John Edwards Trial: Former Presidential Hopeful To Present Case To Jury

John Edwards Trial Latest News
John Edwards' lawyers are expected to begin calling witnesses on Monday.

RALEIGH, N.C. -- A federal judge refused to throw out campaign corruption charges against John Edwards, so the former presidential hopeful will have to present his case to a jury.

Edwards is accused of masterminding a scheme to use nearly $1 million in secret payments to help hide his pregnant mistress as he ran for president. He has pleaded not guilty.

Here is a look at the first weeks of the trial, and some highlights of witness testimony:

Q: WHAT EVIDENCE HAS THE PROSECTUTION PRESENTED SO FAR?

A: Prosecutors showed two members of Edwards' inner circle, campaign finance chairman Fred Baron and fundraiser Andrew Young, engaged in a yearlong cover-up to hide the married presidential candidate's pregnant mistress from the media as he ran for the White House in 2008. Young, who is married, falsely claimed paternity of his boss' baby and received $725,000 in secret checks from an elderly heiress, using some of the money to care for the mistress, Rielle Hunter. A wealthy Texas lawyer, Baron provided Young and Hunter $319,500 in cash, luxury hotels, private jets and a $20,000-a-month rental mansion in Santa Barbara, Calif.

Q: TO WHAT EXTENT HAS THE PROSECUTION SUCCESSFULLY MADE THEIR CASE?

A: After years of Edwards saying he had no knowledge of the cover up, prosecutors introduced phone records, voicemails and other evidence showing he was in frequent contact with Baron, Young and Hunter, all while his mistress was in hiding. Former members of Edwards' campaign also testified that Baron spoke of "moving Hunter around" in the candidate's presence and that Edwards told his speechwriter he knew "all along" what Baron was up to. However, in 14 days of testimony no witness ever said Edwards knew he was violating campaign finance laws, a key element of criminal intent the government must prove to win a conviction.

Q: WHAT STRATEGY WILL THE DEFENSE USE?

A: Defense lawyers for Edwards have hammered the credibility of Young, the prosecution's main cooperating witness, showing he fabricated parts of his 2010 tell-all book about the affair and that he siphoned off much of the secret money to build his family's dream home. Edwards' lawyers will also call former members of the Federal Election Commission to testify that the scheme to hide the mistress didn't actually violate campaign finance laws. It's unknown whether Edwards, a former trial lawyer, will take the stand in his own defense.

Q: IF CONVICTED, WHAT KIND OF JAIL TIME MIGHT EDWARDS FACE?

A: If convicted on all six counts, Edwards faces a maximum sentence of 30 years in prison and $1.5 million in fines.

Q: WHAT HAVE BEEN SOME OF THE MOST DRAMATIC MOMENTS SO FAR?

A: During emotional testimony that saw Edwards' 30-year-old daughter flee the courtroom in tears, former campaign advisor Christina Reynolds recounted an October 2007 fight at a Raleigh airport where an enraged Elizabeth Edwards confronted her husband about his affair, ripping open her shirt and baring her chest.

Former aide Andrew Young testified that when Edwards learned Hunter was pregnant, his first reaction was to express doubt he was the father and call his mistress a "crazy slut."

Young also described his climatic last meeting with Edwards in August 2008 on a secluded road near the former senator's Chapel Hill mansion. Young said Edwards was nervous and acting so paranoid the aide feared his boss had hired men to shoot him.

SOME OF THE KEY QUOTES IN TESTIMONY:

_ "You can't hurt me, Andrew. You can't hurt me." – Edwards' last words to Young, as recounted by the former aide on the witness stand.

_ "He said he could be to poverty what Al Gore was to the environment." – Young recounting Edwards' plan to solicit a $50 million donation from heiress Rachel "Bunny" Mellon to establish a foundation to combat poverty after his political career collapsed.

_ "I've never asked anybody to pay a dime of money, never been told that any money's been paid. Nothing has been done at my request. So if the allegation is that somehow I participated in the payment of money – that is a lie." – Edwards in the 2008 interview on ABC's Nightline that was played for the jury at his criminal trial. Evidence presented by prosecutors showed numerous statements made by Edwards during the interview were lies, including his denial of fathering Hunter's baby.

_ "You don't see me anymore!" – Elizabeth Edwards yelling at her cheating husband as she exposed her breasts, as recounted by Reynolds.

_ "She thought maybe you should probably pay for your girlfriend yourself." – 101-year-old heiress Bunny Mellon's reaction upon learning some of the $725,000 she secretly provided to help Edwards went to hide his mistress, as recounted by Charlotte interior designer Bryan Huffman.

