Joe Arpaio Faces Justice Department Lawsuit Over Allegations Of Civil Rights Violations

PHOENIX — Federal authorities sued America's self-proclaimed toughest sheriff Thursday, a rare step after months of negotiations failed to yield an agreement to settle allegations that his department racially profiled Latinos in his trademark immigration patrols.

The U.S. Department of Justice officials said the agency filed a lawsuit only once before in the 18-year history of its police reform work. The lawsuit escalates the standoff with Sheriff Joe Arpaio and puts the dispute on track to be decided by a federal judge.

"We have invariably been able to work collaboratively with law enforcement agencies to build better departments and safer communities," said Assistant U.S. Attorney General Thomas Perez, who heads the DOJ's civil rights division, at a news conference.

Arpaio and the Maricopa County sheriff's office "have been a glaring exception," Perez said.

The DOJ first leveled the allegations against Arpaio in December, saying that a culture of disregard for basic constitutional rights prevailed at the sheriff's office, which covers metro Phoenix. Federal officials held off on filing a lawsuit as they tried to reach a settlement, but talks broke off last month.

At the time, Arpaio refused to agree to a court-appointed monitor who would help enforce a settlement. Arpaio said it would mean every policy decision would have to be cleared through an observer and would nullify his authority.

At a news conference Wednesday, after DOJ officials notified him of their intent to sue, Arpaio defended himself.

"If they sue, we'll go to court," he said. "And then we'll find out the real story. They're telling me how to run my organization. I'd like to get this resolved, but I'm not going to give up my authority to the federal government. It's as simple as that."

Arpaio's office is also accused of punishing Hispanic jail inmates for speaking Spanish and launching some patrols based on complaints about dark-skinned people congregating in a given area or speaking Spanish. A crime was never reported.

The DOJ has been seeking an agreement requiring Arpaio's office to train officers in how to make constitutional traffic stops, collect data on people arrested in traffic stops and assure Latinos that the department is there to also protect them.

"Constitutional policing is an essential element of effective law enforcement," according to the DOJ lawsuit. The sheriff's office "and Arpaio's conduct is neither constitutional nor effective law enforcement."

One of the examples cited in the lawsuit was a Latino woman who is a U.S. citizen and was 5-months pregnant when she was stopped as she pulled into her driveway.

When the woman refused to sit on the hood of a car as the officer insisted, the officer pulled her arms behind her back, slammed her stomach first into the vehicle three times and dragged her to his patrol car. He shoved her into the back seat and made her wait for about 30 minutes without air conditioning, the lawsuit said.

Eventually, the woman was cited for failure to provide proof of insurance, but the matter was resolved when she provided such proof to a court, the lawsuit said.

The sheriff has said the investigation was a politically motivated attack by the Obama administration, denied allegations of systematic discriminatory policing and insisted that the Justice Department provide facts to prove its allegations. The Justice Department has said a 22-page letter it sent to Arpaio in December provided those details.

Arpaio is a national political fixture who built his reputation on jailing inmates in tents and dressing them in pink underwear, selling himself to voters as unceasingly tough on crime. Along the way, he aggressively pushed for a stronger role for local police to confront undocumented immigration, launching 20 patrols looking for undocumented immigrants since January 2008.

During the patrols, deputies flood an area of a city – in some cases, heavily Latino areas – over several days to seek out traffic violators and arrest other suspected offenders. Over the last three years, he also raided 58 businesses suspected of breaking a state law by knowingly hiring undocumented immigrants.

Earlier in the three-year investigation, the Justice Department filed a lawsuit against Arpaio, alleging his office refused to fully cooperate with a request for records and access to jails and employees. That 2010 case was settled last summer after the sheriff's office handed over records and gave access to employees and jails.

Separate from the Justice Department's allegations, a lawsuit that alleges that Arpaio's deputies racially profiled Latinos in immigration patrols is scheduled for a July 19 trial in federal court.

