Ohio Horizontal Drilling Rules Approved By State Senate

COLUMBUS, Ohio (AP) — Ohio senators approved new regulations for horizontal shale drilling on Tuesday in a bipartisan vote punctuated by a spoken rendition of "The Beverly Hillbillies" theme song.

State Sen. Bill Seitz, a Cincinnati Republican, used the 1960s sitcom's protagonist — who became an instant millionaire when he discovered oil — to urge fellow lawmakers to dispense with critics of hydraulic fracturing and get drilling moving in the state.

"Folks, we're sitting on a mountain of money," he said. "People who have been poor as church mice for 150 years are now going to be the latter-day Jed Clampetts."

The detailed energy bill cleared the chamber, 27-6, with backing from both Republicans and Democrats. It also adjusts Ohio's renewable energy standard, which set a timetable for utilities to meet usage thresholds, to include waste heat such as that generated from factory smokestacks.

Supporters said the bill balances environment, public health and safety, and commerce by expanding chemical disclosure and water testing requirements. It goes next to the Ohio House.

Gov. John Kasich said the bill ensures that "Ohio approaches energy production and consumption in a safe and responsible way, while also giving families and job creators access to more affordable energy."

The bill requires well operators to disclose the location they'll draw water from for blasting into the well to release oil, natural gas and natural gas liquids, as well as the rate and volume at which they'll withdraw it.

The legislation also requires well operators to disclose all chemicals that will come into contact with human water supplies during the drilling operation, though not the specific recipe. Water samples must also be taken at all wells within 1,500 feet of any proposed horizontal well.

No Frack Ohio, a coalition of anti-drilling groups, said such provisions won't help the public because reports won't be timely or specific enough. They said the bill was written by the oil and gas industry and benefits them at the expense of Ohio residents.

"The chemical disclosure requirements in this bill are meaningless, as the industry is only required to give a yearly report," Cheryl Johncox of Buckeye Forest Council said in a statement. "How can a citizen establish baseline water testing when they don't know what chemicals to test for?"

Johncox also criticized a provision that prevents doctors from sharing concerns about patients' exposure to chemicals with local health departments or first responders.

Republican Senate President Tom Niehaus took the rare step of leaving his official perch Tuesday to praise the bill. He said it protects the environment, public safety and health while encouraging a growing industry — going further even than Colorado's "gold standard" drilling rules.

"We do things that Colorado hadn't even contemplated," Niehaus said.

Critics said the bill ignores disposal of wastewater from hydraulic fracturing, or fracking, that has become an environmental issue in eastern Ohio. Disposal of the millions of gallons of chemical-laced water used in the fracking process in a deep-injection well has been tied to a series of earthquakes in the Youngstown area.

Sen. Shannon Jones, the bill's sponsor, said wastewater regulations would be addressed in separate legislation.

When oil and gas companies poison our water, their executives get a bonus.  When terrorists poison our water, they get indefinite detention, torture, and the death penalty without trial.  It's obvious by now that we have a two-tiered system of justice.  The wealthy are immune from prosecution, while the 99% get draconian law enforcement.

Ohio has lots and lots of flat empty land perfectly suitable for wind turbines and solar panels. Drilling for gas and polluting the water is incredibly stupid.

I attended many days of the hearings in the Ohio Senate. I testified before Sen. Seitz in the Senate Energy and Public Utilities committee. The entire time he was not paying attention. He was arrogant and disinterested. After all public testimony was given, the senate slipped in provisions in favor of Gas and Oil industry including a gag order on doctors stating that they can not disclose any information for any purpose on the chemicals their patients are exposed to through hydraulic fracturing except to diagnose and treat. There is not way to alert the public about possible contamination or avenue for discovering the source. As a nurse I am horrified at the influence Gas and oil money has had on the Ohio legislature.

What amazes me is that we have enough natural gas and that fracking is the dirtiest way to get more. They are not just drilling here, they are breaking up the rocks that keep the substrata stable. In Switzerland where they actually need the gas, they stopped all fracking because of earthquakes and damage to the aquifer. We may die of thirst but we will die warm, shaken and hungry!

The planet and it's people are going to "Perdition" in a hand basket filled with greed and the almighty dollar. There is no such thing as "safe fracking" It pollutes aquifers. Some have become so greedy that they do not care that they are killing their own grandchildren. Why is it so important to have more money than a person needs? People are important, not "things'. No one needs the fanciest car, the biggest house or the latest large TV.

I am ashamed of EVERY Democrat who ignored the harmful affects of fracking on the lives of their constituents. The Fracking Industry is getting sweetheart deals in state after state, so they have absolutely no impetus to guarantee that this procedure is done safely, with the least amount of harm to the environment or the people who live in the vicity. I expected this from TeaTHUGliCANTS, who ALWAYS back industry over the individucal but I thought that the Democrats would at least fight the good fight. In the end, I guess the God of MONEY always wins in the end. It has happened here in PA, I'm sorry to see it happen in Ohio.

There have been a few leaders who didn't follow the blessed buck. Two of them were named Roosevelt. The Republicans have been worshipping at the alter for years and it looks like some in the Democratic Party are doing the same. The only recourse we have, as voters, is to get rid of politicians when it becomes clear that they have betrayed us.

About time we are allowed to mine our own resources. I am sure we will be hearing from the EPA and they will fine them to death via the administration. We should also keep this project under close scrutiny for contamination. We will learn what and what not to do. Good for Ohio. This Country is so ready for an economic recovery but it will not happen until remove the fraud from the WH.

Yeah we will learn what and what not to do...after the contamination is already in the groundwater and it is too late. How do states keep allowing this practice when it is so apparent and proven that fracking is causing all kinds of pollution and human costs?
