was ATT trying to squeeze out a competitor and they signed a deal with steep peanlties if it failed to pass. They got cocky and over-confident so personally I am glad they are feeling the pinch. It also reflects in the lack of new cell service for them and increased churn, the bulk of their last reported quater of new adds where tablets etc whose long term viability has yet to be proven and have higher deactivation rates.