A federal grand jury also has been investigating Arpaio's office on criminal abuse-of-power allegations since at least December 2009 and is specifically examining the investigative work of the sheriff's anti-public corruption squad.

The Obama witch hunt for those on his enemies list continues. No president in history has been so divisive and shamelessly politcal. Holder is in much hotter water of his own and it isn't over 'allegations'. It's over verified fact: He gave weapons to criminals that then used those weapons to kill innocents. He will soon be found in contempt of Congress for his lies and deceit. Contempt is the appropriate finding for such a contemptible thug.

Those in my law school class were all surprised when the Justice Department under Reagan hired Kurt as a lawyer for the Civil Rights Division. We all knew that Kurt didn't believe in Civil Rights for anyone except young, rich, white men (and made that abundantly clear in his periodic racist rants in class). It seems that the Reaganites were illegally doing political screenings for civil service jobs like the Bush DOJ actually got caught doing later on. The saving grace of it all was that Kurt flunked the Missouri Bar and had to be fired.

The Civil Rights Division is so effective and accomodative that it rarely has to bring a case. When the study of Southern Maricopa County arrests which shows US Citizen arrest patterns differentials of 300% white versus Latino [Latinos 4 times more likely to be arrested for the same actions], it will be more surprising than the study of Northern Maricopa County with arrest differentials of 800% {which is to be expected from intentionally racist policies]. Perhaps that is not as dramatic as the physical abuse of the pregnant woman, but it will be the end of any argument that could ever save Arpaio from judicial supervision that the judge will impose.

One other comment... According to the President, the border between the U.S. and Mexico is mostly complete (I know, I know, but that is what he said). The truth is that it is about 5% complete. I wonder if I had a car that was 5% complete, would it run?

Interresting... I wonder if the fact that he is patroling the U.S.-Mexican Border have anything to do with looking for Hispanics? If he was patroling he Canadian Border, would he be looking for Caucasians? As far as the example of the woman being stopped... well it seems that she might not have been cooperative. I don't believe that if she had been cordial and cooperative, she may not have been treated badly... atleast that is what I suspect. It is amazing how many people, commiting criminal acts, give the police so much crap, then expect to be treated well. Rules of social interaction that come into play would say that if you treat someone in a certain mannor, that you get the same treatment back. I believe that the police have a difficult job... they often have to take so much crap from people, and then are expected to act calmly, nice, and professionally. I couldn't do it... Sometimes they do lose it. As far as the DOJ "alleging his office refused to fully cooperate with a request for records..." isn't that what Eric Holder is doing right now to congress? The patients are running the asylum!

Police are trained to handle situations effectively - not to use wanton brutality. That can NEVER be condoned. That is never a "social interaction".

As the Justice Department's lawsuit points out, the Hispanic population of Maricopa Country, which includes Phoenix, grew by an astonishing 47% between 2000 and 2010. I think that this is going to make the Justice Department contention that the Maricopa County Sheriff 's Office has made Maricopa County inhospitable to Hispanics look a little dubious.

This is a sad day for LEGAL AMERICANS everywhere; our social services, prisons, and health care facilities are being driven to bankruptcy, due to the tidal wave of ILLEGAL aliens flowing across our borders. Sheriff Arpaio was simply enforcing a law that the Federal Government ignores for political purposes.

Maybe we should adopt the same immigration law that Mexico has and enforces. After all, they are encouraging ILLEGALS to enter the U.S. It would figure that they have a very lenient law when it comes to immigration, now wouldn't it??

It is funny, the Liberals are always crying about people like Arpaio and how they mistreat Ciminals, until one of the Criminals commits a violent crime involving them or thier families. Then the Criminals go from poor mistreated souls to SOBs in an instant. They then sceam, "where were the police or why did you let him go"! I have seen it a million times and just have to shake my head in wonder. The change is so dramatic and so fast. This is the case with illegals also. They want them to have so many rights, until it involves them in a negative way.

