North Carolina State Bureau of Investigation Forensics Scandal Grows With New Evidence of Fraud

A forensics expert for the North Carolina State Bureau of Investigation repeatedly lied on the stand while providing testimony crucial to the 2003 conviction of a novelist accused of murdering his wife, a state judge wrote in a lengthy order published last week.

Michael Peterson's conviction was overturned and he was granted a new trial in December 2011. In his May 9 order, Durham County Judge Orlando Hudson affirmed the decision and described at length how the expert, Duane Deaver, an agent with the North Carolina State Bureau of Investigation, misled the jury about his qualifications and the reliability of his scientific opinions in the Peterson case.

The revelations of misconduct in the Peterson case are only the latest developments in a nearly three-year scandal that has badly battered the credibility of North Carolina's criminal justice system. An independent audit completed in 2010 found that agents at the state crime lab manipulated and withheld the results of hundreds of tests to confirm the presence of blood, tainting prosecutions based on that evidence. Deaver was implicated in some of the most serious misconduct, including hiding exculpatory test results from defense attorneys in a murder case.

The allegations in Hudson's order involve the agency's bloodstain analysis unit, which was separate from the blood analysis unit and not previously implicated. Bloodstain analysis examines stains to determine how a violent crime may have been committed. Deaver led the unit and trained other agents who worked there in bloodstain analysis.

"Obviously, the findings call into question another major area where there apparently was also widespread misconduct," said James Coleman, a professor at the Duke University law school and cofounder of the law school's Wrongful Convictions Clinic. "It's just another indication of how broad the problem likely is."

An attorney for Deaver did not respond to a request for comment.

Hudson accused Deaver of perjuring himself while testifying against Peterson, a Durham novelist whose wife's dead body was found in 2001 at the bottom of a flight of stairs in their home. Peterson argued that his wife died as a result of an accidental fall. Prosecutors called it premeditated murder, relying on Deaver's interpretation of blood stains.

But an investigation by Peterson's lawyers found that Deaver grossly exaggerated his experience in analyzing bloodstains at crime scenes during the trial and that the experiments he conducted in the Peterson case were amateurish and unscientific. Deaver had a degree in zoology and lied about being tutored in bloodstain analysis by a senior expert in the field.

Deaver "deliberately and intentionally misled the jury at Mr. Peterson's trial about the scientific basis and acceptability of his opinions, methods and experiments," Hudson wrote.

The case against Peterson was circumstantial, and Deaver's expert testimony was the only evidence presented to the jury to support the state's charge of premeditated murder. From the stand, Deaver told the jury that he worked on 500 cases involving bloodstain analysis. In fact, he had worked on just 54 bloodstain cases. Deaver also testified that he worked on 15 cases where he was called on to use bloodstain analysis to distinguish an accidental fall from an assault. Records showed Deaver had done no such work.

Hudson said from the bench that he believed Deaver was guilty of perjury in the case. But no charges have been filed against him. In response to queries from the Huffington Post about whether charges would be brought against Deaver, Noelle Talley, a spokeswoman for the attorney general's office, said that is the responsibility of county prosecutors.

"In North Carolina, criminal prosecutorial decisions are made by District Attorneys who are locally elected by the people of their districts," Talley said in an email.

Roy Cooper, the attorney general, confirmed in January 2012 that an internal investigation was underway of past cases involving the state's bloodstain analysis unit, which was disbanded in 2011. Talley did not respond to a request for comment on the probe.

Deaver, who was fired in January 2011, is also at the center of a growing web of litigation that could ultimately cost North Carolina millions. In one lawsuit, he is accused of deliberately withholding lab results that would have helped prove the innocence of a Raleigh man accused of murdering a prostitute. That man, Greg Taylor, spent nearly 20 years in prison before being exonerated by a state commission charged with investigating prisoners' claims of innocence.

Peterson has been released on bond pending a new trial.