_ "She thought it was a little low." – Huffman's reply after a prosecutor asked if Mellon was aware of a federal law that then limited individual political contributions to $2,300 per election cycle.

Edwards proved himself to be like most politicians - large egos that lose sight of decency and try to cover up their 'sins' in order to keep pursuing the goal of being elected.

What he did to his wife is nasty (at best).

But - he isn't the only man (or woman) in America to do this to their spouse or significant other.   The only difference is that he is a public figure who ran for  Read More...

Edwards actions are so morally repugnant that I question whether his middle name is Newt.

Is this a giant waste of time and taxpayer money, however? In light of Citizen's United, this form of impropriety (if it is actually a violation) is peanuts. It would be different if he pulled the cash out of funds that small donors gave him for the election, but I must be missing something because all I hear is that a couple of very large donors gave him money so that he could hide his illicit (and morally repugnant, can I say that again) affair.

I feel badly for people who believed in this guy.  He really tainted the entire Democratic pool of candidates.

Mr. Poverty, indeed.

It seems to me, whatever Edwards' moral failings may be, the government's case is weak at best. The case before the jury, however, will be tainted with his moral failings -- the prosecutor's tactic -- and Edwards is going to go down.

Did anyone bring evidence of donor tax returns, and how they characterized the "gifts?" In other words, were gift taxes paid? Was it claimed as a donation rather than as a gift?

Not one of those who helped Edwards had any reason to do so unless at the behest of Edwards. Common sense just tells you that. That others wouldn't spend fortunes throwing money at Hunter etc just to protect Edwards when it's been clear he was warned he was getting himself into trouble.  Bottom line:  When Edwards said, "You can't hurt me, Andrew. You can't hurt me." –he wasn't just saying, 'Don't do this', but voicing his sense of invincibility, which is what got him to where he is now.

Johnny always talked about the "two Americas"; the one with laws that applied to Johnny and the one with laws that didn't apply to Johnny.

the moralistic bull I hear here from many commentors is absurd. They want to put this guy away because he cheated on his wife that had breast cancer. Dont recall this one being against the law, maybe some peoples moral laws but not a criminal one. Grow up. Marrriages dont work out and people do things others dont agree with, thats life. No laws broken as it was a personal gift with taxes paid and not a campaign contribution. Once the federal elections officials testify that this was not a campaign contribution and violated no laws, I suspect Edwards defense will ask for the case to be thrown out and this will be granted. I hope Edwards sues everybody involved for malicious prosecution.

Notice how the headlines and Edward's Hollywood-type pics are a manipulative way to generate support and sympathy for this coward. Psychological marketing at its finest.

I can't wait for the jury to find this pathetic excuse for a man guilty and watch the hand-cuffs get slapped on him and see him hauled off to serve a LONG stretch in Big Boy Prison. It will serve John Edwards right for what he has put his wife and family through.

It's interesting that you want him 'punished' for his morality. That's not what the criminal justice system is for. You're going to be more comfortable in Iran, where the justice system is for morality crimes. Have a nice trip.

if he didn't violate the campaign laws as ....ie the lawyer for his wealthy benefactor claimed it was a personal gift and as the Federal election officials will testify....... then he should walk regardless of whether you like him or not.

The truth is, most of the money went into the assistants house..if anything, that is the assistants fraud.

if we put everyone in prison we didn't like or who acted stupidly.....most of us would be in a cell.

The mistress put out and took money in exchange. Isn't there a word for that?

The mistress's husband moved into the house bought with that money and agreed to raise the child. Isn't there a word for that?

Agreed, we all act stupidly. We all do things in the privacy of a locked room that we would never do on stage. But shouldn't we expect a wee bit higher level of ethics from those who would lead us?

Edwards did not father a "love child" out of nessity. It was an unfortunate outcome of the heady intoxication of hubris that comes with visions of being Attororney General, Supreme Court Justice or President.

I was invited to speak at a seminar in North Carolina while Edwards was still the Pretty Boy candidate with the picture perfect marriage. When the speakers chairperson found out my partner and I are not married (long term heterosexual domestic partners), I was removed from the program. In the words of the chairman when he dumped me, "We have a state law in North Carolina that prohibits us from subsidizing moral turpitude." What hypocrisy.

John Edwards is going to present his own case to the jury? Now, that ought to be a good show. I hope he's got some tear drops at the ready, and some tissue for his issue...