My comment was made in general and not to be applied only to this incident. Even in this incident the person involved could be making a false compaint. Unless you were there, you do not know all the facts. You are relying on the press for your information and even this has not been proven to be correct. People make false complaints all the time. Wait until things are complete before coming to judgement so soon. Now how is that for logic? Maybe you are the one who is not being completely logical here.

Try to follow this: in our country we have a law that dictates Innocent Until Proven Guilty. Perhaps you are unable to parse this, but what Arpaio is being charged with is OVERREACH of our actual laws. Overreach, discrimination, ignoring sexual assaults if they're against women of color, corruption and cover-up. That you would allow a easily proven corrupt elected official to override CONSTITUTIONAL protections - or worse, ignore them when you find them inconvenient - and then charge liberals with being soft on crime only shows how intellectual bankrupt you are. He has had many charges made against him and has not been found guilty of any of them as of yet. You assume that the charges against him are correct without the benifit of all the information or the judgement of a jury. I would have to say you are the one who is intellectually bankrupt here. You say innocent until proven guilty in one sentence and in the next find someone guilty without all the information. I am not the angry person you think I am. In fact I spent my life investigating this very type of complaint. Some were true and some were not, but you never know until all the facts are on the table. You must truly be comfortably numb or just so one sided you can not wait until all the facts are available.

Maricopa County has successfully defending itself against similar lawsuits by pointing out that its tactic of concentrating its resources in high-crime areas causes the racial disparity in number of stops. New York City use the same argument to defend its frisk and search policy, which produces far more lopsided demographics than Maricopa County's policies. Much of the Jusrice Department's lawsuit is directed at the Maricopa County's efforts to apprehend undocumented immigrants. The anticipated Supreme Court ruling in favor of Arizona's SB 1070 would destroy this portion of the Justice Department's case. It's doubtful that the Justice Department will be able to prove its contention that the Maricopa County Sherriff's Department has made the country an inhospitable place for Hispanics. As the Justice Department lawsuit points out, the Hispanic population of Maricopa Country, which includes Phoenix, grew by an astonishing 47% between 2000 and 2010.

And for those that are here LEGALLY, they are an amazingly nice group of hard working, and caring people. They too, for the most part, agree with Joe Arpaio and with Jan Brewer - so I hope that if and when we have to appear in the Kangaroo Court with Eric Holder, we have equal representation of Hispanics as we will political favor givers.

Logic 101: If the Sheriff's Department receives a report like "the suspect has recently been seen driving a RED car" , what COLOR cars should they be scrutinizing?

Incredible, everyone said "RED". When you think about it, it would be idiotic and wasteful of time/manpower to check an equal number of all the other color cars so RED car owners do not feel discriminated.

Now, re-read the above substituting "person/people" for "car" and "Hispanic" for "red".

Do they really need to defend scrutinizing Hispanics after being given the order to reduce the number of illegal entries from Mexico?

Good argument but with a slight error....you are probably referring to Syria rather than the US: see in this country we have a thing called the Constitution which prohibits warrantless searches, kidnapping of political opponents, arresting of critical editors, and midnight knocks on the doors of whistleblowers. So, perhaps Joe is more suited to be a 'sheriff' in Syria than the US. And they will welcome him too....they love anyone who is so rabidly anti-American over there.

Wowzers, to give Sheriff Joe and appointment like that would be like handing someone the greatest gift that one could ever desire. He'd have two of his greatest wishes fulfilled. If he so desired, he'd likely let Janet Napolitano "drown" as they were not really good friends when she was the Governor of AZ. and they certainly did not see eye to eye on many things that went on in this state. And, as leader of Homeland, he might just gain control of the National Sheriff's Ass'n in some unique manner, and then the 51 States in the Union would have a new set of rules to follow. One thing that I'd buy stock in if that happened would be a company that makes PINK UNDERWEAR and another that makes 8 man tents. LOL.