It is no wonder that the NC AG office passed the buck... The fox watching the hen house. When assistant AGs are allowed to perjure in open court, alter evidence and tamper with witness testimony it is no wonder why silence is golden. Lady justice in NC is not blind. The people that are in charge think that they are above the law. Until the people ask they will continue to use the law to their advantages. They are many Deavers with the title of law enforcent officer in NC.. So when the question is asked why this man continue to be allowed to be free? It start at the AG Roy Cooper office and ends there. He is the chief lawman in that state and this happen in his backyard .... Literally. All them need to be investigated at the federal level..... The old saying that if one continues to shake the apple tree...The rotten ones will eventually fall at one's feet.....fits well when discussing law enforcement in NC.......

go read Durham-In-Wonderland.this is Mike Nifong country.The Duke Lacross case.Nifong's replacement,Tracey Cline,was removed from office for waging a vendatta against Judge Hudson.the whole system down there is corrupt beyond words.it really boggles the mind.

It's a "Get Out Of Jail Free" card that even stupid, lazy attorneys can figure out. Any case where this man testified & the defendant was convicted will be overturned sooner or later.

Not only has it resulted in the innocent being convicted, it's going to result in the guilty having their convictions overturned as well.

It's injustice when the innocent are wrongly convicted and it's injustice when the guilty are wrongly freed. But that's the only acceptable way to ensure justice. Hopefully there's enough evidence untainted by wrongdoing to convict the real bad guys at their new trials.

Dang.........I remember watching a show about this case. I hate that Peterson is walking around because I really feel like he is guilty. However, I am mad about this whole perjury scandal and how many other people may have had their lives ruined because of lies like this.

I watched a documentary about this case and with that man's testimony, I would have convicted Petersen as well. Now I think this guy should get life because he took life when he lied and put possibly innocent people into prison. He destroyed lives, he destroyed families. This guy has daughters who he loved and they did not believe him guilty. I don't know if they still believe in him but they have had to live without him because of this man and what he testified to. Perjury? They have already concluded he is guilty of that at the very least.

One of the biggest problems we have in the south is that we(the voters) tend to promote prosecutors to judges. Their world view is so skewed that it very hard to get a fair trial. I've never voted for a former prosecutor running for judge unless he has been in private criminal practice for 5 years or more.

My understanding from The Innocence Project is that if the prosecutors are sued in the civil court...i.e. malicious prosecution...and lose, we, the taxpayers pay the settlement. We need to drop immunity and make these folks accountable with criminal charges and loss of license. Otherwise they will never stop doing what they are doing. How they sleep at night I will never know.

This was a very famous case. If North Caroline was brazen enough to use fraud to convict this man, then imagine what they did in low-profile cases?

Around the same time, I was working in North Caroline when a big story came out that rape victims were billed for their own rape kits. I do not understand this state.

Basically we're stuck half-way between Virginia & South Carolina. It's a state that wants to be progressive, but too often finds itself stuck with a case of try to take two steps forward & they drag you one step back.

Quite a large percentage of our worst, most regressive elements are carpet baggers who came down here to implement Nixon's "southern strategy"

Our Congressional representation is split 7 Democrats & 6 Republicans and we have one Democratic Senator & one Republican Senator.

Half of the Republican representatives moved to North Carolina from north of the Mason-Dixon Line, and the Republican Senator moved here from Virginia.

A degree in Zoology? Is that what it takes to get such an intricate job? That is unbelievable. This guy obviously didn't know whatthehell he was doing. Of course he should be charged. Just look at all the damage he's done. His degree in Zoology is probably fake also. Anyone convicted in a crime in which blood stains or blood spatter was used should get a new trial, period.

They sure should.... but personaly I think that would still leave plenty of innocent people in prison behind this PURPOSELY manipulated evidence that came from this DISHONEST lab. I think the lab that is that sloppy in the blood splatter department is NO better in the BALISTICS arena.
