McDonald's Soda 'Thief' Mark Abaire Arrested Again At Pizza Hut

The Huffington Post  |  By Posted: 05/14/2012 9:33 am Updated: 05/14/2012 12:26 pm

Fast food is his quick ticket to jail.

Mark Abaire -- charged with a felony last month when he requested a cup for water at McDonald's only to fill it with soda -- was arrested again last week, this time at a Pizza Hut.

It's the second time that the Naples, Fla. man has been arrested at the exact same Pizza Hut on the exact same charges: trespassing and open container violations, according to the Naples Daily News.

Last Monday, Abaire was spotted by cops outside the pizza joint at about 3:30 a.m. Officers recognized him from his McDonald's run-in and approached. He allegedly had booze on him, United Press International reported.

Abaire reportedly said he returned to the Pizza Hut because he dropped his lighter.

Abaire, who is homeless, made headlines in April when he allegedly filled a McDonald's water cup with soda despite an employee's warning. Police slapped the suspect with a felony charge because of his long rap sheet in Naples.

He's scheduled to appear in court again this week.

Correction: An earlier version of this story stated that Abaire has a long rap sheet in Naples county. It was in the city of Naples -- there is no Naples county. We regret the error.

The soda incident was at Macs... this one at Pizza Hut was only having an open alcohol container on him (drinking) outside at 3.30am - after the restaurant was closed. That's nothing. This time he was not stealing anything, yet that seems to be lost on the majority of posters here.
He's homeless, but I don't think this time he was looking for trouble. I think once you fall into the homeless trap you are basically stuffed. He is 52, so his job prospects are virtually nil.

The homeless ought to have an opportunity to be employed by the Government. Maybe harvesting grapes or apples or working for the military in some capacity...washing dishes in mess halls or something. Better to think of ways to help others than to criticize others.

Then what is he doing with the two dollars I gave him outside? No but really I should of stated it in my origanal post, I was referring to the ones who order a big mac and a water cup. I know people who aren't poor or homeless and still do that is what I really meant.

I do the EXACT SAME THING BUT I'll drink the WATER FIRST then refill with soda if I want.

It doesn't matter if you drink the water first. If you asked for a cup for water and later take soda, it's called stealing.

I felt sorry for the guy until I read the article and see he had a bottle of booze and hanging around a closed restaurant at 3 in the morning.

How many restaurants have you hung out at at 3 a.m. drinking with no place to go?? I imagine it to be a lonely, painful life. If I were not home in a nice warm bed,I'd have given him a buck or two. What would Romney do???????????

If he stole hundreds of millions or billions from the little people he would be held up as a great man.

But he stole $1.50 from an international megacorporation.

In the article is says this latest arrest was for an open bottle of booze and trespassing at 3 am. Sound like the guy has a host of problems and probably needs help more than prison time

If you read the past article you would have seen he was charged with a felony because it wasn't his first offense

Not entirely happy about how Obama has NOT held "Wall Street" players more accountable....But, Romneys answer seems to be to allow them MORE freedom and LESS regulation, and PRETEND that all will "work out" well as a result.
We CAN'T have that ..... We WON'T be having that..: )

Such a smart way to spend the public's funds for law n` order.

Tell the guy if he takes out the trash he can earn a soda. Is this SO freakin` hard to figure out?

I know the comeback...
